LIABILITY WAIVER AND PHOTO RELEASE

THIS AGREEMENT CONTAINS IMPORTANT PROVISIONS

AFFECTING OUR LIABILITY TO YOU, AS WELL AS TERMS AND

CONDITIONS OF YOUR PARTICIPATION IN THESE ACTIVITIES

1. In consideration for receiving permission to participate in the services provided by Jump Around I hereby RELEASE, WAIVE, DISCHARGE, COVENANT NOT TO SUE, AND HOLD HARMLESS: Jump Around, and any partner, employee, servant, representative, associate, officer, agent, volunteer, successor and assigns of Jump Around, (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, action, judgments, costs, expenses, court costs, attorney fees and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, WHETHER CAUSED BY THE, including but not limited to, SOLE, CONTRIBUTORY OR GROSS NEGLIGENCE OF THE RELEASEES, or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted.

2. I hereby elect to participate in said activity voluntarily and to engage in such activity, knowing that certain risks of harm are or may be inherent in the various activities contemplated herein and that the activity may be hazardous to me and my property. I

VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY

DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, I may sustain that, or any loss or damage to property owned by me, as a result of being engaged in such an activity, WHETHER CAUSED BY Jump Around LLC, including but not limited to, SOLE, CONTRIBUTORY OR GROSS NEGLIGENCE OF RELEASEES or otherwise.

3. I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES Jump Around LLC from any loss, liability, damage, demands, liens, liabilities, judgments or costs, including court costs and attorney fees, that they may incur due to my participation in said activity, WHETHER CAUSED BY OR CONTRIBUTED TO IN WHOLE OR PART by any action or failure to act, negligence, breach of contract, or other misconduct on the part of RELEASEES or otherwise.

4. It is my express intent that this Release and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, personal representatives, executors, and assigns, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE the above named RELEASEES. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the Common Wealth of Virginia.

5. I expressly agree that this Release and Hold Harmless Agreement is intended to be as broad and inclusive as is permitted by the laws of the Commonwealth of Virginia. If any portion of this Agreement is held to be invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

6. I grant Jump Around and the other Released Parties a NON-REVOCABLE PERMISSION to capture my image and likeness in photographs, videos, recordings, or other media (collectively "images" I acknowledge that Jump Around will own such images and further grant Jump Around permission to copyright, display, publish, distribute, use, modify, print, and reprint such images in any manner whatsoever related to Jump Around's business, including, without limitation, publications, advertisements, brochures, web site images, or other electronic displays and transmissions thereof. I further WAIVE ANY RIGHT TO INSPECT OR APPROVE the use of the images by Jump Around LLC before its use. I forever RELEASE AND HOLD Jump Around HARMLESS from any and all liability arising out of the use of the images in any manner or media whatsoever, and waive any and all claims and causes of action relating to the use of the photos, including without limitation, claims for invasion of privacy rights or publicity. I accept Jump Around taking pictures or videos of me and publishing them on any media source for advertising.

NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY.

YOU ARE AGREEING THAT EVEN IF Jump Around USES REASONABLE CARE

SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY

BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY

WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM, YOU

ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM

JUMP AROUND IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM

THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM AND JUMP AROUND HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENT THAT

1. I have fully and thoroughly read and understand this Release, Liability Waiver, and Consent Agreement;

2. I am 18 years of age or older;

3. The Information set forth above is accurate and complete;

4. I consent and agree to all of the foregoing;

 5. I consent to remain personally liable for all of the covenants and statements contained herein if any information provided by me is incorrect and 

6. I understand that Jump Around relies upon the representations made herein to determine whether I should participate in the Activities.

 

INDEMNIFICATION (Must be completed for participants under the age of 18) In consideration of ("Minor") being permitted byto participate in its activities and to use its equipment and facilities, I further agree to indemnify and hold harmless Jump Around from all claims which are brought by or on behalf of Minor and which are in any way connected with Minor's use or participation.
