EVENT AGREEMENT TERMS AND CONDITIONS:
The person whose signature appears on this contract, known as “Client,” agrees that Click Photo Booth Ltd will provide photobooth services to the best of its abilities, in the manner described in this Agreement. This is a binding contract, which incorporates the entire understanding of the parties, and any modifications to the booking must be requested and agreed in writing.
SERVICE PERIOD:
Pursuant to the responsibilities of the Client, Click Photo Booth Ltd agrees to have a photobooth operational for a minimum of 90% during the event, however, very occasionally, operations may need to be interrupted for maintenance of the photobooth.
CHANGES AND CANCELLATIONS:
Any request for a date, time, or location change must be made in writing at least thirty (30) days in advance of the original event date. Change is subject to photobooth availability. If there is no availability for the alternate date, time, or location, the £10.00 deposit shall be forfeited and no photobooth services will be provided. Any cancellation by the client occurring less than thirty days prior to the event date shall forfeit all payments received.
PARKING:
Client shall provide parking for Company’s vehicle while at Client’s Event. The parking space shall be within close proximity to the venue, and Client shall provide any necessary parking permit or pass prior to the event date.
PAYMENT:
The remaining balance is to be paid by the client no later than 14 days before the event. Click Photo Booth Ltd will contact the client no less than 30 days before the event to go through all details and at this point, the client will be invoiced for the remaining balance. Photo booth access, space and power, the client shall arrange for an appropriate space for the photobooth at Client’s venue. Space must be level, solid, and at least 8’ by 9’. It is the Client’s responsibility to ensure access is possible. The photo booth may be placed in an exterior location, provided it is protected from any wet weather. The client is responsible for providing 1 standard power socket to power the photo booth.
BOOTH OPERATIONAL TIMES:
Click Photo Booth Ltd will do it’s utmost to arrive in plenty of time to start the set up and switch the booth on at the time requested by the client. If for any reason the booth attendant's arrival is delayed resulting in the booth start time being pushed back, the booth attendant will then stay longer at the event to ensure the client does not lose out on any booth operation time.
BOOTH SET UP:
The booth attendant will arrive at the venue 1 hour before the booth is due to be switched on to start the set up and switch the booth on at the time requested by the client. If the attendant cannot set up on time ( for example if the wedding speeches are not finished ) Click Photo Booth Ltd will give the client a 30 minute grace period.
EXTRA HOURS:
Extra hours are charged at £50.00 per hour. If on the day / night of the event the client would like the booth attendant to stay for longer than was stated on the booking form, this will then be up to the booth attendant. Payment for this extra booth time will be charged to the client the following day.
TOILET BREAKS:
For standard 4 hour events, the photo booth attendant will stay with the booth at the event to help guests use the booth and to assist with printing. The booth attendant will only leave the booth for a short toilet break or for an emergency.
PHOTO TEMPLATES:
Click Photo Booth Ltd cannot be held responsible for spelling mistakes and grammatical errors made by the client upon filling out the photo template section of the booking form. Click Photo Booth Ltd will create the photo template using the exact spelling & wording stated by the client on the booking form.
ONLINE GALLERIES:
At some venues (especially rural events) the booth may have limited / poor connection to the internet. In this instance, the booth content (photos and videos) may take longer to upload to your online gallery. In some instances, the booth will not upload the content until it gets back to base. Please note! online galleries will be deleted after 3 months from the event date. Client is responsible for downloading all gallery content during this time frame.
BOOTH CONTENT:
Click Photo Booth Ltd cannot be held responsible for the amount of photos, boomerangs, gifs and videos at the end of the client's event.
CLIENT'S ADDITIONS TO THE BOOTH SET UP:
The Client may wish to add their own items to the booth set up, such as their own neon sign, their own props or their own guest book / scrapbook. Click Photo Booth Ltd cannot be held responsible for these items nor the amount of photos in the client's scrapbook at the end of the event.
PRINTING:
Although photo prints are unlimited and guests can have as many as they want (fair usage applies) Click Photo Booth Ltd cannot be held responsible for the number of print outs at the end of the event. Click Photo Booth Ltd cannot print off photos for the client after the event has finished unless there was a printer error and guests were not able to receive their prints at the event.
VIDEO GUEST BOOK:
Click Photo Booth Ltd cannot be held responsible for the number of guests that leave a video message at the booth during the client's event. Your photo booth attendant will do their utmost to encourage as many guests as possible to leave a video message for you.
PHOTO BOOTH ATTENDANTS' SAFETY AND WELLBEING:
Click Photo Booth Ltd will not tolerate any violence or abusive / threatening behaviour towards booth attendants at events. If the booth attendant feels in danger or is being threatened or verbally / physically assaulted - the attendant reserves the right to pack down and leave the event immediately with no refunds issued.
GUEST BEHAVIOUR:
If the safety of the booth attendant and booth guests is in doubt due to guest behaviour, the booth attendant reserves the right to shut down the booth and have a cooling off period until it is safe to resume. If guest behaviour continues to jeopardise safety after this cooling off period, the booth attendant reserves the right to switch the booth off again. If guest behaviour continues to jeopardise safety for a third time, the attendant will be advised to shut the booth down and to leave the event immediately with no refunds issued.
LIMITATION OF LIABILITY; WAIVER:
Under no circumstances, except as otherwise stated in this agreement, will Click Photo Booth Ltd, It's parent company, nor any of their employees, managers, officers or agents be liable to the client for any loss or damages of any kind (Including, without limitation, for any direct, indirect, economic, exemplary, special, punitive, incidental or consequential losses or damages) that are directly or indirectly related to: (A) the photo booth service; (B) any action taken in connection with copyright or other intellectual property owners, including without limitation, any intellectual property right, publicity, confidentiality, Property or private right; (C) any errors or omissions in the service's operation; or (D) any damage to any user's computer, mobile device, or other equipment or technology. In no event will Click Photo Booth Ltd be liable to client or anyone else for loss, damage or injury, including, without limitation, death or personal injury.
PRO-RATA:
In the event Click Photo Booth Ltd is unable to supply a working photobooth for at least 80% of the Service period, Client shall be refunded a prorated amount based on the amount of service received. If no service is received, Company’s maximum liability will be the return of all payments received from Client. Prior to any party commencing an action, each party shall meet in a good-faith attempt to resolve their differences. Should both parties be unable to resolve their dispute, both parties agree to submit their dispute to a neutral mediator. Both parties agree to the jurisdiction, venue, and choice of law of the Company's principal place of business at the time of the execution of this Agreement.
ALL SALES ARE FINAL
Client understands and agrees that all sales are final.
