  • Wedding and Special Events Cake Contract

    1. The Cake Quotation is only valid for 30 days from the date of the order, unless a deposit is received, as any quote is considered an estimate based on costs of ingredients, materials, and supplies at the time of booking and subject to increase based on increased costs. 2. Client grants Sweet & Shiny the right to adjust prices proportionately, if necessary, to make substitutions, and/or changes to the agreed design, flavors, fillings and embellishments as necessary. 3. Sweet & Shiny cakes are individually designed. Exact replication of a supplied pattern, design, style or decoration or of another cake artist's work is not possible and cannot and will not be guaranteed and may be illegal due to copyright restrictions. Sweet & Shiny will provide a product representing its interpretation of the desired pattern, design, style, decoration or another cake artist's work. 4. Along with final payment, all details (i.e., flavors, guest numbers, etc must be finalized no less than 14 days before delivery date. Any ornament/cake topper must be given to Sweet & Shiny by the final payment date. If Sweet & Shiny is to provide the ornament/cake topper, the cost will be added to the final payment amount. Once final, the order CANNOT be adjusted for a smaller guest list. 5. Cakes will not be started on or released unless full payment has been received. If payment is not received by the date required, NO cake will be made, the order will be canceled and all monies paid to

    6. If more servings than the main cake are needed unexpectedly, a kitchen cake to match the main cake in terms of layers, flavors and fillings may be made if availability permits and it is ordered at least 7 days before the event. The kitchen cake's cost will be calculated at the same amount per serving as the main cake plus a $50 rush order fee and must be paid within 24 hours of placing the kitchen cake

    7. Serving amounts provided by standard shape cakes are based on the wedding industry standard of 8 cubic inches of cake per serving: generally 1 inch wide X 2 inch long X 4 inch high slice of cake. Specialty carved cake serving amounts are estimated and are not guaranteed to be exact. All cakes will provide at least the requested industry standard size number of servings, however, the actual number of servings created during service of the cake cannot be guaranteed as methods of slicing, such as serving larger than the industry standard slice or other preparations will affect the number of actual

  • servings. The Client understands and accepts these terms and variables.

    8. A cake will not be released until the person receiving the cake has inspected the cake and signed the Cake Release Form. On occasion we will photograph our cakes and we reserve the right to use any photographs for display or promotion without compensation to you. 9. If you or your representative elect to pick up and set up the cake, you must sign a cake release waiver and assume all liability and responsibility for the condition of the cake once it leaves Sweet & Shiny's possession.

    10. Should the venue not be open and Sweet & Shiny is not able to set-up the cake, we will continue on our delivery route and return to set-up the cake at the end of the route. In this case your cake may be late and we will not be held responsible. In the event Sweet & Shiny waits at the site for the venue to open, the Client will be billed for the time at an hourly rate of $90 prorated to the minute.

    11. We are not responsible for any damage to the cake after setup is complete. You are responsible for providing an appropriate and secure table and environment for the cake(s Cakes are heavy and require a sturdy table with optimal room temperature of 75 degrees or below.

    12. Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You agree to notify your guests of this risk and hold us harmless for allergic reactions.

    13. If, for any reason, the Client of her/his own accord cancels the contract, all payments received to date, including the non-refundable deposit fee, will be forfeited. If, for any reason other than non-payment or cancellation by the Client, Sweet & Shiny of its own accord cancels the contract, all payments, including the non-refundable deposit fee, will be refunded in full within 60 days. 14. If, for any reason the event must be postponed, the Client must contact Sweet & Shiny immediately as the requested new date may not be available. If the postponement occurs after final payment, 14 days prior to the event, a change fee of at least $100 or more will be assessed based upon the cost of the amount of product already made and now unusable. If the new requested date is not available, the order may be canceled, however, the non-refundable deposit fee will be forfeited.

    15. Late payments may be assessed an additional $50.00 late fee. Returned checks and non-sufficient funds for payment notices will be assessed a $75.00 surcharge.

  • By paying the deposit, we consider that you have read, understood and accepted the terms and conditions listed above, even if not signed and dated below. Sweet & Shiny may not be able to accommodate significant changes to the design and/or style of a cake. Such alterations may make the original quote and order invalid and require a new Cake Order Form.
