Parental Consent and Media Release Form

Release, Acknowledgment of Risk, and Waiver of Liability for use of The Flavor Continues' community spaces of programming MUST BE COMPLETED by parent/legal guardian if participant is under 18 years of age. 

In consideration of the opportunity to participate in classes, activities, and programs conducted at The Flavor Continues (the “Organization”, "Company") and/or other auxiliary facilities, and to use equipment located therein, I, the PARENT or LEGAL GUARDIAN of the child, identified hereunder in the signature block, on behalf of myself, my child/children, and anyone claiming on behalf of me or my child/children acknowledge and agree to the following conditions:

I, hereby forever release, hold harmless, agree not to sue, and forever discharge The Flavor Continues (the “Organization”, "Company") and its departments, officers, directors, board members, representatives, agents, and employees from any and all claims, demands, causes of action, judgment, damages, expenses and costs (including attorneys’ fees), including but not limited to claims of negligence on account of personal injury, bodily injury, property damage, death or accident of any kind sustained by me and/or my child that arises out of my or my child’s use of, presence in, or participation in activities conducted at physical location spaces in which The Flavor Continues operates and/or other auxiliary facilities, whether or not caused by the ordinary negligence of the Organization, which I may now or hereafter have and which the above-named minor has or hereafter may acquire, either before or after reaching majority. I understand, recognize, and acknowledge that certain activities conducted or taking place in the physical location spaces in which The Flavor Continues operates and/or other auxiliary facilities are potentially hazardous and may involve the risk of accident, death, illness, physical or mental injuries, and property damage. It is my responsibility to ask questions about any aspect of the Program activities that has not been explained to my satisfaction. I hereby voluntarily assume any and all risks, including injury to person and property, related to my participation and/or my child's participation in the Program. I further understand that, notwithstanding precautions taken by The Flavor Continues activities involve a risk of injury. I/we are voluntarily participating in these activities with knowledge of the requirement and dangers involved.

Purpose: To allow The Flavor Continues (TFC), NPO, their photographers/filmmakers, marketing agencies, employees, agents, and other affiliated parties under the organization to use the photographs and videography taken by TFC.

Agreement: I hereby convey, transfer and assign all right, title and interest, including but not excluding any images, text, quotes, comments, endorsements, videos, likeness, film, audio, audio-visual, and any other depictions of minor, knowingly provided by me or minor to The Flavor Continues.

The Content, including the copyright and all other rights therein, shall be TFC’s sole and exclusive property. TFC has the right to authorize, publish, utilize, and distribute the material at their sole discretion within the boundaries of the law. I agree that the Content may be combined with other images, text, graphic, or other methods, altered, or modified such as for Grant proposals or on the Website. TFC reserves the right to use or not use this content.

I agree that I have no rights to the Content as published by TFC, and I also have no right to any of TFC’s trademarks or copyrighted materials and other intellectual property. I waive any right to inspect or approve the finished versions of any reproduction of the Content.

I acknowledge and agree that I will make no further claim for any reason to or against TFC until the expiration of the program or non enrollment of the minor from. I also hereby release TFC from all claims, demands, and liabilities, whatsoever in connection with the above. I agree that this release is irrevocable, worldwide and perpetual, and will be governed by the Law of the United States of America and State of Massachusetts. The exclusive venue for any dispute shall be within the jurisdiction in the State of Massachusetts.

I acknowledge that I have completely read and fully understand the above release and fully agree to be bound thereby.

In signing this Release, Acknowledgment of Risk, and Waiver of Liability, I hereby voluntarily release, forever discharge the community, the corporation, its officers, directors, employees, volunteer and agents from any and all claims, demands, or causes of action, which are connected with my child's participation in the programs or the use of the equipment and facilities. By signing this form, I confirm that I have fully informed myself of the contents of this Parental Consent and Release Form by reading it before I signed it. I warrant that I possess all the rights, powers, and privileges of a parent or legal guardian necessary to execute this document with binding legal effect.

I hereby acknowledge that I have read this entire document, that I understand its terms, that I have signed it knowingly and voluntarily, and that I intend it to bind me and, as applicable, my child/children and anyone claiming on behalf or me or my child/children.
