TERMS & CONDITIONS
NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce negatives, digital images and printed photographs elsewhere without Pamela Lin's permission, in the form of a Print Release, and violators of this Federal Law will be subject to its civil and criminal penalties.
1. ENTIRE AGREEMENT: This agreement contains the entire understanding between Pamela Lin and the client (named above). It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties.
2. ONLINE GALLERY: After the session once all photographs have been edited, Pamela will provide the client with an online gallery. This gallery will contain all edited photographs from the session. Online gallery will be available for viewing/sharing/downloading within 3 weeks of session date.
3. PAYMENTS: The client agrees that the balance is due in full at the time of session. Invoice will be sent through e-mail. Client agrees to pay non-refundable retainer (50% of balance) to hold date for session. If session must be rescheduled, deposit goes toward session at later date.
4. MODEL RELEASE: The client hereby assigns and grants Pamela Lin the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for social, editorial, trade, advertising or any other purpose and in any other manner and medium; the client hereby releases Pamela Lin from all claims and liability relating to said photographs. It is agreed that Pamela may display and use the photos for advertising and promotions.
5. Pamela Lin takes the utmost care with respect to exposure, transportation and processing of photographs. However, in the unlikely event of the clients phtographs being lost, stolen or destroyed for reasons within or beyond Pamela's control, the latters liability to the return of all payments received for the session package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.
