Assumption of Risk

Waiver and Release of Liability

(collectively as “PARTICIPANT”, “I”, “MY”) request the entry and participation into the facility and activities sponsored by Gymnastics World, its affiliates, and licensees including but not limited to Cute Onyx, LLC (collectively as “GW”). I hereby consent for the Participant named above, to use the facility and equipment of GW, and participate in events, competitions, programs, and/or classes for training in gymnastics, trampoline, tumbling, dance, cheerleading, rock climbing, rope climbing, riding zip lines, and/or other activities, events, and associated skills and physical activities administered and or sponsored by GW.

Assumption of Risk

I recognize that potentially severe injuries, including but not limited to broken bones, dislocations, torn tendons, torn ligaments, brain damage, spinal and back injury, PERMANENT PARALYSIS or DEATH, and other risks and danger (collectively as “RISKS”, “DANGERS”), can occur in any or all of these activities. I also recognize that similarly SEVERE INJURIES can result from participating, helping, or spotting teammates as well as from folding, unfolding, transporting, and setting up apparatus and equipment. Furthermore, I recognize that because of increased movement, height, flipping, twisting and inversion, and increasingly complex routines, the competitive pursuit of these sports and activities may carry an increased degree of risk of injury and catastrophic injury, even at the recreational settings. I also recognize that the mats, pits, and other safety equipment and apparatus provided for PARTICIPANT’s protection, including the participation of a coach or staff member who will spot or assist in the performance of certain skills, may be inadequate to prevent certain injuries. I understand and willingly accept the inherent risks involved in these recreational and/or competitive activities, and that the above named PARTICIPANT may be injured in any or all of these activities. Despite the safety checks done by GW to ensure the health of apparatus I understand that equipment and apparatus may fail due to various reasons at any time and, I understand and willingly accept the inherent risks involved in participating knowing that the apparatus may fail during my participation causing RISKS.

The PARTICIPANT is not under any obligation by GW or its agents or representatives to participate in any of these activities or programs, nor is the PARTICIPANT being paid to do so. The PARTICIPANT’s interest is solely in the sport and/or activities and for his/her own self-improvement and enjoyment. I FULLY ACCEPT AND ASSUME ALL SUCH RISKS INHERENT IN THESE PURSUITS AND ASSUME ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES on my own behalf and on behalf of the PARTICIPANT. I also represent that the PARTICIPANT is in good and sufficient physical condition to participate in GW activities or programs. I agree and understand that I will NEVER be on any apparatus and equipment without the supervision of a GW staff member and understand that GW does not allow any participants on apparatus without supervision.

Waiver & Release of Liability

In consideration for allowing the PARTICIPANT to use GW facilities and equipment, and/or participate in GW events, programs, classes and/or competitions, on my own behalf and on behalf of the PARTICIPANT and each of our respective heirs, administrators, next of kin, executors and successors, hereby COVENANT NOT TO SUE and FOREVER RELEASE, discharge, and hold harmless and agree to indemnify GW, its officers, directors, shareholders, owners, employees, volunteers, agents, successors and assigns (collectively in this Waiver and Release as “RELEASEES”), from any and all liability, claims, medical, legal and/or other costs, demands, losses, damages or causes of action (known or unknown) whether existing now or in the future, including any loss of personal property due to theft or otherwise, arising out of my PARTICIPANT’s use of GW facilities, equipment, and/or participation in GW events, and/or while under the instruction, supervision or control of GW and/or any of the RELEASEES wherever caused, and whether caused or alleged to be caused in whole or in part by the negligence of any of the RELEASEES; and I further agree that if, despite this Waiver and Release of Liability, I or anyone on my own or my Child/Athlete’s behalf make a claim against any RELEASEES, I will INDEMNIFY, SAVE AND HOLD HARMLESS GW and the RELEASEES from any litigation expense, attorneys’ fees, loss, liability, damage or cost which may occur as a result of such claim, to the fullest extent permitted by law.

Communicable Diseases

I also acknowledge the contagious nature of COVID-19 and related/similar communicable diseases, or variants thereof (collectively as “DISEASES”) and voluntarily agree to the terms described in this document and assume all the risk associated with participating and attending in any and all activities sponsored by GW. I fully understand that I may be exposed to or infected by DISEASES, which may result in personal injury, illness, permanent disability, and even death.

I understand the risk of becoming exposed to or infected by DISEASES at the GW may result from the actions, omissions, or negligence of myself and others, including, but not limited to, GW employees, volunteers, independent contractors, agents, advisors, distributors, suppliers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to PARTICIPANT including, but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense, of any kind, that I, my family, and/or PARTICIPANT may experience or incur in connection with my attendance at GW or participation in GW programming.

I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of GW, its employees, volunteers, independent contractors, agents, advisors, distributors, suppliers, and program participants and their families whether a DISEASES infection occurs before, during, or after participation in any GW activity.
GW cannot guarantee that PARTICIPANT will not become infected with DISEASES. Further, attending sponsored activities at GW could increase your risk and PARTICIPANT’s risk of contracting DISEASES. 

Photo, Audio & Video Release

GW may take photos or videos of students participating in classes and/or events sponsored by GW, which may be used on our flyers or website. These photos are to be used solely for the advertisement and promotion of GW. I agree to grant GW the permission to use any such photo for display for promotional or non-promotional purposes. I give GW permission for the copyright and use/reuse of PARTICIPANT portrait/photographic pictures/audio video footage in publications and/or commercials sponsored by GW including websites or social media without any compensation.

I HAVE BEEN INFORMED BY GW THAT I/PARTICIPANT AM/IS/ARE ENTERING THE ACTIVITY AREA AT MY OWN RISK AND WILL ASSUME ALL RESPONSIBILITY INCASE OF ANY INJURY CAUSED DUE TO MY INVOLVEMENT IN GW FACILITY, BE IT DUE TO MY OWN FAULT OR DUE TO EQUIPMENT FAILURE OR NEGLIGENCE OF GW STAFF, including risk of DISEASES. This WAIVER OF LIABILITY and COVENANT NOT TO SUE, having been read thoroughly and understood completely, is signed VOLUNTARILY as to its content and intent, and I VOLUNTARILY CONSENT to PARTICIPANT’s and MY OWN participation.
