The Borrower shall be solely liable for, and shall indemnify and hold harmless, Canberra BMW, its employees, agents, and affiliates, from any and all claims, liabilities, losses, damages, costs, and expenses (including legal fees) arising out of or related to the use of the loan vehicle. Canberra BMW reserves the right to recover in full from the Borrower the cost of any fines, penalties, tolls, tow-away fees, impoundment costs, or any other payments incurred during the loan period, whether directly or indirectly related to the Borrower’s use of the vehicle. The Borrower indemnifies Canberra BMW against any loss or damage suffered due to the inapplicability of comprehensive insurance caused by the qualification, condition, or conduct of the driver in charge of the vehicle. This includes, but is not limited to, situations where insurance coverage is voided due to the Borrower's actions or failure to comply with the terms of the insurance policy. The Borrower hereby declares that they currently hold a valid and unrestricted Australian driver’s license. The Borrower acknowledges that failure to hold a valid license may result in liability for all costs and damages incurred during the loan period. By accepting these terms, the Borrower agrees to comply with all conditions set forth above.
