I we ("I"/"my") am a member(s) of the Travisso Community, Inc. (the "Association") and am registering for use of the common area facilities of the Association (the "Facilities" I understand that the Facilities are owned and/or maintained by the Association and that Travisso, Ltd. (collectively referred to herein as "Declarant" which shall include all of Travisso, Ltd.'s subsidiaries, affiliates, partners, directors, shareholders,officers and employees) or the Association does not, by provision of these Facilities, assume any responsibility or liability to me, my children, Occupants or my guests, and I undertake such use AT MY OWN RISK. I understand that my access to the Facilities is subject to the Travisso Facilities Rules adopted by the Association attached hereto as Exhibit "A". I acknowledge that I have reviewed and understand the Travisso Facilities Rules attached hereto as Exhibit "A". Furthermore, I accept the current and future condition of the Facilities and the property on which the Facilities are located (the "Property") as is and with all faults. I understand that the Association and Declarant makes no implied or express representations or warranties of any kind whatsoever regarding the Facilities and the Property, including, but not limited to, the safety or security of the Facilities and the Property, the compliance of the Facilities and the Property with any applicable law, or the fitness for any use by me or my children, my Occupants, agents, guests, and invitees. I understand that no affirmation of the Association or Declarant, by words or actions, shall constitute a warranty of any kind whatsoever. In addition, I understand that the Association or Declarant shall not be liable to me or my children, my Occupants, agents, guests, and invitees, or any third party for any damage to person or property proximately caused by any of my acts, omissions or neglect, or the acts, omissions or neglect of my children, my Occupants, agents, guests, or invitees, and I agree to indemnify and hold harmless the Association and Declarant from all claims, demands, actions, suits, and liabilities, of any kind whatsoever, for any such damage. I understand that the Association and Declarant shall in no event be liable for any damage to person or property proximately caused by any act, omission, or neglect of the Association or Declarant, or their directors, officers, employees, or agents. Furthermore, I understand that the use of the Facilities is a privilege offered by the Association that can be suspended for a length of time to be determined by the Association's board of directors if: 1 I am delinquent in my Association assessments, 2 my property or home is in violation of the Travisso Master Covenant, 3 if I, members of my family, Occupants, agents, guests or invitees violate any Travisso Facilities Rules, or 4 for any other violation of the rules, regulations, policies, design guidelines (if any), or other governing documents of the Association. Acknowledgement and Agreement: I HEREBY RELEASE, ON BEHALF OF MYSELF AND ANY MINOR CHILD TO WHOM GUARDIAN, AND ON BEHALF OF MY HEIRS, EXECUTORS, ADMINISTRATORS AND ASSIGNS, DECLARANT, THE ASSOCIATION, AND THEIR DIRECTORS, OFFICERS,EMPLOYEES AND AGENTS FROM LIABILITY FOR ANY CLAIMS WITH RESPECT TO THE FACILITIES OR THE PROPERTY. I UNDERSTAND THAT I WILL BE FINANCIALLY RESPONSIBLE FOR ANY DAMAGE THAT I OR MY OCCUPANTS, GUESTS, ETC., MAY CAUSE TO THE FACILITIES. *

I understand ONE free Facility Use key fob will be issued to the Owner of the property for new build homes only. Additional key fobs are available for purchase for $20 each (payment accepted through credit card only). *

I understand that in order to receive, activate, or purchase any key fobs I must bring a valid ID as well as either my Closing Disclosure, Lease Agreement, or Master Settlement Agreement as proof of Travisso Residency.

I understand key fobs may only be used by the Owner the key fob is registered to. Children under 16 years of age are never authorized to use our amenities, including the tennis courts, pool, and gym, without the direct supervision of their parent of guardian. *

I understand if I resell or lease my home, I am expected to leave my keyfob(s) for the new residents. If I am leasing my home, I understand my tenants must fill out a Facility Use Agreement prior to using any community amenities. *
