All photos and images taken by Parties remain the sole, copyrighted, intellectual property of Parties. Parties may reproduce, use and distribute the photos and images for any personal, business, marketing or studio purpose. Model expressly agrees to release to Parties any personal or proprietary interest in the photographic materials that result from the session, and agrees that Parties may showcase, sell, or otherwise distribute photographic materials from the session, including those depicting Model.
Social Media
This clause applies to social media including, but not limited to Facebook, Instagram, and website. When published online it is required that citation of Parties be made. The client agrees that they will under no circumstances alter the Parties photographs that are placed in public or on the internet. As Parties, I need photographs to be an accurate representation of my work so that future endeavors have a good understanding of my brand and style. The client agrees to be responsible for any family member or friend who posts our photographs online and agrees that they cannot be cropped (with the exception of forced cropping on social media), altered in color, or edited in any way.
Personal Injury Risk
1) I am a healthy adult, voluntarily participating in this yoga practice and I assume all risks of illness, injury, death, damage and/or loss to myself or my property that might result.
2) On behalf of myself and my personal representatives, heirs, executors, administrators, agents and assigns, I hereby release and discharge in advance Parties from any and all liability, even if that liability arises out of negligence and/or carelessness on the part of the persons or entities mentioned above.
3) My assumption of risk, waiver and release of liability, including negligence, encompasses, but is not limited to: death, bodily injury, illness, damage, theft and/or loss of personal property during said yoga event which occurs as a result of anything during the entire outing. The following are some, but not all, of the possibilities:
I have carefully read this Assumption of Risk, Waiver and Release of Liability, Including Negligence. I am aware that both predictable and unpredictable risks are involved during the outings conducted on behalf of Parties. I hereby agree to assume all of those risks and to release and hold harmless all of the persons or entities mentioned above who through negligence or carelessness would otherwise be liable to me or to my heirs or assigns for damages.
