Agreement

PARTICIPATION IN THE EVENT

Participation entitles the child to attend the designated [Parents' Night Out] events according to the current schedule at NOLA CHAMPION LLC. Participation does not grant the child or their parents/guardians any ownership or rights in NOLA CHAMPION LLC, its management, property, or operations.
 

COSTS:

The payment Fee for Parents' Night Out is $50.

For each additional sibling, the payment Fee is $45.

Day before and day-of registration includes a $10 late fee.

 

 

Cancellations must be completed no later than the Friday prior to Parents' Night Out. Your payment will be credited towards the next available Parents' Night Out with prior cancellation. No credits or refunds will be given due to day of cancellations or absence.

A late fee of $1 per minute, per child will be charged to the account of any children picked up after 9 pm.

MINOR CHILD PARTICIPATION

The signer, along with the Participant, agrees to be bound by all the terms and conditions of the Agreement, including payment of all fees. The Parent(s) and/or legal guardian(s) do/does hereby approve and execute this Agreement on behalf of the Participant.

PERSONAL CONDUCT
The Participant agrees to observe and obey all posted rules and warnings, and further agrees to follow any oral instructions or directions given by NOLA CHAMPION LLC and any of its administrators, managers, owners, directors, agents, officers, volunteers, employees, representatives, subsidiaries, affiliates, associates, successors, or assigns (collectively, the “NOLA CHAMPION Parties”). The Participant is required to conduct themselves in a manner that ensures the safety of others at all times. Each Participant accepts sole responsibility for their own conduct and actions while participating in the activities and the condition and adequacy of any equipment they may own and supply in conjunction with those activities. The Participant is aware that portions of the activities may not be guided or supervised at all times by NOLA CHAMPION LLC and/or NOLA CHAMPION Parties. The Participant agrees to pay for all damages to the facilities of NOLA CHAMPION LLC caused by the Participant’s, their family’s, or their guests' negligent, reckless, or willful actions.

EVENTS
The Participant understands that the scheduling and content of events and activities, the furnishing of facilities, and the provision of staff to supervise and conduct Parents' Night Out activities are at the sole and absolute discretion of NOLA CHAMPION LLC. The Participant understands that NOLA CHAMPION LLC reserves the right to change the schedule and location of the event. NOLA CHAMPION LLC also reserves the right to cancel or reschedule the event due to inclement weather, emergencies, or other concerns.

NOTICE TO PARTICIPANTS
Do not sign this Agreement before reading it in its entirety. The Participant is entitled to a copy of this Agreement. The Participant acknowledges that they have been notified: (A) that this document is an Agreement and will become legally binding upon its acceptance by NOLA CHAMPION LLC; and (B) of the terms and conditions of this Agreement. There are no warranties, either expressed or implied, which extend beyond this Agreement. If any provision of this Agreement is held to be invalid or unenforceable in whole or in part, this Agreement shall continue to be valid with respect to its other provisions and the remainder of the affected provision.

CONFIDENTIALITY OF AGREEMENT
The Participant agrees that this Agreement and its terms are strictly confidential and shall not be disclosed to any person, firm, corporation, or other entity, either orally or in writing, except as may be necessary to comply with applicable laws and regulations, court orders, or other legal processes, or to confer with a financial advisor, tax preparer, or lawyer regarding the subject matter of this Agreement, or to enforce this Agreement. This confidentiality obligation extends to NOLA CHAMPION LLC and its representatives.

 

 

Assumption of Risk

I, the undersigned parent or guardian, do hereby grant permission for my child(ren) to participate in the Parents' Night Out activities at "NOLA CHAMPION LLC." I understand that the activities at "NOLA CHAMPION LLC" may involve a significant degree of physical activity. I certify that my child(ren) is/are in good physical health and condition and free from injury or disability that might impair their ability to participate without limitation in any event, game, or activity during Parents' Night Out at "NOLA CHAMPION LLC."

I further acknowledge and understand that due to the nature of these activities, there is a possibility that my child(ren) may sustain physical illness or injury (minimal, serious, or catastrophic) in connection with their participation. I also understand that any physical activities involve certain inherent risks, which include but are not limited to falling, being hit by objects or props, twisting or breaking bones, bruises, or other physical injuries that may require treatment from a medical physician.

Release of liability

I further acknowledge and understand that my child(ren) is/are assuming the risk of such physical illness or injury by participating in the Parents' Night Out event, and I hereby release "NOLA CHAMPION LLC" and its representatives from any claims for personal illness or injury that my child(ren) may sustain during participation in this activity. I hereby release, indemnify, and hold harmless "NOLA CHAMPION LLC" and its agents, employees, officers, directors, owners, partners, members, all parties for whom "NOLA CHAMPION LLC" may be responsible, and all other persons or entities associated with "NOLA CHAMPION LLC" (together the “Releasees”) from and against any and all claims, liabilities, damages, demands, costs, attorney fees, and expenses (including, without limitation, liability for personal injury, death, and property damage) which may arise or be in any way connected with "NOLA CHAMPION LLC."

"NOLA CHAMPION LLC" also requires a signed ‘Waiver of Liability’ form for each child participating in the Parents' Night Out event. Children will not be allowed to participate until the signed waiver form is returned.

If a provision of this Agreement is or becomes illegal, invalid, or unenforceable in any jurisdiction, that shall not affect: the validity or enforceability in that jurisdiction of any other provision of this Agreement; or the validity or enforceability in other jurisdictions of that or any other provision of this Agreement.

I hereby state that I am authorized to make this decision. I agree to indemnify, defend, and hold harmless the Releasees, as described above, from any loss, liability, cost, attorney fees, or damages whatsoever that may be imposed upon said Releasees because of any defect or lack of such authority to take the actions described herein on behalf of the undersigned participant.

I have read and understand all of the above and voluntarily sign this document, and further agree that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.

Medical Emergencies

In the event that my child may require medical treatment due to injury or illness during participation in any event or activity at or with "NOLA CHAMPION LLC," I hereby authorize "NOLA CHAMPION LLC," its representatives, teachers, coaches, or other supervising adults to obtain medical treatment for my child for such injury or illness. I hereby hold "NOLA CHAMPION LLC" and its representatives harmless in the exercise of such authority.

I understand that participation in Parents' Night Out activities may involve physically strenuous activities, and my child may be exerted during this program. I acknowledge that if an injury occurs due to falling, tripping, being knocked into, or hit by objects or props during activities, or any other cause, I expressly assume the risk of such injuries and agree that we will not hold the Released Parties responsible for the same.

Furthermore, I agree that I am responsible for my child(ren)’s health and accident insurance and any medical costs incurred as a result of injury. I also give my permission for emergency medical transportation and treatment at my expense if the need arises.

 

COVID-19 Consent Form and Liability Waiver

"NOLA CHAMPION LLC" will endeavor at all times to reasonably follow state and local standards of conduct and has implemented reasonable preventative measures to reduce the spread of COVID-19 during its activities (including, but not limited to, Parents' Night Out events, photos, live performances, and other activities). COVID-19 is highly contagious and is believed to spread mainly through person-to-person contact. "NOLA CHAMPION LLC" will make every effort to prevent symptomatic employees and participants from entering the premises. However, COVID-19 has been shown to be asymptomatic in some individuals. Therefore, even though reasonable standards and measures will be in place, "NOLA CHAMPION LLC" cannot guarantee that you, your child(ren), guests, or relatives will not become infected with COVID-19 or any other virus.

Further, you understand and acknowledge that attending "NOLA CHAMPION LLC" events, such as Parents' Night Out, could increase your and your child(ren)’s risk of contracting COVID-19. By signing this Agreement, I acknowledge the contagious nature of COVID-19 and its variants and understand that my child(ren) and I may be exposed to or infected by COVID-19 by participating in activities at "NOLA CHAMPION LLC." Such exposure or infection may result in personal injury, illness, permanent disability, or death.

I understand that the risk of becoming exposed to or infected by COVID-19 at "NOLA CHAMPION LLC" may result from the actions, omissions, or negligence of myself and others, including, but not limited to, employees, volunteers, program participants, and their families. Considering this, I grant permission for my child(ren) to participate in activities with "NOLA CHAMPION LLC" despite the risks associated with COVID-19 and group activities.

I further agree on behalf of myself, my child(ren), my spouse, our heirs, successors, and assigns, to release, indemnify, hold harmless, and defend "NOLA CHAMPION LLC" and its members, directors, officers, employees, agents, and representatives (collectively "Indemnitees") from any event arising from, or in any way related to, any negligent act(s) or omission(s) of any Indemnitee in relation to preventing the spread of the COVID-19 virus. I SPECIFICALLY ACKNOWLEDGE AND AGREE THAT I AM AGREEING TO DEFEND, INDEMNIFY, AND HOLD HARMLESS THE INDEMNITEES FROM THEIR OWN NEGLIGENCE AS IT RELATES TO PROTECTION AGAINST COVID-19 AND ALL ITS VARIANTS.

 

Model Release

I hereby consent to the use of my child(ren)’s likeness, name, and voice by "NOLA CHAMPION LLC" in connection with its informational, promotional, and marketing activities, including, but not limited to, use in photographs, electronic video, social media, and web-based content, as well as audio recordings or the "NOLA CHAMPION LLC" website, without compensation.

I HAVE READ THIS WAIVER, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE. I INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW, AND I AGREE THAT IF ANY PORTION OF THIS WAIVER IS HELD TO BE INVALID, THE REMAINDER SHALL CONTINUE IN FULL FORCE AND EFFECT.

TO BE SIGNED BY PARENT/LEGAL GUARDIAN IF THE NAMED PARTICIPANT IS UNDER LEGAL AGE (18 YEARS OLD). I AM THE PARENT AND/OR LEGAL GUARDIAN OF THE MINOR(S) LISTED BELOW AND HAVE THE AUTHORITY TO EXECUTE THIS WAIVER ON THEIR BEHALF.

I hereby acknowledge that I understand the nature of the Parents' Night Out event and believe that the said minor is capable and qualified to participate in the event. On behalf of myself, my personal representative, heirs, beneficiaries, assigns, and the said minor, I hereby adopt and fully incorporate the entirety of the Waiver on the minor’s account and behalf.

By checking the box below, you are: (1) consenting to communicate electronically with "NOLA CHAMPION LLC" regarding enrollment and participation in Parents' Night Out events; (2) authorizing "NOLA CHAMPION LLC" to send you notices, disclosures, and forms electronically, and agreeing that information and responses you provide to "NOLA CHAMPION LLC" may be stored in electronic format; and (3) agreeing that your electronic signature on an electronic authorization or agreement will serve the same purpose as a written signature.
