Constitution of these United States,
AFFIANT
I, {name}, being one of the People (as seen in the 50 American States, & Texas Constitution Article 1, Section 2), republican in form, Sui Juris, do serve this affidavit to make the following claims and so that you may provide immediate due care;
Please take notice that all political power is inherent in the People, all free governments are founded on their authority, and instituted for their benefit. Tex. Const. art. II, § 2.
Please take notice that We the People are endowed, by our Creator, with certain unalienable rights, that among these are life, liberty, and the pursuit of happiness. No society in which these liberties are not respected is free, whatever its form of government.
"We hold these truths to be self-evident, that all men are created equal, that they are endowed, by their Creator, with certain unalienable rights, that among these are Life, Liberty, and the pursuit of Happiness." The Declaration of Independence para. 2 (U.S. 1776).
Please take notice that the Founders sought to ensure that our laws would be Publicly declared, knowable in advance, and the product of democratic processes. They sought to ensure that disputes about their meaning would be resolved by neutral judges, but perhaps most of all they sought to keep the government off the backs of the People and allow them room to author their own lives. Where rights secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them.
"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." U.S. Const. Amend. I.
Please take notice that laws, statutes, codes, ordinances, or regulations, that violate Constitutions of the United States are null and void, therefore, as a matter of jurisprudence, do not exist. Void things are as no things.
"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws." U.S. Const. Amend. XIV, § 1.
Please take notice that, when in the course of human events, it becomes necessary for one people to dissolve political bands, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature’s God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.
Please take notice that the history of government “agency” is that of repeated injuries and usurpations, all having in direct object the establishment of an absolute Tyranny over the People. To prove this, let Facts be submitted to a candid world:
- they have refused their Assent to Laws, the most wholesome and necessary for the public good;
- they have called together pretended legislative bodies at places unusual, uncomfortable, and distant from the depository of their public records, for the sole purpose of fatiguing the People into compliance with their measures;
- they have made Judges dependent on their will alone;
- they have erected a multitude of new offices, and sent out swarms of officers to harass the People, and consume their resources;
- they have combined with others to subject us to a jurisdiction foreign to our Constitution, and unacknowledged by our laws, giving their assent to their acts of pretended legislation;
- they have deprived us in many cases, of the benefits of trial by jury;
- they have declared themselves invested with power to legislate for us in all cases whatsoever.
Please take notice that all government information is presumed to be available to the public, and the purpose of the Texas Open Meetings Act is to provide the People with the ability to hold the government and it’s “agencies” (unconstitutional as they are to begin with) accountable, to fulfill the standard that: decisions entrusted to governmental bodies must be made by the body as a whole at a properly called meeting.
Please take notice that Texas Government Code §551.002 requires every regular, special, or called meeting of a governmental body is to be open to the public, with only very limited exceptions (Texas Government Code §551.002; and §551.071 through §551.090)
Please take notice that closed meetings can only follow open meetings, and adjournment to a closed meeting must be announced to the public in order to cause the governmental body to assess the applicability of the exceptions before deciding to close the meeting; to fix the governmental body’s legal position as relying upon the exceptions specified; and to inform those present of the exceptions, thereby giving them an opportunity to object intelligently (Texas Government Code §551.101).
Affiant demands you show in any United States Constitution where the right to participate in democratic processes can be derogated or abrogated by the state or it’s agent (express or implied) without the due process of law.
Affiant demands, in the interest of justice and the defense of our republican form of government, that you declare in writing and publicly, that the rights to life, liberty, and due process, are secured by the Declaration of Independence and U.S. Constitutions, and that any government, entity, or agent of government, that denies these rights, does so unlawfully.
Affiant demands that in the event you believe Affiant is wrong in the law, that you submit, in writing, an affidavit sworn under penalty of perjury, and postmarked by Monday next after the expiration of twenty (20) days after the date of receipt of this affidavit. Your sworn affidavit must include the evidence or the constitutional provision that declares these rights may be violated by the government and without the constitutionally mandated due process of law.
Please take notice that failure to respond indicates tacit acquiescence to the ongoing abrogation of the People’s Constitutionally guaranteed rights to Life, Liberty, and Pursuit of Happiness. This affidavit shall stand as evidence against you in all courts of record, that you do, with full known malice and intent, support the unlawful abrogation of the Peoples’ Constitutional rights and are acting in contradiction to the Constitutions of the United States, Laws of Nature, and Nature’s God. Supporting the abrogation of Constitutional rights is a violation of your oath to uphold the Constitutions of these United States, including the Texas Constitution, Article 16, Section 1.
