servings. The Client understands and accepts these terms and variables.
8. A cake will not be released until the person receiving the cake has inspected the cake and signed the Cake Release Form. On occasion we will photograph our cakes and we reserve the right to use any photographs for display or promotion without compensation to you. 9. If you or your representative elect to pick up and set up the cake, you must sign a cake release waiver and assume all liability and responsibility for the condition of the cake once it leaves Sweet & Shiny's possession.
10. Should the venue not be open and Sweet & Shiny is not able to set-up the cake, we will continue on our delivery route and return to set-up the cake at the end of the route. In this case your cake may be late and we will not be held responsible. In the event Sweet & Shiny waits at the site for the venue to open, the Client will be billed for the time at an hourly rate of $90 prorated to the minute.
11. We are not responsible for any damage to the cake after setup is complete. You are responsible for providing an appropriate and secure table and environment for the cake(s Cakes are heavy and require a sturdy table with optimal room temperature of 75 degrees or below.
12. Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You agree to notify your guests of this risk and hold us harmless for allergic reactions.
13. If, for any reason, the Client of her/his own accord cancels the contract, all payments received to date, including the non-refundable deposit fee, will be forfeited. If, for any reason other than non-payment or cancellation by the Client, Sweet & Shiny of its own accord cancels the contract, all payments, including the non-refundable deposit fee, will be refunded in full within 60 days. 14. If, for any reason the event must be postponed, the Client must contact Sweet & Shiny immediately as the requested new date may not be available. If the postponement occurs after final payment, 14 days prior to the event, a change fee of at least $100 or more will be assessed based upon the cost of the amount of product already made and now unusable. If the new requested date is not available, the order may be canceled, however, the non-refundable deposit fee will be forfeited.
15. Late payments may be assessed an additional $50.00 late fee. Returned checks and non-sufficient funds for payment notices will be assessed a $75.00 surcharge.
