    Agreement made, jobseeker(Hereinafter “Candidate”) and MS STAFFING LTD (Hereinafter “MS STAFFING”).

    RECITALS

    a. Whereas the candidate represented by the candidate’s CV, which has been presented to MS STAFFING.

    b. Whereas MS STAFFING in regularly engaged in the business of matching qualified candidates for employment with employers of MS STAFFING’s network.

    c. Whereas the candidate wishes to engage MS STAFFING for the purposes of securing employment with an employer in MS STAFFING’s network and the Candidate hereby agrees as follows;


    1. SCOPE OF MS STAFFING SERVICES

    a. MS STAFFING agrees and commits to use its reasonable efforts to present the Candidate’s CV to MS STAFFING’s network of employers.

    b. MS STAFFING will use its best and reasonable efforts to secure and schedule employment interviews, associated trainings and skill tests relating to the role; provide ongoing advisory services as well as conducting negotiations of salary and other remuneration.

    2. COMPENSATION AND PAYMENT

    a. For services provided under and pursuant to this agreement, MS STAFFING shall be compensated as follows:

    i. Candidates will pay a registration fee of GHS 50.00.

    II. In the event Candidate is successful following an interview, or at any time, including any unspecified future date, a successful placement fee, also known as an agency coordination support fee, will be due to MS STAFFING. For service expended by MS STAFFING in providing services under and pursuant to this agreement MS STAFFING shall be paid a successful ONE-TIME placement fee in an amount equivalent to twenty (20) percent (%) of the monthly Net Salary offered to the successful Candidate, in the form of cash or direct deposit to MS STAFFING; following an acceptance of an oral or written employment offer to the Candidate or at the end of first month of commencement.

    3. CONFIDENTIALITY AND DATA PRIVACY

    a. Except as may be otherwise required by law, MS STAFFING exercise reasonable efforts to ensure that;

    i. Candidate’s information remains confidential and is available only to personnel who have a need to know such information in connection with providing Candidate with MS STAFFING’s services or otherwise for MS STAFFING’s general business purposes

    ii. MS STAFFING will not sell Candidate’s name, address or similar personally identifying information to unrelated third parties or permit the use of such information outside the scope of the MS STAFFING’s service or MS STAFFING’s general business purposes. The same level of confidentiality is expected from the Candidate. All documents between MS STAFFING and the Candidate are confidential unless otherwise indicated.

    4. INDEMNIFICATION

    a. Candidate shall indemnify and save harmless MS STAFFING and its employees from all suits, actions, losses, damages, claims, or liability of any character, type of description, including without limiting the generality of the foregoing all expenses of litigation, court costs, and attorney’s fees arising from or relating any employment secured by MS STAFFING.

    5. OTHER PROVISIONS

    a. Candidate shall not contact any employer in MS STAFFING network that MS STAFFING introduces to the Candidate directly for any reason without the prior written consent and instruction of MS STAFFING.

    b. If Candidate communicates with an employer in MS STAFFING’s network introduced to the Candidate by MS STAFFING, directly, Candidates must advise MS STAFFING in writing within one (1) hour immediately after. Failure to do so qualifies as a breach of confidentiality and may/shall result in the termination of this agreement and expose the candidate to liability for breach of contract.

    c. The Candidate shall update MS STAFFING in writing by email after each meeting or interview with an employer introduced to the Candidate by MS STAFFING. Failure to do so qualifies as a breach of confidentiality and may/shall result in the termination of this agreement and expose the candidate to liability for breach of contract.

    6. NOTICES AND PAYMENTS

    a. All notices and correspondences intended for MS STAFFING shall be sent to info@msstaffinggh.com and payments due to MS STAFFING under this agreement shall be addressed to MS STAFFING LTD.

    7. MODIFICATION OF AGREEMENT

    a. Any modification of this agreement or additional obligation assumed by either party in connection with this agreement shall be binding only if evidenced in writing signed by each party or an authorized representative of each party.

    In witness of the above, each party to this agreement has caused it to be executed and by ticking means the candidate is accepting the terms of the Company.
