SERVICE AGREEMENT
This Agreement is made between Pawsitive Walkers, operated by Solange Alves da Silva, and the individual identified in the form below (“Pet Owner”).
1. Ownership and Responsibility
By signing up for any service provided by Pawsitive Walkers, the Pet Owner confirms legal ownership of the listed dog(s) and accepts full responsibility for the animal(s)’ participation. Pet Owner acknowledges and accepts all potential risks involved in services such as group walks, pet sitting, or overnight boarding. The Pet Owner remains solely responsible for any injury, loss, or damage caused to or by their dog(s) during the service period.
2. Normal Play and Risk Acknowledgment
Pet Owner understands that supervised dog activities—even with diligent care—carry inherent risks. Minor injuries like scrapes, small bites, or strains may occur during playtime. While all play is monitored, such incidents are a natural part of dog interaction and are not considered negligence.
3. Behavior and Health Requirements
All dogs must complete a basic temperament and behavior screening prior to participation. Dogs showing signs of aggression toward humans or other animals are not eligible for services. By enrolling, the Pet Owner affirms that their dog(s) is/are healthy, free of behavioral issues, and have not displayed threatening or aggressive behavior. Pawsitive Walkers reserves the right to remove or deny services to any dog that demonstrates unsafe or disruptive behavior at any time.
4. Limitation of Liability
The Pet Owner agrees that Pawsitive Walkers, including its staff, volunteers, and affiliates, will not be held liable for illness, injury, escape, or death of any dog while under their care—provided that reasonable safety measures and precautions are in place. Pet Owner releases Pawsitive Walkers from any claim or liability arising from such incidents.
5. Health Concerns and Medical Treatment
If the dog(s) under Pawsitive Walkers’ care develop any health or behavioral issue, the staff will take appropriate action based on their best judgment. The Pet Owner agrees to cover all costs associated with emergency care, treatment, or damage caused by their dog(s), including but not limited to medical attention or repair of destruction caused by the dog(s).
6. Vaccination and Contagious Illness Policy
All dogs must be current on required vaccinations per Massachusetts state guidelines, including but not limited to rabies, distemper, and bordetella. Dogs showing signs of contagious illness or who have been exposed to one within the past 30 days must not attend any services. Pet Owner acknowledges that even vaccinated dogs may contract kennel cough or other mild illnesses, and agrees not to hold Pawsitive Walkers responsible should such illness occur.
7. GPS Tracking
To enhance safety during walks and outings, dogs may be equipped with a GPS tracking device. If your dog already wears a tracker such as an Apple AirTag, you are encouraged to share access with us. If not, Pawsitive Walkers may temporarily provide and share tracking data for the duration of the dog’s care.
