  • SOCIAL MEDIA MANAGEMENT AGREEMENT

    This Agreement (the "Agreement") is made and entered into on the date of signature by and between you (the "Client") and Sarah Lilly from Sarah Lilly Media ("Sarah Lilly Media").

    Sarah Lilly Media will provide you with social media management at the level of the package you have selected and any additional add-ons as agreed by both the Client and Sarah Lilly Media. 

    By signing this agreement, the Client agrees to the following terms and conditions.

     

    1. Payment

    The Client agrees to make all payments as per their chosen social media package. 

    The client agrees to make the first payment before the work begins and then at the start of the month, thereafter. Monthly payments will automatically be deducted each month for the payment term.

    Monthly direct debit payments are managed via Stripe. 

    Any late payments will mean that you will lose access to social media management and all work will be halted. Interest of 10% will start to be charged on the late payments after 3 days, and in the event of non-payment, the debt may be sent to a third party for collection. 

    Due to the nature of this service, there are no refunds and all payments are non-refundable. 

    All prices are in NZD.

     

     

    2. Notice Period

    There is a three month minimum agreement for social media packages. If the agreement is cancelled before then, the Client will be liable to pay for the full three months.

    2 months written notice is required by both parties for the termination of the agreement, unless the client has opted for additional quarterly strategy meetings, in that case, 3 months notice is required for contract termination. 

     

    3. Content

    The Client agrees to provide high-res imagery and video for use in social posts to Sarah Lilly Media. This is so that your reels and posts can be the best possible quality that they can be. This is to be provided in a timely manner and Sarah Lilly Media holds no responsibility for any content that is unable to be published due to content not being recieved on time. 

    Please let us know in advance if you would like assistance in arranging this content to be created. If located in Dunedin, we can help take content for you (as an additional cost) or to help arrange a photographer if you are out of Dunedin (also at an additional cost)

    4. Deadlines & Communication

    Sarah Lilly Media prides ourself on our communication and expect our clients to do the same. We may require from you additional information or images and this is to be provided in a timely manner. Likewise we may require content approvals before a certain date. This will be communicated to the Client in plenty of time.

    Sarah Lilly Media takes no responsibility for any posts that are not approved on time due to lack of communication or information from the client. 

     

    5. Social Media

    The Client grants Sarah Lilly Media ability to share or use comments or results on the Sarah Lilly Media website or social media. These will be anoymous and will not include any personal information or identifiers of the client. 

    Sarah Lilly Media may also ask the Client for a testimonial of the results, which the Client may choose to agree to. This will be identifying and include the Clients name

     

    6. Liability 

    The Client acknowledges that while Sarah Lilly Media will use best practices and professional expertise to create and manage content, Sarah Lilly Media cannot guarantee specific results or control public reactions to the content.

    The Client assumes full responsibility for any outcomes, including but not limited to negative comments, public backlash, or other unforeseen reactions. Sarah Lilly Media shall not be held liable for any reputational damage, loss of business, or other consequences resulting from the content published on behalf of the Client.

    The Client is responsible for maintaining the security of their social media accounts, including safeguarding passwords, granting appropriate access levels, and monitoring for unauthorized activity. While Sarah Lilly Media will take reasonable precautions when accessing and managing accounts, Sarah Lilly Media is not liable for any breaches, hacking incidents, or unauthorized access that may occur. The Client is encouraged to use strong passwords, enable two-factor authentication, and regularly update account credentials to enhance security.

     

    7. Creator Package

    If opting for the Creator package, the Client is aware that the main part of the text for each post needs to be provided by them. Sarah Lilly Media is only responsible for fine tuning and optimising the content, creating visual content (either imagery or templated content) and scheduling. All written content needs to be provided in a timely manner and Sarah Lilly Media takes no responsibility for any content which is not posted due to lack of communication.
