Participation Agreement and Waiver Form

The participant should fill in Section A, initial each section where indicated, and sign form to give their agreement to all sections/pages of this document.

Info for Parent/Guardians:  Place your info in Section A, even if you are not participating, and if signing for a minor, then also read and complete Section G at the end.

This Agreement, Assumption of Risk, and Waiver of Liability is by the undersigned person in favor of Tonic Rage Room and all Tonic Rage Room’s members, managers, officers, employees, agents, volunteers, contractors, insurers, affiliated entities, and assigns (collectively “Tonic Rage Room”). You have the right to refuse to sign this Agreement, Assumption of Risk, and Waiver of Liability and forego participation in Tonic Rage Room.

In consideration of the venue, equipment, and services provided by Tonic Rage Room, and my desire to participate in the activities offered at Tonic Rage Room today and in the future, I acknowledge, accept, and agree as follows:

Activities in Tonic Rage Room are inherently risky. Such risks include (but are not limited to) flying and floor debris, slipping and tripping hazards, confined spaces, collisions, surprises, impacts, sharp and jagged edges, shocks, stress, rebounds, vibrations, acts and omissions by other people, changing environmental conditions, equipment failure, physical exertion, unusual physical stresses, loud noises, and other risks not specifically named. Other risks involved in this activity include but are not limited to injury, psychological, emotional, spiritual, and physical distress, and/or death. 

• Tonic Rage Room offers strenuous activities that include known and unanticipated risks. Participation is voluntary. Participation can result in injury. For myself and for my minor child (if applicable), I freely accept and fully assume all such risks.

• For myself and for my minor child (if applicable), I agree to use Tonic Rage Room’s venue, equipment, and services reasonably, responsibly, and safely. For myself and for my minor child (if applicable), I agree to participate within my physical ability.

• For myself and for my minor child (if applicable), I agree to abide by all Tonic Rage Room’s rules as related by Tonic Rage Room’s employees, instructions, and signage. For myself and for my minor child (if applicable), I agree to follow all directions given by Tonic Rage Room’s employees.

• For myself and for my minor child (if applicable), I agree to use available protective clothing and equipment while participating in the activities offered by Tonic Rage Room always including facial visor use.

• Activities in Tonic Rage Room may cause significant physical, mental, and emotional stresses. Tonic Rage Room recommends consultation with a qualified physician prior to Tonic Rage Room activities.

• Tonic Rage Room recommends that pregnant women should not participate in the activities offered at Tonic Rage Room.

• Tonic Rage Room recommends that people with medical conditions that can be triggered and/or exacerbated should not participate in the activities offered at Tonic Rage Room, specifically including (but not limited to) those with asthma; epilepsy; a cardiorespiratory issue; hypertension; mental illness; a muscle, skeletal, or joint issue; an open or recent wound; and others not specifically named.

• People who have been advised or cautioned against the activities offered at Tonic Rage Room are prohibited from participating.

• Intoxicated people are prohibited from participating in the activities offered by Tonic Rage Room.

• For myself and for my minor child (if applicable), I confirm that I have inspected the venue, equipment, and services provided by Tonic Rage Room and based upon that inspection, found it to be safe and acceptable for participation. I agree to immediately notify a Tonic Rage Room employee if I become aware of a condition that is or may become not safe and acceptable for participation.

For myself and for my minor child, (if applicable), I freely accept and fully assume all such risks. (This includes all minors I am signing for on this form.)

Please initial below after reading, understanding, and accepting all of section B.

In consideration of the venue, equipment, and services provided by Tonic Rage Room, and my desire to participate in the activities offered at Tonic Rage Room today and in the future, for myself and for my minor child(ren) (if applicable), I agree to waive, release, and discharge Tonic Rage Room from any and all claims resulting from activities and/or participation in Tonic Rage Room, including any and all claims caused by or related to the venue, equipment, and services provided by Tonic Rage Room. This agreement applies to claims of personal injury (including death), dismemberment, illness, property damage, and loss or theft of property.

Please initial below after reading, understanding, and accepting the information in Section C.

In consideration of the venue, equipment, and services provided by Tonic Rage Room, and my desire to participate in the activities offered at Tonic Rage Room today and in the future, for myself and for my minor child (if applicable), I agree to hold harmless, defend, and indemnify Tonic Rage Room from any and all claims arising from activities and/or participation in Tonic Rage Room, including all such claims made by me, my minor child (if applicable), other participants, rescuers, and any other person.

Please initial below after reading, understanding, and accepting the information in Section D.

For myself and for my minor child(ren) (if applicable), I consent to recording by video, photograph, and audio during Tonic Rage Room activities and use of all such video, photographic, and audio recordings by Tonic Rage Room, including publication upon its social media platforms. The appropriate venue for any legal action relative to any claims arising from activities and/or participation in Tonic Rage Room and/or this Agreement, Assumption of Risk, and Waiver of Liability is Cabarrus County, North Carolina.

Please initial below after reading, understanding, and accepting the information in Section E.

By signing below, I agree I will make every effort to obey safety precautions as listed in writing and as explained to me verbally.

Tonic Rage Room provides safety gear, instruction on safety, rules & guidelines, and makes every effort to give you a safe rage room experience.

However, ultimately, YOU are responsible for your own safety!

If you do not have minor(s) to sign for, just skip the next part (Section G) and go to the bottom to submit.

By signing this Agreement, Assumption of Risk, and Waiver of Liability, you are agreeing to let your minor child(ren) engage in a potentially dangerous activity that can result in injury; you are giving up your child(ren)'s right and your right to assert a claim against Tonic Rage Room resulting from activities and/or participation in Tonic Rage Room including any and all claims caused by or related to the venue, equipment, and services provided by Tonic Rage Room. You have the right to refuse to sign, and forfeit your child(ren)'s participation in Tonic Rage Room activities.

Please fill in the names and ages of up to ten minors, and sign below after reading, understanding, and accepting the information in Section G.

Tonic Rage Room will receive a copy of this completed form and will have it on hand when you come in for your appointment. Please have ID with you if asked for.

You will also get a copy of it sent to your email.

Remember to wear long pants and close-toed shoes!
