Terms & Conditions
These will be sent to you to sign if you are successful.
1. Liability: The Council is not liable for any loss, damage, or injury to persons or property resulting from your trading activities.
2. Health and Safety Compliance: You must comply with the Health and Safety at Work Act 1974, its associated regulations, and all other relevant statutory provisions, including health and hygiene regulations.
3. Byelaws: You are required to abide by all applicable byelaws. Copies are available upon request.
4. Legislative Compliance: You are responsible for complying with all relevant legislation regarding the siting, operation, and management of your stall, including the payment of any required fees.
5. Public Access: Your stall must not obstruct or inconvenience the public or other traders in neighbouring areas.
6. Equipment Removal: All equipment must be removed, and the site cleared by 21:30 on 5th November. You are responsible for securing the site and ensuring that your insurance covers all risks during the period your equipment is on Council land. The Council is not liable for any loss or damage to your equipment.
7. Trading Hours: Trading activities may only commence after 17:00 unless you have prior approval from the Council.
8. Site Cleanliness: The site must be left clean and tidy. You are responsible for removing any litter generated by your activities before the event concludes and for arranging proper disposal of this refuse.
9. Noise Control: No equipment or activity should create a noise nuisance. Public address systems, loudspeakers, and non-silent running generators are prohibited without prior written consent from the Council.
10. Site Allocation: The Council reserves the right to alter your allocated site in the event of unforeseen circumstances.
11. Vehicle Access: No vehicles are permitted on the Promenade, Beach, or event site unless agreed upon with the Council. All permitted vehicles must use oil drip trays unless otherwise agreed.
12. Trading Boundaries: Trading is only allowed within the boundaries of your allocated site.
13. Leafleting and Fly Posting:
13a. Distribution of leaflets or information is prohibited unless agreed upon in writing by the Council.
13b. Fly posting is strictly prohibited both within and outside Weymouth. Breaching this condition may result in the cancellation of your stall.
14. Indemnification and Insurance:
14a. You must fully indemnify the Council against all costs, claims, expenses, and liabilities arising from your trading activities.
14b. You are required to maintain Public Liability insurance with a minimum coverage of £5 million or an amount determined by the Council. Proof of insurance must be provided to the Council before trading begins.
14c. Your business must be registered with Environmental Health, hold a 4- or 5-star food hygiene rating, and provide proof of compliance.
15. Site Damage: The Council reserves the right to charge you for any damage, repair, or clean-up work required at your allocated site as a result of your trading activities.
16. On-Site Contact: You must designate an on-site contact for any issues during setup, operation, or equipment breakdown. Provide their name and contact number to the Council at least 14 days before the event.
17. Fire Safety Compliance: Where applicable, you must comply with The Regulatory Reform (Fire Safety) Order (RRFSO) 2006.
18. Council Instructions: You must comply with any verbal or written instructions issued by an Authorised Officer of the Council at all times before and during the event.
19. Breaches of Terms: The Council reserves the right to order you to cease trading and vacate your pitch if you breach any of these terms. The Council will attempt to provide an opportunity to comply before such an order is issued unless the breach poses an immediate risk to public health, safety, or welfare. The Council is not liable for any expenses or losses incurred as a result of such an order.
20. Alcohol Sales: If you wish to sell alcohol, you must apply for a TENs license via Dorset Council and provide proof to Weymouth Town Council.
21. Electrical Equipment: All electrical equipment must be PAT (Portable Appliance Testing) certified. The Council may request evidence of certification.
22. Event Cancellation: If the event is cancelled due to weather conditions, you will receive a 50% refund. No refund will be given if you choose not to attend for any other reason.
