DAOM ADDITIONAL TERMS, WAIVER AND RELEASE / TERMINOS ADICIONALES DE DAOM, EXENCION Y LIBERACION
As Consideration for being allowed to participate in the activities of the Dance Academy of Mexico (DAOM), the undersigned, on his or her behalf, and on behalf of the student, acknowledges, understands, and agrees to the following.
En consideración por participar en las actividades de la Academia de Danza Mexico (ADM), la persona que firma, en su nombre y a nombre del estudiante, reconoce, entiende y acuerda lo siguiente:
1. I represent that I am an adult, student, parent or legal guardian of the student or I have permission to execute this agreement on their behalf. 1. Yo represento que soy un adulto, estudiante, padre o guardián legal del estudiante o tengo permiso para ejecutar este acuerdo en su nombre
2. I acknowledge and understand that there are risks (including COVID-19) associated with participation in the activities of the DAOM. I willingly assume the risks. 2. Yo reconozco y entiendo que hay riesgos asociados con la participación en las actividades de la ADM (incluyendo COVID-19). Yo acepto los riesgos voluntariamente
3. The student is physically able to participate. 3: El estudiante es físicamente apto para participar.
4. I understand that the Dance Academy of Mexico (DAOM) will not be responsible for any physical damage. In case of an emergency, I authorize DAOM to obtain the medical treatment necessary, with the understanding that the family will be notified immediately and that I will be responsible for any charge resulting from such treatment. 4. Yo entiendo que la Academia de Danza Mexico (ADM) no será responsable por ningún daño físico. En caso de emergencia, autorizo a la ADM a obtener el tratamiento medico necesario, sabiendo que la familia será notificada inmediatamente y que yo sere responsable por cualquier cargo derivado de dicho tratamiento.
5. Release of Photographs: I am informed, acknowledge and understand that student may be videotaped, filmed and/or otherwise photographed during the class and/or performances, and hereby forever grant DAOM, its assigns, licensees, legal representatives, including without limitation, those for whom DAOM, is acting, and those acting with DAOM, authority and permission, the absolute and irrevocable right and permission to copyright, use and reuse, all form, for any purpose without compensation or restriction of any kind. Liberacion de Fotografias: Yo estoy informado, entiendo y autorizo que el estudiante sea grabado, filmado o fotografiado durante la clase o presentaciones, y aqui por siempre doy a DAOM, sus asignatarios, licencias, representantes legales, incluyendo sin limitacion los derechos de autor, uso y reuso, en todas las formas por cualquier proposito sin remuneracion alguna.
6. I agree to comply with all stated and customary terms, posted safety signs, rules and verbal instructions as conditions for participation in any activity at the DAOM or associated events. This includes notifications and announcements that DAOM publishes on FACEBOOK. 6. Yo acuerdo cumplir con todos los términos presentes y los acostumbrados, los anuncios de seguridad, reglas e instrucciones verbales como condición para participar en cualquier actividad de la ADM o los eventos asociados. Incluso anuncios y noticias que publica ADM en grupos y páginas en FACEBOOK.
7. Dismissal: DAOM reserves the right to dismiss any student at any time for actions that DAOM feels are disruptive to the DAOM environment or usual business proceedings or any action (verbal or physical) that reflects negatively upon other students. Student suspension or termination shall not entitle the student to a refund or credits for any tuition already paid or cancel any unpaid balance due. The failure or inability of student to use the facilities, classes or services of DAOM for any reason, shall not relieve or suspend the student's obligation to make all payments required under this Agreement on a timely basis, nor entitle the student to a refund or credit of tuition // 7. Despido: DAOM se reserva el derecho de despedir a cualquier estudiante en cualquier tiempo por acciones que DAOM determine que interrumpen el ambiente de DAOM o su curso usual de negocios o por cualquier accion (verbal o fisica) que refleje negativamente en otros estudiantes. La suspension o terminacion del estudiante no le da al estudiante derecho a creditos o reembolzos por ninguna mensualidad pagada o el pago del balance cancelado. La falla o inabilidad del estudiante de usar las facilidades, clases o servicios de DAOM por cualquier razon, no quita o suspende la obligacion del estudiante de hacer los pagos requeridos por este acuerdo a tiempo, ni le da al estudiante derecho a recibir un reembolso o credito de la mensualidad.
8. I agree to hold harmless and indemnify the DAOM, subsidiaries and affiliates, officers, and employees from any and all injuries, liabilities, or damages from participation. I agree to indemnify DAOM for any defense cost or expense arising from any and all claims, injuries, liabilities or damages arising from participation. 8. Yo acuerdo a indemnificar a ADM por cualquier costo de defensa que surja de las demandas, heridas o lesiones, obligaciones o daños por la participación. Yo acuerdo indemnificar a ADM, subsidiarios y afiliados, oficiales, y empleados de cualquier herida o lesión, obligación o daños por la participación.
9. NO UNAUTHORIZED PERFORMANCES: I agree to not compete with DAOM. I will not perform, use, or teach, dances and outfits that are identical or substantially similar to those used or performed by DAOM without written permission. I agree to pay $250 per dance or outfit used without permission, per occurrence, for up to a year after I no longer participate at the DAOM. 9. NO ESTA PERMITIDO HACER PRESENTACIONES SIN AUTORIZACION: Yo acuerdo no competir con ADM. Yo no bailare, usare o enseñare los bailes y trajes que sean identicos o substancialmente similares a los que usa o presente la ADM sin permiso por escrito. Yo acuerdo en pagar $250 por baile o traje usado sin permiso, por cada ocasión, por 1 año después de que ya no participe con ADM.
10. I understand that any costumes, outfits, accessories, provided to me by DAOM must be returned within 5 business days unless a bill of sale has been provided. Failure to return lent items will result in fee/fine or replacement cost of a new item. I am also responsible for any lost or damaged items. 10. Entiendo que se tiene que regresar a ADM cualquier traje, disfraz, o accesorio prestado al estudiante en 5 días hábiles de la fecha en que fue prestado - al menos que ADM le proporcionó un recibo de venta. Cuotas y multas resultarán por cada artículo que no se regresa a tiempo. Tambien sere responsible de cualquier articulo perdido o dañado.
11. I am legally competent to understand and complete this agreement. I hereby execute this agreement without coercion 11: Yo soy legalmente competente para entender este acuerdo completo. Yo ejecuto este acuerdo sin coerción.
12. This agreement shall be governed by the laws of the State of Wisconsin and any applicable Federal law. 12: Este acuerdo está gobernado por las leyes del Estado de Wisconsin y cualquier ley Federal applicable.
