Apply to become a reseller of AJ Hackett Bungy NZ via Hero

AJ Hackett Bungy NZ is just one of the thousands of great suppliers available for sale on Hero. To gain access to sell AJ Hackett Bungy NZ products, in addition to Hero's Agency Agreement, You must agree to adhere to these guidelines:

1. You (The Agent) agree to only sell Products and Services of the Operator (AJ Hackett Bungy NZ) at the Retail Price as displayed on Hero, unless AJ Hackett Bungy NZ has communicated in writing a specific promotion. 
2. The Agent will not resell the Operators Products and Services at a price other than the Retail Price unless prior agreement has been made in writing by the Operator. 
3. The Agent will not offer value-add incentives or discount vouchers on the Operator Products and Services unless agreed to in writing by the Operator. 
4. The Agent will not bundle and sell any Operator Products and Services with any other Operators product as part of a discounted bundle unless prior agreement has been made in writing by the Operator. 
5. For the avoidance of doubt; reselling at a price other than the Retail Price, discounting the current Retail Price, offering any value-add or discount vouchers or discounted bundling of the Operators Products and Services with any other operator activities is strictly prohibited under this Agreement, unless the Operator has given its prior written consent to such discount or bundling. 
6. From time to time the Operator may release tactical discounted promotions direct to consumers (“Operator Promotions”). Operator Promotions may also be extended to the Agent and the Commission for the Operator Products and Services sold under the Operator Promotions will be reduced in proportion with the discounted promotion during the period of the Operator Promotion. 
7. The Agent from time to time may approach the Operator with tactical promotion opportunities. The Operator will consider all requests which are accompanied by a marketing proposal but is not obliged to accept those opportunities. 
8. All references to discounted Operator Products and Services must be removed by the Agent from any online platform at the end of the promotional period to ensure that the offer is no longer searchable online. 
9. The Agent will withhold from bidding on the Operator’s AJ Hackett Bungy NZ, SkyJump & SkyWalk trademarks and product names (as per Keyword Exclusion List below) in paid search engine advertising (e.g. Google Adwords, Bing Ads); nor will the Agent use AJ Hackett Bungy NZ, SkyJump & SkyWalk trademarks and product names in ad text or display URLs in a way that confuses users as to the origin/ownership of the activities. The Agent will comply with any other directions issued by the Operator in respect of its brand and other intellectual property from time to time.

10. The Operator grants to the Agent the non-exclusive worldwide right to publicly display and otherwise use any and all Operator Content provided by Operator for the sole purpose of advertising, market, promoting, and distributing the Operators Products and Services on or through the Agent’s distribution channels. This right is for the duration of the Term of this Agreement.
11. The Agent agrees that the use of Operator Content is strictly limited to the sale and promotion of the Operators Products and Services.
12. It is the Agent’s sole responsibility to ensure that any use of the Operator Content by the Agent or in its distribution channels is in accordance with the terms of this Agreement and that the Operator Content is used in a way which is accurate and complete; is not misleading or fraudulent; and does not and will not infringe, violate or misappropriate any third party’s proprietary or intellectual property rights, including without limitation any copyright rights or trademark rights or rights of privacy or publicity. 

 

Risk Disclosure

• AJHBNZ activities offer unique and memorable experiences. However, like all adventure experiences they carry inherent risks that we, as an experienced operator, want to communicate clearly to all participants.
• AJHBNZ will provide agents with a copy of their risk disclosure, terms and conditions and legal waiver.
• AJHBNZ requires all agents to take reasonably practicable steps to ensure the risks associated with our experiences are disclosed to all customers.
• AJHBNZ requires all ‘online agents’ to place links next to all AJHBNZ listings, to ensure the risks associated with our experiences are disclosed to all customers.
• As part of the booking process, AJHBNZ requires the customer email address for all bookings.
