ASSUMPTION OF RISK

I, the undersigned participant, acknowledge and fully understand that Jiu Jitsu and related martial arts activities involve the risk of serious injury, including permanent disability or death, and severe social and economic losses which might result not only from my own actions, inactions, or negligence, but also from the actions, inactions, or negligence of others, or the conditions of the premises or any equipment used. Further, I acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time.

I hereby freely, voluntarily, and without duress, assume all risks of participating in the activity, including but not limited to risks associated with my physical condition, the use of equipment, and any other associated activities.

WAIVER AND RELEASE

In consideration of being permitted to participate in the Jiu Jitsu training, classes, events, or any other activities offered by Jiu Jitsu Kubo (hereinafter referred to as the "Company"), I, the undersigned participant, for myself, my heirs, personal representatives, or assigns, do hereby release, waive, discharge, and covenant not to sue the Company, its officers, employees, agents, representatives, affiliates, volunteers, and all others associated with the Company (collectively referred to as the "Releasees"), from any and all claims, liabilities, demands, or causes of action of any kind that arise out of or are related to my participation in the activities.

INDEMNIFICATION

I agree to indemnify and hold harmless the Releasees from any and all claims, liabilities, losses, damages, costs, or expenses (including attorney's fees) arising from or in connection with my participation in the activities, whether caused by the negligence of the Releasees or otherwise.

MEDICAL CONSENT

I certify that I am in good health and have no physical or medical conditions that would impair my ability to safely participate in Jiu Jitsu activities. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in these activities. In the event of an emergency, I authorize the Company and its representatives to obtain medical treatment for me at my expense.

IMAGE AND LIKENESS RELEASE

I hereby grant the Company permission to use my image or likeness in any photograph, video, or other media in which I may appear, for promotional, advertising, or educational purposes, without compensation to me.

SEVERABILITY

If any portion of this agreement is deemed to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws of the state in which the Company is located.

ACKNOWLEDGEMENT OF UNDERSTANDING

I have read this Waiver and Release Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

I acknowledge that I have carefully read this form and fully understand that it is a release of liability. I expressly agree to release and discharge the trainer or instructor from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I may otherwise have to bring a legal action for personal injury or property damage.
