Program: NOVA SYSTEMIC – Fabrication Lab

Part 1 – Participant CODE OF CONDUCT
I agree to the following Rules and Regulations of the Northern Virginia Community College (“College”) Systemic Fabrication Lab (including Mobile Fabrication Lab) and agree to abide and be bound by them:
1. Participant is required to abide by the standards expected of College Students and follow all applicable policies of the College and any applicable Virginia or federal law or regulation. Participant is also expected to make choices that preserve a safe and secure environment, to practice responsible citizenship, to respect the rights of others and be responsible for her/his own actions. Participant is also required to follow all directions issued by program staff and any other College official, including adhering to all safety policies and training.
2. Smoking, the use of alcohol and other drugs, weapons, gambling, or fireworks/explosives is prohibited. Participant is also prohibited from engaging in dangerous conduct (including the use of dangerous items), disorderly conduct, dishonest behavior, or the harassment of other individuals. Projects that violate local, state, or federal law, that pose a threat or danger to the well-being of others, that violate intellectual property rights, or that is sexually explicit is prohibited.
3. Participant must wear appropriate attire at all times while at the Fabrication Lab (Fab Lab). Participants may not wear roller/wheeled shoes, open toed shoes (flip flops, sandals, etc.) or transparent clothing in the lab. Clothing must not display any graphics or text that is sexually explicit. Long hair, dangling jewelry, and baggy clothing must be pulled back and restrained when using equipment. Furthermore, Participant will wear supplied appropriate Personal Protective Equipment (ex. safety glasses, gloves, etc.) as required for certain activities.
4. Participant may not damage, misuse, or deface any College or Host site property. Participant (or Participant’s legal guardian if under 18 years of age) agrees to reimburse the College for the full cost, up to and including replacement, of any damaged, misused, or defaced property. Participants are responsible for their own money and personal items. The College is not responsible for lost or stolen items.
College staff, in their sole discretion, determine whether a rule was violated. In the event of a violation, Participant is subject to dismissal from the Fab Lab without refund at Participant’s expense. If this occurs and Participant is under eighteen (18) years of age, Participant’s parent or legal guardian agrees to immediately pick up Participant upon notification.
Part 2 Participant ASSUMPTION OF RISK & MEDICAL RELEASE
The Fab Lab offers access to tools, equipment, and materials for digital innovation and fabrication, as well as related services and educational opportunities, events and/or activities. Equipment and activities include, but are not limited to, hammers, drills, cutting tools, soldering equipment, 3D printers, robots, laser engraver, vinyl printer, power saws, routers, adhesives, plastic injection molder, wood and plastics, instructional classes, training opportunities, hands-on experiences, collaboration sessions and other group activities, including opportunities to produce a prototype(s), product(s) or other results (“Activities”).
The Fab Lab implements a variety of safety measures and safety guidelines for using equipment and working in the Fab Lab, which if followed, result in safe enjoyment of the facilities. However, the Participant acknowledges the inherent risks in participating in Activities in the Fab Lab, including the use of tools, equipment, devices, and hazardous materials of any kind commonly used in fabrication, electronics construction, digital design, and other technology related activities. These Activities may involve inherent risks and dangers of accidents, emergency treatment, property loss or damage, and serious personal and bodily injury (including death).
I agree that as a participant in the Fab Lab associated with NOVA, I am responsible for my own behavior and wellbeing. I accept this condition of participation, and I acknowledge that I have been informed of the general nature of the risks involved in these activities.
I understand that in the event of accident or injury, personal judgment may be required by College personnel regarding what actions should be taken on my behalf. Nevertheless, I acknowledge that the College personnel may not legally owe me a duty to take any action on my behalf. I also understand that it is my responsibility to secure personal health insurance in advance, if desired, and to take into account my personal health and physical condition. I understand any costs for emergency medical treatment are my/our responsibility. By signing this form, the participant, or the participant's parent or guardian, allows the provision of emergency medical treatment. I further agree to abide by any and all specific requests by the College for my safety or the safety of others, as well as any and all of the College’s rules and policies applicable to all activities related to this program. I understand that the College reserves the right to exclude my participation in this program if my participation or behavior is deemed detrimental to the safety or welfare of others. In consideration for being permitted to participate in this program, and because I have agreed to assume the risks involved, I hereby agree that I am responsible for any resulting personal injury, damage to or loss of my property which may occur as a result of my participation or arising out of my participation in this program, unless any such personal injury, damage to or loss of my property is directly due to the negligence of the College. I understand that this Assumption of Risk Form will remain in effect during any of my subsequent visits and program-related Activities, unless a specific revocation of this document is filed in writing with the College, at which time my visits to or participation in the program will cease.
Part 3 Image Release 2024
Note for parents and students about the image release:
Dear parents and students, the following image release is used to protect the college and you. The language is comprehensive in an effort to cover multiple scenarios. The photos we take during these programs are primarily intended to market the program to other students and parents, so they can be inspired to get involved in STEM and CTE like you.
I hereby grant Northern Virginia Community College ("NOVA") the absolute and irrevocable, worldwide and perpetual right and permission to take, use and re-use photographs, digital images, film, video and/or audio recordings of my image, likeness and voice without payment or any other consideration. NOVA will be utilizing these assets for marketing and communications purposes detailed herein only and will not be selling rights to images for monetary purposes.
NOVA shall have the right to display, reproduce, edit, modify, distribute, publish and/or broadcast the same, or in part, in any and all media, including use on the internet (social media platforms), now or hereafter, and for any lawful purpose including but not limited to instruction, promotion and advertising. Additionally, I agree to waive any right to royalties or other compensation arising out of its related use and understand that it may be used in diverse educational settings within an unrestricted geographic area.
I agree that NOVA owns the copyright to these photographs, digital images, film, video and/or audio recordings and I hereby waive any prior right to the usage of such. I also understand that once an image or video is posted online, it may be downloaded by any computer or connected device user and is no longer under sole control of NOVA. I agree to release and hold harmless NOVA, the Virginia Community College System (VCCS), the Commonwealth of Virginia, their respective officers, employees and agents from any and all claims, demands, charges or actions, including future compensation, related to such images and uses thereof by NOVA or by third-parties not permitted, intended, and/or known to NOVA.
I represent that I am over the age of 18 years, and that by signing this form, I give NOVA permission to use my name and the biographical information below that I have provided voluntarily, and I certify that I have read and fully understand this form and agree to be bound thereby.”
