Golden Heart Ranch Official Waiver

I, the undersigned name* . am the individual or the parent/legal guardian of participants name* who is participating in the Golden Heart Ranch Activities. By signing the Release of Liability and Assumption of Risk, I certify that I am the adult with legal responsibility for the participant and freely enter into this agreement on his/her behalf.

I hereby waive and release, for myself, my child, my heirs, executors and administrators, any and all rights, claims, liabilities costs, injuries, damages and causes of action whatsoever I may have against Golden Heart Ranch and it's respective officers, directors, employees and agents relating to or arising from my/our participation in ranch activities, including but not limited to personal injury. I recognize the Activities have inherent risks of injury and I hereby knowingly and freely assume that risk, on behalf of myself and the participant. If I or the participant causes injury to any person or damage to any property while participating in the Activities, I hereby indemnify and hold harmless Golden Heart Ranch from and against any and all claims, suits, actions, losses, damages and expenses related to or arising from such injury or damage. I certify that I have read and hereby waive on behalf of myself and the participant the application of the following provision of Section 1542 of the California Civil Code which states:

"A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.". Initial Hereinitial*

I hereby give my consent on behalf of myself and the participant to Golden Heart Ranch and its affiliates to use my name and photographs, video and film ("Photos") of me before, during or after the Activities in advertising and promotional materials for Golden Heart Ranch, including but not limited to the Internet, without compensation. I agree that no advertising or other material need be submitted to me for approval. I agree that all Photos of me used by Golden Heart Ranch and its affiliates are owned by Golden Heart Ranch and they may copyright material containing same. I hereby release, discharge and agree to save harmless Golden Heart Ranch and its affiliates from any liability, including, without limitation, any claims for libel or invasion of publicity/privacy, by virtue of any use of mine or the particpants name and/or Photos, including, any alternation of such Photos, whether intentional or otherwise. Assumption of the Risks and Release. I recognize that there are certain inherent risks associated with attending or participating in any programs, volunteer activities, or special events at Golden Heart Ranch regarding COVID-19. I acknowledge the contagious nature of COVID-19 and understand that local and national authorities recommend the practice of social distancing, and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Golden Heart Ranch for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Golden Heart Ranch, whether caused by the fault of myself, my family, Golden Heart Ranch, both other third parities. Introduction and Purpose: The Activity (or Activities) described above will occur at a time when there exists a public health emergency arising form the spread of coronavirus that causes COVID-19 ("Coronavirus"), which has resulted in a global pandemic. Thus, there presently is a significant risk of community spread of the Coronavirus associated with the Activity. Participation in the Activity is not mandatory. Whether to participate in the Activity is a decision to be made by the Rancher who desires to participate ("Participant") and/or his or her parent or guardian ("Parent/Guardian"). Coronavirus Exposure: By signing this Waiver, you hereby certify to Golden Heart Ranch that neither Participant nor any of (i) your or the Participant's parents/guardians, siblings, or family members or (ii) anyones else living in the Participants's household (collectively, "Participant's Family"), at any time within the 14 days immediately prior to you signing this Waiver, have: (i) had close contact with or provided care for any person diagnosed with or suspected to have COVID -19; or (ii) experienced any of the following symptoms: fever, cough, shortness of breath, difficulty breathing, chills, muscle pain, sore throat, new loss of taste or smell. By signing this Waiver, you also hereby represent and warrant to Golden Heart Ranch that if, at any time prior to or during the Activity, any of the things described int he foregoing causes (i) or (ii) occur, you will promptly notify Golden Heart Ranch and you will stay away (or, if you are the Parent/Guardian, will keep the Participant and all of Participant's Family away) from the Activity.
