LIABILITY RELEASE WAIVER

 

This Liability Release Waiver ("Waiver") is executed on this [Date Below] by and between:

 
Property Owner: [David Stubbs], residing at [1275 W Township Avenue Colorado City, Arizona 86021] ("Property Owner").

 
Business: Southern Utah Paramotor LLC, with its principal place of business at [1630 E 2450 S #76 St. George, Utah 84790] ("Business"). 

Event Organizer: Brad Roper, representing Southern Utah Paramotor LLC, residing at [1630 E 2450 S #76 St. George, Utah 84790] ("Organizer").

Participant: [Participant’s Full Name], residing at [Participant’s Address] ("Participant").

Event: The paramotor event to be held on [September 25 - 29, 2024] at [1275 W Township Avenue Colorado City, Arizona 86021] ("Event").

1. ASSUMPTION OF RISK

 
The Participant acknowledges that participation in paramotor activities involves inherent risks, including but not limited to injury, death, or property damage. The Participant voluntarily assumes all risks associated with the Event, whether caused by the negligence of the Property Owner, the Business, the Organizer, or otherwise.

2. RELEASE AND WAIVER OF LIABILITY

In consideration of being permitted to participate in the Event, the Participant, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby:

 
(a) Release and discharge the Property Owner, the Business, the Organizer, their affiliates, agents, employees, contractors, and representatives from any and all claims, liabilities, demands, actions, causes of action, or suits, whether in contract, tort, or otherwise, arising out of or related to any injury, loss, or damage, including but not limited to personal injury, death, or property damage, that may occur during the Event.

(b) Agree not to sue the Property Owner, the Business, the Organizer, or any of their affiliates, agents, employees, contractors, or representatives for any claim, liability, demand, action, or suit arising out of or related to participation in the Event.

3. INDEMNIFICATION

 
The Participant agrees to indemnify and hold harmless the Property Owner, the Business, the Organizer, their affiliates, agents, employees, contractors, and representatives from and against any and all claims, liabilities, demands, actions, causes of action, or suits, including legal fees and expenses, arising out of or related to the Participant's participation in the Event.

4. MEDICAL TREATMENT

 
The Participant consents to receive medical treatment that may be deemed necessary in the event of an injury, accident, or illness during the Event. The Participant agrees to be solely responsible for any medical expenses incurred.

5. GOVERNING LAW

This Waiver shall be governed by and construed in accordance with the laws of the State of Arizona. Any disputes arising out of or related to this Waiver shall be subject to the exclusive jurisdiction of the courts located in [Mohave], Arizona.

 
6. ENTIRE AGREEMENT

 
This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral, relating to such subject matter.
