  • Please read this document carefully because signing it indicates you are waiving certain legal rights, including the right to pursue personal injury negligence claimsagainst the released parties. If you have any questions, ask any member of the support staff, or an attorney, before initialling a paragraph to signify your understanding. Also, you should discuss this with your family and/or heirs since youare waiving their rights to pursue recovery in the event that you are injured or killed during these activities. Print when filling in the blanks and initial each paragraphbefore signing your name at the end of this waiver.

  • I, * hereby affirm that I have been thoroughly informed of the risk involved with any freediving/breath-holding activity and submit this form having read and understood the release of liability.

  • Participant Cancellations or Rescheduling

    More than 14 days before the course start date: Full refund (minus processing fees) or option to reschedule. 7 to 14 days before the course: 50% refund (minus processing fees). Less than 72 hours before the course: No refund. No-shows: No refund.


    Cancellations by Salty Souls Freediving (Non-Weather Related)

    If Salty Souls Freediving must cancel the course for any reason other than weather, participants will receive either a full refund or the option to reschedule.


    Weather-Related Cancellations

    If the course is canceled less than 48 hours prior due to adverse weather, participants receive a full refund.  If the course is canceled more than 48 hours in advance due to weather, participants are responsible for any non-refundable expenses such as flights, accommodation, or travel costs.

    Salty Souls Freediving is not liable for financial losses resulting from weather-related cancellations.

    Rescheduling Policy

    Participants may request to reschedule their course at least 72 hours before the scheduled start time.  Rescheduling is subject to availability, and a rescheduling fee may apply to cover administrative costs.  Rescheduling requests made less than 72 hours before the course start time will be treated as a cancellation, and no refund or reschedule will be offered.

  • Acknowledgment of Risks

    I acknowledge that freediving and breath-holding underwater are inherently dangerous activities, involving both known and unknown risks. These risks include, but are not limited to:

    • Hypoxia
    • Marine life injuries (e.g., bites, stings, abrasions, or attacks)
    • Barotraumas (injuries caused by pressure changes)
    • Latent hypoxia, which can lead to sudden unconsciousness underwater without warning ("shallow water blackout")
    • Physical injuries, such as head injuries, broken bones, or abrasions
    • Brain damage, drowning, death
    • Hyperbaric (pressure-related) injuries, such as squeezes to the ears, nasal cavities, eyes, lungs, or other airspaces
    • Injuries while embarking or disembarking boats

    I understand that in the event of an accident, immediate medical attention and/or hyperbaric oxygen therapy may be required. I acknowledge that the freediving training location may be remote, making access to medical care and/or a recompression chamber delayed or unavailable. Despite the increased risk of participating in remote locations, I choose to engage in this freediving/breath-hold training voluntarily.

    Understanding of Freediving Risks

    I specifically understand the inherent risk of latent hypoxia, brain damage, and death associated with freediving and breath-hold diving activities. Despite these risks, I voluntarily intend to participate. I agree never to freedive alone and will always dive with a qualified surface support freediver. I also agree to adhere to all guidelines and safety instructions provided by my instructor.

    Release of Liability

    For good and valuable consideration received, I agree that neither my instructor, facilitator, nor Salty Souls Freediving (the "Training Facility"), nor any of their respective officers, captains, agents, or employees ("Released Parties") will be held liable for any injury, death, or other damages to myself, my family, heirs, or assigns resulting from my participation in this freediving/breath-hold training. This includes any injury or damage resulting from the NEGLIGENCE OF THE RELEASED PARTIES, whether active or passive.

    I assume all known and unknown risks in connection with this training, and agree to release the Released Parties from any and all claims, demands, damages, actions, causes of action, or suits in equity arising from my participation in freediving, even if due to the NEGLIGENCE OF THE RELEASED PARTIES.

    Diver Insurance
    I acknowledge that I have the option to obtain my own insurance coverage for freediving-related accidents and medical emergencies.

    I am aware that DAN (Divers Alert Network) Insurance offers policies specifically designed for divers, including coverage for hyperbaric treatment, emergency evacuations, and medical expenses. If I wish to have coverage, it is my responsibility to purchase my own insurance policy before participating in the course.

    I acknowledge that Salty Souls Freediving is not responsible for any medical expenses, evacuations, or other costs related to accidents or injuries that occur during freediving activities.


    Weather and Ocean Conditions Acknowledgment

    I acknowledge that freediving takes place in the open ocean, where weather and sea conditions are unpredictable. While every effort will be made to ensure the dive occurs in safe conditions, I understand and agree to the following:


    Diving in Challenging Conditions

    I understand that freediving sessions will proceed in conditions deemed safe by the instructor. However, these conditions may not always be comfortable, and I accept that I may encounter challenging weather or sea conditions while diving.
    Uncontrollable Weather Events:

    I acknowledge that weather is beyond the control of Salty Souls Freediving and agree to accept any potential cancellations or changes without holding the Released Parties responsible.


    Media Release

    I grant full rights and permission to the Released Parties to use any photography or videography of myself taken during the course for use in promotional materials, commercials, training content, or other commercial applications. I waive any right to compensation for the future use of such media.

    Equipment and Skill Requirements

    I affirm that I meet the prerequisite skill level or equivalent diving experience required to participate in this freediving/breath-hold diving course. I also understand that I am responsible for ensuring my freediving equipment is in proper working condition, regardless of where or from whom I obtained it.  If I lose or damage property owned by Salty Souls Freediving, I understand I am responsible for paying replacement equipment.

    Waiver of Legal Rights

    I understand that I have been given adequate time to consult with family, heirs, and legal counsel before signing this document. I make an informed choice to waive my rights (and those of my heirs and assigns) to pursue legal recovery if I am injured or killed during the course. It is my specific intention to proceed with the activities outlined in this agreement, fully aware of the risks and the legal release I am signing.

  • FINAL ACKNOWLEDGMENT AND WAIVER

    I am voluntarily waiving all of my legal rights to sue the Released Parties for anything related to their negligence in conjunction with freediving training and related activities.

    I state that I am of lawful age and legally competent to sign this liability release, or that I have the written consent of my parent or legal guardian to engage in this freediving/breath-hold dive under the conditions of this waiver as stipulated by their signature below.

    It is my intention by signing this document to exempt and release all of the Released Parties, as defined herein, from all liability whatsoever for personal injury, property damage, or wrongful death to me, however caused, including but not limited to the negligence of the Released Parties, whether active or passive.

    I have fully informed myself of the contents of this full, general waiver & liability release and assumption of risk by reading it before signing it on behalf of myself and my heirs. This waiver & release document consists of the truthful disclosure of specific diving experience and qualifications. It also requires me to print my legal name as well as execute my signature at the end of page three. I have been advised to seek the counsel of my personal attorney prior to executing this document. I have also been advised to discuss this with any heirs or potential family dependents, as their rights to sue are waived as well.
