Service Terms* This field is required.Trainer agrees to provide private lessons for Client and Dog on a lesson-by-lesson basis, the goal being to teach Client how to train and work with Dog. These lessons will take place at Trainer's place of business with training utilizing Dog only and Client being incorporated in the training sessions per Trainer’s discretion. Trainer will make every reasonable effort to help Client achieve training and behavior modification goals but makes no guarantee of Dog’s performance or behavior as a result of providing professional animal behavior consultation/training. Client understands that he/she and members of the household must follow Trainer’s instructions without modification, work with dog daily as recommended, and constantly reinforce training being given to Dog.

Liability Terms* This field is required.If Dog causes property damage, or bites or injures any dog, animal or person (including but not limited to Trainer and Trainer’s agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Trainer and Trainer’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If Dog is injured in a fight or in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that Trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses. By agreeing to these terms, I certify that I have been informed and understand that there is always some unavoidable risk of injury involved when working with animals, especially animals with behavioral issues. I acknowledge that dogs can be inherently difficult to control and that not all dogs will be under control at all times resulting in the possibility of injury to myself, my dog, my family members, or third parties. Additionally, I have had full opportunity to discuss all concerns I have about the foregoing risks with Kisha’s Kommands, LLC. and its authorized representatives. I have also made all inquiries and investigations to my satisfaction related to such risks, including, but not limited to, an examination of the training area (if applicable). I hereby accept and assume, without reservation, all risks associated with my participation in the Classes, including, but not limited to: the risks of any and all injuries to myself, my dog and any of my family members or third parties who may attend; the risks that my dog may cause injury to other persons and/or dogs while training. As lawful consideration for participating in the classes, I, for myself, my heirs, executors, administrators, legal representatives, successors and assigns hereby waive, release, discharge and agree not to sue and to indemnify, defend and hold harmless Kisha’s Kommands, LLC. and their members, managers, agents, and employees from any and all injuries, losses, claims and damages to any person or persons of any nature whatsoever, including claims arising from the Released Party’s own negligence, and all costs associated therewith, including attorney’s fees, court costs and consultant fees, arising from my participation in the Classes.

Trainers Fees Terms and Conditions* This field is required.Client agrees to pay Trainer according to our payment term as follows: All payments due in full on the first day of training or according to the agreed upon payment plan. We accept ONLY the following payment methods: Zelle (no fee), Cash (no fee) or Credit/Debit Card (online)payments with a 3% fee applied. (Zelle information is Kisha Myers kisha.myers@yahoo.com). Zelle and Online payments must be paid and cleared prior to session. If your account is late your dog(s)'s sessions will be canceled until the account is current. Full payment is due on first session unless taking advantage of payment plan option. Deposits for private lessons or class Sessions are non-refundable. All sales are final. Clients may terminate services at any time with the understanding that no costs will be refunded. Trainers may terminate contracts with no refund in cases of severe threat of injury or breach of contract

Payment Plan Terms* This field is required.Deposit/Initial payment is due prior to start of first session. Deposits are an acceptance of estimate and payment installment offer. Installment payments are due Monday by midnight unless agreed differently in estimate. Payments are due regardless of training schedule including cancellations or holds. A late fee of $25 per day will be applied to installment payment after midnight on the due day. Trainer reserves the right to waiver one late charge as a reminder of terms without contract disollution. The client has the right to pay back the loan in full or make additional payments at any time without penalty. Additional amount above scheduled payment will be applied to the principle balance without affecting weekly payment schedule. If client fails to pay by due date for two incidences during agreement, trainer reserves the right to demand balance due immediately without need of further notice. If litigation is needed to receive payment client agrees to all fees associated with said litigation.

Confidentiality/ Photography/ Social Media/ Video Terms* This field is required.Any agreement between Trainer and Client regarding pricing and training is to remain confidential between Trainer and Client. Any techniques shown to the client cannot be shared for client's monetary gain.We do not allow pictures or videoing of any sessions by clients or client(s)' family/friends. Client agrees to their Dog being photographed and/or videoed and understands the photo/video may be used for promotion. Agreement to this clause constitutes a release to all video, audio, and photography records to Kisha's Kommands, LLC. In addition, a trainer may use their personal phone number to contact the client (due to technical issues). Clients are not to give out these personal numbers nor use them as a means to initiate contact with a trainer. All communication must be facilitated through our business social media or contact information.

Sessions/ Training Plan/ Parking Terms* This field is required.Proof of current vaccinations required prior to training.Training Plan: Client agrees to the training plan provided by Trainer and described in estimate. Sessions: Sessions are 45 minutes each unless specified otherwise by the trainer. We offer session by session pricing but results are variable as consistency is integral to training success. Please be courteous of others and remember that each client has his/her own appointment with each appointed session lasting 45 minutes. This is to ensure that every client is getting the trainer’s full attention for the entire allotted time. If our schedule permits us to take your dog early the session is only 45 minutes. Parking: Please park to the side and do not block the driveway. Also please stay off the grass and refrain from driving through the yard unless directed by trainer. Due to liability purposes clients are asked not to exit their vehicle nor allow the dog to exit without a trainer present. We must look out for the safety of all clients and their dogs. If you arrive early and another dog is present we ask that you make a block so that you do not interrupt that dog's time.

Cancellation and Early Pickup or Late Drop off Terms* This field is required.Cancellation Policy: Cancellations by Trainer will be rescheduled with no charge. Cancellation with a 24 hour notice will be rescheduled with no charge. If Client fails to give at least 4 hours cancellation notice, or is not present at time of scheduled appointment, session fees are still due and Trainer is not required to make up session. An addition fee of $25 per appointment can be charged for no call/no show cancellations. Trainer received the right to waiver no show/no call fee if Client contacts them within the same day and had an emergency that did not allow early notification. We limit client cancellations to three per package. After three cancellations we reserve the right to terminate the dog's training with no refund of any payments and any remaining balance due immediately. Late fee for pickup is $20 for the first 10 minutes and $1 for each additional minute due upon pickup. Trainer reserves the right to waiver one late pickup charge as a reminder of terms without contract dissolution. Early Pickup: If you return early for pickup we reserve the right to end the session early as the dog gets distracted by their owner’s vehicle.

Contract Termination Terms* This field is required.All fees are non-refundable. Clients may terminate services at any time with the understanding that no costs will be refunded and any balance on their account is due in full at that time. At Trainer's sole election, Trainer's duties hereunder shall terminate if (a) in Trainer's sole judgment Dog is dangerous or vicious to Trainer or any other person or animal, or interferes with the training of other dogs, (b) non-payment per agreement, (c) attendance or tardy issues, or (d) Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, Trainer's duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.

In Conclusion* This field is required.This Agreement is binding upon Client, spouse of Client, and children of Client. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Trainer regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made regarding Dog or anything else. Without limiting the generality of the foregoing, Client acknowledges that Trainer has not represented, promised, guaranteed or warranted that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time. This Agreement may be amended only by a written instrument agreed upon by both Client and Trainer. Agreement may be in text, email, or a signed revised contract. By initialing and signing this contract, client agrees to all initialed and signed sections.
