In consideration of the Township of Amity, Berks County, Pennsylvania (Township) allowing a person to enter Monocacy Hill and/or the Schuylkill River Tract for the purposes of hunting, this release and waiver is executed on the    Date*      day of   Month    ,   Full Year*, by   First Name*   Last Name*   (Hunter) and   First Name*   Last Name*  (Guardian) on behalf of a minor child,    First Name*   Last Name*. Hunter (and Guardian) does for himself/herself, and his/her heirs or assigns, hereby forever waive, release, discharge, indemnify, and hold harmless Township and its officials, supervisors, agents, employees, professional consultants, contractors, and volunteers from any and all liability, claims, causes of action of any nature, suits at law or equity, and demands of whatever kind and nature, which arise or may hereafter arise from Hunter's (and Guardian's) activities on Monocacy Hill and/or the Schuylkill River Tract. Hunter (and Guardian) understands that this agreement is binding on Hunter (and Guardian), and on Hunter's (and Guardian's) heirs, executors, administrators, successors, and assigns. Hunter (and Guardian) further understand that this permission is revocable by Township at its discretion, at any time, and for any reason.

Hunter (and Guardian) understands that this release discharges Township from any liability or claim that Hunter (and Guardian) may have against Township with respect to any bodily injury, personal injury, illness, death, or property damage that may result to Hunter (and Guardian) or by Hunter (and Guardian) from Hunter's (and Guardian's) activities on Monocacy Hill and/or the Schuylkill River Tract, whether caused by the negligence of Township or its officers, directors, employees, agents, or otherwise. Hunter (and Guardian) acknowledges and understands that Hunter (and Guardian) voluntarily agrees to expressly accept and assume all risks involved in Hunter's (and Guardian's) participation in hunting activities. Hunter (and Guardian) also understands that Township does not assume any responsibility for or obligation to provide financial assistance or other assistance, including, but not limited to, medical, health, or disability insurance in the event of injury or illness. Except as otherwise agreed to by Township in writing, Township does not carry or maintain health, medical, or disability insurance coverage for any hunter. Hunter (and Guardian) is expected and encouraged to obtain his or her own medical or health insurance coverage.

Hunter (and Guardian) expressly agrees that this Release Waiver of Liability and Indemnification (Release) is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Pennsylvania, and that this Release shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania. Hunter (and Guardian) agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.

In addition to abiding by the Pennsylvania Game Laws, Hunter (and Guardian) will obey all Rules and Regulations according to Section 20-121 (as amended) of the Code of Ordinances of the Township of Amity, Berks County, Pennsylvania. Hunter (and Guardian) also understands that failure to comply with all regulations will result in the revocation of this permit and may subject Hunter (and Guardian) to prosecution under law.
