Nature of the Risk
Use of a floating Sauna (the “Sauna”) at Kiln LLC dba Kiln Floating Sauna (“Kiln”) can involve significant risk of bodily injury, illness and death and can create a risk to your health and well-being. These risks stem from the inherent nature of the activities associated with the use of any heated sauna. In addition, use of a floating Sauna such as that here presents unique risks of injury or death in addition to those described above related to the use of saunas generally. These unique risks stem from using the Sauna in cold weather, and using the Sauna in conjunction with, in proximity to and over water, including frigid water. These conditions may result in (or the aggravation of) health or medical conditions, including heart issues, increase or decrease in blood pressure, fainting, drowning, slip and fall, electrocution, dizziness and dehydration, shock, and hypothermia, and other illness. These risks can stem from the environment in which the Sauna is used, and also from the failure of the Sauna itself.
Please review the below Rules and Warnings. To minimize risks and the possibility of death or injury, please follow all Rules and be aware of and adhere to all Warnings identified in the attachment. Unfortunately, neither Kiln nor NPM Venture LLC, Navy Pier, Inc., the Metropolitan Pier and Exposition Authority, and/or the City of Chicago, and each of their respective employees, officers, directors, agents and representatives (the “Navy Pier Parties”) can completely eliminate the risk associated with use of the Sauna and the possibility of injury, illness or death. The risks you face may stem from the Sauna, Kiln’s failure to properly maintain the Sauna, the environment in which the Sauna used, Kiln’s or the Navy Pier Parties’ failure to provide railing or protective devices, Kiln’s or the Navy Pier Parties’ lack of adequate supervision of those using or maintaining the Sauna, the dock, the marina premises or the surrounding areas, Kiln’s or the Navy Pier Parties’ failure to give proper or adequate warnings or instructions concerning the use of the Sauna, the dock, the marina premises or the surrounding areas, your or others’ failure to follow instructions, your own negligence and the negligence of others, and your own medical conditions health or fitness.
All of the risks described in the section above are collectively referred to as “Risk”,
“Risks” or “RISKS” below.
Risks that I am Assuming
I accept the Risk of using the floating Sauna as those Risks are described under the
heading “Explanation of the nature of risk” above. I assume these Risks even if the
Risks were created by the carelessness or negligence of Kiln, or its officers, agents,
independent contractors, or other employees associated with Kiln or the Navy Pier
Parties. I understand that I am voluntarily assuming the risk of negligent conduct ofothers, but I am not assuming the risk of intentional or reckless conduct of others. Iunderstand that this assumption of Risk is being given in advance of my use of the Sauna and access to the dock, marina premises and the surrounding area. I agree that I am voluntarily participating in the use of the Sauna and I further represent and warrant to Kiln that I, or those on whose behalf I am signing, am physically and medically fit to access and use the Sauna.
I VOLUNTARILY ASSUME FULL RESPONSIBILITY
FOR RISKS OF DEATH OR PERSONAL INJURY, OR ANY MEDICAL
CONDITION that may be sustained as a result of use of the Sauna as those risks are described in this agreement.
The Potential Claims and Liability I am Releasing
I also hereby EXPRESSLY RELEASE, WAIVE, DISCHARGE AND AGREE NOT
TO SUE Kiln and/or the Navy Pier Parties, or the officers, owners, members, agents,
independent contractors, or other employees associated with Kiln and/or the Navy Pier Parties, from any and all claims, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, that may be sustained due to my use of the Sauna and stemming from or related to the Risks described in this agreement. I further hereby AGREE TO HOLD HARMLESS Kiln and its officers, owners, members, agents, independent contractors, or other employees associated with Kiln andthe Navy Pier Parties, from any loss, liability, damage or costs, including reasonableattorney’s fees which are in any way connected with my participation in the use of theSauna which allege negligent acts or omissions of Kiln or its officers, agents,independent contractors, or other employees associated with Kiln and/or any of theNavy Pier Parties.It is my express intent that this Agreement shall bind the members of my family, myspouse (if any) and my heirs, executors, representatives, agents, successors, assigns, andadministrators, and shall be deemed as a complete RELEASE, WAIVER, ANDDISCHARGE of Kiln or its officers, members, owners, agents, independent contractors,or other employees associated with Kiln and NPM Venture LLC, Navy Pier, Inc., theMetropolitan Pier and ExpositionAuthority, and the City of Chicago, and each of their
respective employees, officers, directors, agents and representatives.
WARNINGS
Alcohol & Drugs
Alcohol is a diuretic, which dehydrates you quickly. It can also impair your judgment, making it harder to listen to your body's warning signals. Do not consume alcohol, cannabis or drugs that could impair you in any manner prior to entering the sauna.
Illness, Health Conditions, & Medications
You should avoid using a sauna if you are ill, at risk of becoming ill, or recovering from an illness. You should avoid the use of the sauna if you've recently had a heart attack or a stroke. You should avoid using the sauna if you have recently had blood or plasma drawn. You should avoid using the sauna if you have any medical conditions that may increase the risk of adverse effects, including but not limited to very high or low blood pressure, epilepsy, prone to dizziness or fainting, certain heart conditions, or the use of certain medications that may impact your blood pressure or increase the risk of dehydration. Please consult with a medical professional if you have questions about any health conditions or medications that may impact your ability to safely use the sauna.
Children & Pregnant Women
The Sauna is not recommended for people who are pregnant. If pregnant, please consult with a medical professional before using the sauna. Anyone under the age of 18 is prohibited from using the sauna.
Dehydration
Sitting for extended periods of time in heat increases the possibility of dehydration,
please exercise caution and drink lots of fluids before, during, and after using the sauna to prevent dehydration.
Natural Cold Plunge
Entering any body of water carries the risk of injury, drowning, or death. Entering the water is at your own risk. Entering frigid water may additionally increase the risk of numbness, pain, hypothermia, and shock. Please exercise extreme caution when entering the water alongside Kiln. Exit the water immediately if you feel any
discomfort. Do not dive into the water. Do not enter the water alone. Do not enter the water during a thunderstorm or severe weather.
Dock Safety
The dock and deck area surrounding Kiln may be slick and/or icy. Please exercise
caution to prevent slips and falls. Please use the railings when walking on the ramp.
This facility is not suitable for people with mobility or balance concerns. The facility is floating, can be slippery and icy and requires stairs.
RULES
For your safety and enjoyment, and the safety and enjoyment of others, you must adhere to our rules and any instruction provided by our staff. Kiln and its staff reserve the right to refuse service to anyone who does not follow these rules Failure to comply may result in becoming permanently banned from using our services, injury, or death.
• People under age 18 and under are not permitted in the sauna.
• Pregnant women and persons affected by heart disease, diabetes, high or low
blood pressure, circulatory or respiratory problems, seizures or epilepsy should
not enter the sauna without seeking prior medical consultation.
• Do not use the sauna while under the influence of alcohol or drugs. Anyone
suspected to be under the influence of alcohol or drugs will be asked to leave.
• Do not use the sauna if you are feeling ill or have been exposed to illness.
• Bathing suits are required while using the sauna, but neoprene items are
prohibited.
• Towels are required while using the sauna.
• Shoes are not allowed in the sauna.
• The surface of the rocks, heater, and surrounding area can be extremely hot.
Exercise caution.
• Prolonged use of sauna is not recommended due to fatiguing effects. Limit
yourself to a maximum of 30 minutes each round before taking a break.
• Do not smoke, eat, or drink beverages other than water in the sauna room.
• Leave the sauna immediately if you experience any of the following: nausea,
dizziness, hot flashes, cold chills, headaches or other discomfort.
• Drink plenty of fluids before, during, and after leaving the sauna.
• Only the water provided should be used on the heating rocks in the sauna.
• Do not use the sauna to dry clothes, swimsuits, or towels, or place materials near
the heater or guard fence.
• Rude and inappropriate behavior is prohibited at Kiln, and is up to the discretion
of Kiln and its sauna guides to determine. Anyone engaging in rude, lewd,
discriminatory, offensive or inappropriate behavior will be asked to leave.
Anyone determined not to be following the rules of Kiln will be asked to leave.
• Use caution when exiting the sauna and entering the water. The area outside of
the sauna may be slick or icy.
• Enter and exit the water by using the ladders on the side of the vessel.
• Do not enter the water alone, a sauna guide or fellow guest must be present when
entering the water.
• Do not enter the water if you cannot swim.
• Use caution when entering the water, go slowly and let your body adjust to the
temperature, if you feel uncomfortable do not continue.
• Do not run on the dock or deck.
• Do not dive into the water.
• Please secure your belongings in the area provided before entering the sauna,
neither Kiln nor any of the Navy Pier Parties are responsible for items lost or
stolen during sauna sessions.
Cancellation Policy
Due to our limited capacity, sauna reservations may not be cancelled. Payment in full is required.
Private sauna reservations may be rescheduled up to seven (7) days (168
hours) before the time of the reservation. Public and shorty sauna reservations may be rescheduled up to forty-eight (48) hours before the time of the reservation.
No-shows will also be charged in full. Same day and next day bookings cannot
be cancelled or rescheduled.
If you would like to reschedule your reservation, please use the link provided in your confirmation email. We cannot reschedule sessions for guests over the phone or via email.
We reserve the right to cancel sessions due to inclement weather or other extenuating circumstances. In this case you will be offered a refund or credit for a future reservation and will be notified via email or text.
AGREEMENT NOT TO USE ANY FORM OF COMMERCIAL PHOTOGRAPHY,VIDEO OR PROMOTION
Use of a floating Sauna (the “Sauna”) at Kiln LLC (“Kiln”) is for personal use only.
Commercial use of any form without prior written approval is not permitted.
Photography, videography, filming, recording, or similar activities for any commercial, promotional, advertising, marketing, or revenue-generating purpose are strictly prohibited on the Premises without KILN’s prior written approval. This prohibition includes posting any content relating to or including KILN or of the sauna on any form of social media for actual or potential commercial use. It also includes inserting or including any links to other forms of social media or other internet content. Personal, non-commercial photography only is permitted. KILN reserves the right to revoke permission for personal use at any time. KILN also reserves the right to have any user delete any content from any form of social media or internet use that KILN, in its sole discretion, determines to be objectionable and not in the best interests of KILN.
BY SIGNING BELOW, I ACKNOWLEDGE AND REPRESENT THAT I HAVE
READ AND UNDERSTAND THE FOREGOING AGREEMENT; I AM AT
LEAST EIGHTEEN (18) YEARS OF AGE AND FULLY COMPETENT OR
HAVE RECEIVED THE SIGNED WRITTEN CONSENT OF A PARENT OR
LEGAL GUARDIAN; I HAVE GIVEN UP LEGAL RIGHTS; AND I AM
EXECUTING THIS AGREEMENT FREELY, VOLUNTARILY, UNDER NO
DURESS OR THREAT OF DURESS.
I have read, agree to and intend to be bound by the terms outlined above.
