CODE OF CONDUCT:

This Code of Conduct applies to all activities organised by Grazjyna Prinsloo (trading as Stirling Karate) (ABN 70 473 965 796) (Stirling Karate

All participants are required to comply with this Code of Conduct.

1.Duty of Care: Each participant under the age of 18 must be supervised by a parent or guardian at all times and must not be left unattended, except where prior arrangements are made with Grazjyna Prinsloo or Karin Prinsloo (each a Head Instructor Stirling Karate does not take any responsibility for the care or supervision of any participant, whether over or under the age of 18.

2.Respect: Each participant and spectator must act in a respectful manner at all times. Disrespectful behaviour will not be tolerated and Stirling Karate reserves the right to require any participant or spectator who behaves in a disrespectful manner to immediately leave the venue.

3.Discipline: Each participant must follow instructions promptly and maintain discipline throughout the activity. Stirling Karate reserves the right to require any participant who does not do so to immediately leave the venue.

4.Cultural Sensitivity: Each participant is expected to respect the cultural traditions and customs associated with karate during the activity, including etiquette, bowing, responding and sitting appropriately (on your knees or with neatly crossed legs

5.Cooperation: Each participant is expected to engage with other participants during the activity in a spirit of cooperation and mutual learning.

6.Safety: Each participant is responsible for their own health and safety during the activity and participates in the activity at their own risk. Each participant must prioritise their health and safety during the activity, including by engaging in warm-up exercises appropriate for their level of fitness, following all instructions and practicing controlled techniques during the activity.

7.Dress: Each participant is required to wear a full karate suit or club t-shirt and karate pants during the activity and must also provide and wear (at appropriate times) all other safety equipment they may require, including a mouth guard and karate gloves.

8.Payment: A participant's fees must be paid (in full) prior to the first lesson of each term or, in the case of a one-off event or activity, no later than the date notified by Stirling Karate. A participant may only enter the venue and participate in the activity once a waiver has been signed by the participant (or their parent/guardian) and returned to Stirling Karate along with payment of the relevant fees (in full Stirling Karate may agree to alternative payment arrangements in its discretion.

9.Hygiene: Each participant must maintain good personal hygiene and clean training attire to promote a healthy environment.

10. Compliance: Each participant must comply with Stirling Karate's rules and regulations applicable to this activity and the rules and regulations of any other applicable governing body.

11. Spectators: Entry into the venue constitutes agreement by the spectator to this Code of Conduct and any other rules and regulations applicable to this activity. Spectators must limit interaction with participants during activities and respect and follow instructions from the Head Instructor.

12. Feedback: Stirling Karate welcomes constructive feedback and suggestions for future activities. All feedback and suggestions should be given to a Head Instructor.

13. Enjoyment: Each participant should embrace the opportunity to practise karate in a supportive and inclusive environment.

 

WAIVER, RELEASE AND INDEMNITY

[Each Participant must read, sign and return this document to Grazjyna Prinsloo (ABN 70 473 965 796) trading as Stirling Karate before participating in any Activity]

This waiver, release and indemnity is irrevocably given by the Participant (or the Participant’s Parent/Guardian) in favour of Stirling Karate.

Definitions:

Participant, I or My means the person identified as such on page 2 of this document and, where the person is under the age of 18 years, includes that person’s parents or guardians and the person who signs this document on their behalf.

Venue means Stirling Karate’s dojo and surrounds and any other location at which an Activity takes place.

Stirling Karate means Grazjyna Prinsloo trading as Stirling Karate (ABN 70 473 965 796) and includes her Representatives.

Activity includes (without limitation) the following:

·     karate training, drills, gradings, examinations, seminars and competitions, including all warm up, cool down and practice activities undertaken by the Participant at or in the vicinity of the Venue whether before, during or after karate training, drills, gradings, examinations, seminars and competitions;

·     seminars and competitions organised by a martial arts association other than Stirling Karate that the Participant attends;

·     all physical and mental exercises and training done in connection with karate training, drills, gradings, examinations, seminars and competitions; and

·     karate demonstrations, fundraising and promotional activities carried out on behalf of Stirling Karate.
Representatives
includes (without limitation) all past and present:

·     JKA-SKC Western Australia Incorporated (ABN 44 163 612 754) its members and all members of its executive committee;

·     members any affiliated organisations;

·     Stirling Karate’s instructors, supervisors and coaches conducting or engaged in any Activity and any visiting instructors, supervisors and coaches;

·     officials conducting or engaged in any Activity, including (without limitation) referees, marshals and volunteers; and

·     any person or other body directly or indirectly associated with an Activity, including any owner of the premises at which the Activity takes place.

Waiver, release and indemnity:

1.    I acknowledge and understand that each Activity involves physical contact and employs techniques including punches, kicks, strikes and blocks with inherent risks.  I further acknowledge that I may suffer injury due to the strenuous, high impact, high velocity and repetitive nature of karate, including but not limited to, bodily injury, property damage, death and disability.

2.    I acknowledge that I have been given a safety briefing in relation to the Venue, My participation in each Activity and My use of any equipment which may be provided for use in connection with each Activity.  I confirm that I understand how to safely use the equipment and have been given an opportunity to inspect it and the Venue.

3.    In consideration of, and as a condition of Stirling Karate’s acceptance of My participation in each Activity, I agree to participate in each Activity entirely at My own risk and accept that I am solely responsible for My own actions and participation in each Activity.  I voluntarily assume all risks of injury, illness, death and disability as a result of My participation in each Activity.

4.    I acknowledge that I may choose not to participate in any Activity or aspect of an Activity (e.g. part of a drill or competition) and confirm that it is My sole responsibility to refrain from participating in those activities.

5.    I acknowledge that I have been requested to inform Stirling Karate if I have any medical condition or injury that may affect or be affected by My participation in any Activity.  Regardless of any medical condition or injury I may have informed Stirling Karate of, I unconditionally declare that I am medically fit (both physically and mentally) to participate in each Activity and I agree that any medical condition or injury advised to Stirling Karate does not limit this waiver, release and indemnity.  I consent to receiving any medical treatment that Stirling Karate considers necessary before, during or after the Activity.

6.    I acknowledge that Stirling Karate does not provide personal accident or medical insurance coverage for participants, and I am responsible for obtaining My own insurance coverage to protect against any injury or loss that I may suffer or incur.

7.    I acknowledge that I am solely responsible for any loss or damage to My personal property arising from My participation in, or attendance at, each Activity.

8.    I agree to abide by all codes of conduct, rules for attendance and instructions provided by Stirling Karate during or in respect of an Activity.

9.    I acknowledge that participants under the age of 18 must be supervised by a parent or guardian at all times and must not be left unattended at the Venue, except where prior arrangements are made with Grazjyna Prinsloo or Karin Prinsloo (each a Head Instructor).  I further acknowledge that Stirling Karate does not take any responsibility for the care or supervision of any participant, whether over or under the age of 18.

10. I acknowledge that photographs and videos may be taken by or on behalf of Stirling Karate during an Activity and consent to the publication and use (in any form) of My name, image, voice, results, statements or otherwise, without payment or compensation.

11. I consent to the collection and storage of personal information for the purposes of administering and conducting each Activity.  I consent to disclosure of My personal information for management and storage purposes, the regions where these disclosures (if any) are likely to occur are Australia and New Zealand and the Asia-Pacific region.

12. I acknowledge that I am not entitled to a refund or credit of any nature in relation to the membership or participation fees or ancillary items I have paid in respect of an Activity, for any reason whatsoever, or in any circumstances, unless and to the extent that Stirling Karate is required to provide a refund or payment at law.

13. I (and on behalf of My executors, administrators, heirs, next of kin, successors and assigns) release Stirling Karate from all claims, demands and proceedings arising out of or in connection with My participation in an Activity, waive all rights that I have or may have against Stirling Karate in contract or otherwise at law and indemnify Stirling Karate against all liability (including acts of negligence to the fullest extent permitted by law) whatsoever and howsoever caused arising as a result of or in connection with My participation in an Activity.

If the Participant is under the age of 18, this waiver, release and indemnity must be signed by the Participant's parent/guardian.

By signing this document, the Participant's parent/guardian warrants that they are the parent/guardian of the Participant and that they consent to the Participant participating in the Activity.
