  • Terms and Conditions for using Jennifer LaRocca at Approved Locators

    1. Binding Agreement

    By requesting and receiving a list of apartment options from Jennifer LaRocca at Approved Locators, you acknowledge that this constitutes a binding contract between you ("Client") and Approved Locators. This contract obligates you to follow the specific instructions provided by Jennifer LaRocca and Approved Locators before applying to any apartment on the list.

    2. Use of Apartment List

    The apartment list provided by Jennifer LaRocca and Approved Locators is curated based on the information you have supplied. By using this list to apply for an apartment, you agree to adhere to the following conditions:

    • Referral Source: You must list Jennifer LaRocca at Approved Locators as your sole and exclusive referral source on all rental applications and lease agreements for the properties on the list.
    • Space Not Provided On Application To List A Referral Source or Locator: Please be advised that if the apartment application does not provide a designated space to list your locator, Jennifer LaRocca, as your referral source, you are required to obtain the "Locator Proof" document from Jennifer by emailing Jennifer@ApprovedLocators.com. This document contains specific instructions that must be followed to ensure Jennifer LaRocca is properly listed as your referral source.

      It is essential that the completed "Locator Proof" is submitted both to the property and to Jennifer at Jennifer@ApprovedLocators.com. Failure to submit this documentation prior to the processing of your application may result in a charge for Approved Locators services. This is because if the property does not recognize Jennifer LaRocca as the referral source, Approved Locators will not receive compensation from the property, and you will be held responsible for covering the service fees. Please ensure that this step is completed in order to avoid any unnecessary charges. 

    • Minimum Lease Term: You agree to sign a lease with a minimum term as specified by the property listing provided by Jennifer LaRocca. Any deviation from this minimum term must be pre-approved in writing by Jennifer LaRocca before you sign the lease agreement.

    3. Client Responsibilities

    • Understanding Instructions: It is your responsibility to thoroughly review and comprehend all instructions provided by Jennifer LaRocca and Approved Locators. Failure to do so does not absolve you of your obligations under this agreement.
    • Application Process: By proceeding with any application using the apartment list provided, you confirm your understanding and acceptance of these terms and conditions.

    4. Exclusivity and Referral Obligation

    By using the apartment list provided by Jennifer LaRocca and Approved Locators, you agree not to engage any other apartment locator or referral service for the same properties. This agreement is exclusive, and you must ensure that Jennifer LaRocca at Approved Locators is listed as the referral source on all relevant documents.

    5. Notification of Changes

    • Move-In Date Changes: If you need to reschedule your move-in date, you must inform both Jennifer LaRocca and the property of these changes in writing. Obtain written confirmation from the property approving the new move-in date. Failure to do so may result in the loss of deposit fees and could lead to the cancellation of the lease agreement, requiring you to restart the application process. The lease terms are not flexible and will proceed according to the property's schedule.

    6. Cancellation and Forfeiture

    • Responsibility for Notification: If you decide to cancel or forfeit your lease agreement before moving in, you are required to notify both Jennifer LaRocca and the property in writing. This notification must be promptly sent via email to Jennifer LaRocca at Jennifer@ApprovedLocators.com. Failure to provide timely written notification may result in your financial responsibility for the services rendered.

    In the event that I, Jennifer LaRocca, have submitted an invoice to the property based on your confirmed application, move-in date, and any communications made via phone or email, and you subsequently cancel or forfeit the lease without providing proper written notice, you may be held responsible for all costs incurred by Approved Locators. This includes any repayment obligations to my broker, Timothy Matthew Malone, License No. 598673, as a direct result of your cancellation.

    Failure to provide timely written notification may result in your financial liability for any losses incurred, including the repayment of fees already disbursed to me upfront by my broker. This obligation remains enforceable irrespective of the status of your lease or tenancy if proper notification is not given.

    7. Lease Breakage or Eviction Within 90 Days

    If you are evicted or choose to break your lease agreement within 90 days of the lease becoming binding, you agree to pay for the cost of my services. By signing the lease, you acknowledge that I have advocated on your behalf and assured the property that you were a suitable tenant for approval. If you breach the lease terms within this 90-day period, you are responsible for covering the costs of my services, which include advocating for your approval and facilitating the lease agreement with the property.

    8. Legal Binding Nature


    This agreement becomes legally binding upon your use of the apartment list provided by Jennifer LaRocca. Any breach of these terms may result in legal action.

     

    9. Governing Law


    This agreement is governed by and construed in accordance with the laws of the state of Texas. Any legal actions arising from this agreement shall be filed in the courts located in Harris or Brazoria, Texas.

    10. Acceptance of Terms


    By using the apartment list provided by Jennifer LaRocca at Approved Locators, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. You also understand that any applications submitted using this list must follow the specific instructions provided by Jennifer LaRocca at Approved Locators.
