This Agreement is made and entered into, on the date indicated at the bottom of the agreement, by and between McLean County Fair of Bloomington, Illinois (Lessor), and Lessee (Name noted after terms of agreement).
1. Description of location: Lessor does hereby provide to Lessee one of the following spaces located at the McLean County Fairgrounds, 1106 Interstate Drive, Bloomington, Illinois from November 1, 2024 through April 30, 2025:
- One outdoor space on the grounds not under a roof ($150)
- One space in Barn C ($252)
- One space in Barn D ($282)
If space assigned to Lessee is one in either Barn C or Barn D, Lessee will park units with hitches facing towards the outside of the barn.
Lessee agrees to keep units stored within assigned space and not encroaching into another Lessee's rented space.
2. Length of tenure and consideration: The terms of this Rental Agreement shall be for the space Lessee is assigned, and for the amount payable by the Lessee based on the space location on or before execution of this agreement.
3. Access: Lessee may access its stored property any day of the week during daylight hours. Such access may not always be available due to events on the property.
4. Dangerous or Illegal Materials: Lessee will not keep or have on or around the property stored on the above premises any item of a dangerous, flammable, or explosive nature that might unreasonably increase the risk of fire or explosion on the above premises. Lessee will not keep or have on or around the above premises any illegal items, materials, or substances.
5. Security: The parties acknowledge that Lessor will provide no security arrangements for property stored on site and Lessee assumes any and all risks of loss that may be associated with the storage by him or her of property at Lessor’s facility.
6. Insurance, Hold Harmless, and Indemnification: Lessee agrees to keep all property stored on the above premises fully insured against fire, lightning, storm damage, and extended coverage insurance including theft and vandalism. Proof of insurance must be submitted along with your agreement.
Lessor assumes no responsibility and shall not be liable for the loss or damage to Lessee’s property by theft, fire, vandalism, malicious mischief, wind, water, freezing, snow, ice, or act of God.
Lessee agrees to indemnify and hold harmless McLean County Fair and McLean County Farm Bureau, and McLean County Ag Expo, their agents, employees, directors, and affiliates (“the Parties”), from all claims, demands, actions, judgments or other proceedings of any nature and kind, and the expenses arising therefrom, including attorney’s fees, for any and all liability and/or damages and /or expenses sustained or incurred by the Parties as a result of anything related to Lessee’s use of the above premises.
7. Emergencies: Emergencies or situations may arise where the Lessor must move Lessee’s property from its location. These emergencies or situations can include, by example, a fire on the premises or utility and service repair. Lessor reserves the right to move Lessee’s property in these situations and will make all reasonable steps to contact Lessee prior to such action.
8. Governing Law: This Agreement shall be governed by the laws of the State of Illinois.
9. Assignment: Neither party may assign this agreement without signed written consent of the other. The new assignee shall be responsible for all obligations imposed, and rights granted, under this agreement.
10. Termination: This agreement shall terminate on April 30, 2025. Lessee must remove its vehicle from the McLean County Fair property on or before the stated date.
