I. Introduction

This Release and Liability Waiver Form ("Agreement") is entered into by and between the submitter ("Guest") and "Well What Had Happened Was.com," its affiliates, agents, successors, and assigns (collectively referred to as the "#WWHHW and The Relatable Counselor"). This Agreement pertains to the submission and potential publication of personal storytelling content related to mental health, including but not limited to the website "Well What Had Happened Was" and the associated program "The Thinking Corner" hosted by Mandii Brown.

II. Consent and Grant of Rights

Content Submission: The Guest agrees to submit content ("Content"), which may include but is not limited to personal stories, audio recordings, video recordings, photographs, and other related materials to the Platform.

Grant of Permissions: The Guest hereby grants the Platform the irrevocable right and permission to record, use, publish, stream live, offer for sale, or otherwise distribute any submitted Content. This includes the use of the Guest’s name, recorded audio or video, photograph or likeness, and biographical information.

Confidentiality: At the discretion of the Guest, submissions can be made confidential. In such cases, identifying details will be withheld by the Platform. However, the Guest acknowledges that the essence of the submitted story may be used without revealing specific personal details.

III. Liability and Acknowledgements

Public Interaction: The Guest acknowledges and agrees that the Platform and the Host are not responsible for comments made by the public under published posts or any external interactions that result from the publication of the Content.

After Effects: The Platform and the Host disclaim any responsibility for the after effects of choosing to submit and publish the Guest’s Content, including but not limited to emotional, psychological, and social impacts.

Professional Advice: The Guest acknowledges that the storytelling content is not a substitute for professional mental health services. The Platform encourages all submitters to seek professional mental health services and create a support village, as promoted by both the Platform and "The Thinking Corner."

IV. General Provisions

Indemnification: The Guest agrees to indemnify and hold harmless the Platform and its directors, officers, employees, and agents from and against any claims, losses, damages, liabilities, including legal fees and expenses, arising out of or related to the Content or Guest’s breach of any obligations stated in this Agreement.

Severability: If any provision of this Agreement is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
