Downtown Winnipeg BIZ
Choose Downtown Winnipeg Campaign Contest Rules:
- Application of Rules: These general contest rules (the “General Contest Rules”) apply to the Choose Downtown Winnipeg Campaign & Contest (the “Contest”) which is operated by The Downtown Winnipeg BIZ (the “BIZ”). By entering the Contest, entrants agree to be legally bound by these General Contest Rules and will be deemed to have read and understood these General Contest Rules.
- Eligibility: Entrants must be legal residents of Manitoba, and 18 years of age or older at the time of entry. Employees and Board members of the BIZ are ineligible to win prizes. As well, the parents, siblings and children of any such employees or Board member are ineligible to win prizes.
- Contest Period: The Contest will run from September 25, 2024 at 12:00 AM CDT until 11:59 pm CDT on October 30, 2024 (the “Contest Period”).
- Prizes: Contest entrants will be eligible to win:
one (1) of two hundred (200) $25.00 Downtown Winnipeg BIZ gift cards, with an approximate total retail value of $5,000.00; or
one (1) cash grand prize of $5,000.00.
Gift Cards must be accepted as awarded, may not be sold, transferred and are not convertible to cash. Limit of one (1) gift card per person. An entrant’s odds of winning depend on the number of eligible entries received. TOTAL APPROXIMATE VALUE OF ALL PRIZES = $10,000.00 CAD.
- Contest Entry: No purchase necessary to enter the Contest. There is a limit of one (1) entry per person. Participants can enter the Contest in-person at one of nine (9) pop-up events or online at www.downtownwinnipegbiz.com. To enter the Contest, entrants must follow the instructions given on the BIZ website, including:
Video Entry: Record a video (up to 1 minute). Accepted formats: MP4 or MOV; or
Written Entry: Share a story (up to 250 words). Accepted formats: Word Doc or PDF;
(collectively, the “Submissions”).
- Submissions: All Submissions must be original and must not include any third party’s proprietary content. The BIZ may use its sole discretion to:
disqualify any entrant who uses third-party proprietary content, uses generative artificial intelligence tools to create a Submission, or any portion of a Submission, or violates any other General Contest Rules;
edit any Submission to blur out any trademarks or to remove any copyrighted content, including but not limited to, music or video clips; or
disqualify any Submission that involves anything illegal, defamatory or harmful.
All Submissions become the property of the BIZ, and none will be returned. By participating in the Contest, the entrants hereby waive all non-assignable rights including, without limitation, moral rights, in the Submission in favour of the BIZ and agree to release, indemnify, discharge and hold harmless the BIZ from any claim or liability arising from or related to the Submission; and entrants consent to the publication and/or use, in any medium, of the Submission by the BIZ, in its sole discretion.
- Prize Draw:
(a) Gift Card Draw: During the Contest Period, gift cards will be given out at random, and the sole discretion of the BIZ, at all nine (9) pop-up events, until no gift cards remain.
(b) Grand Prize Draw: A random draw for the cash grand prize of $5,000.00 will take place by the BIZ on Thursday, Oct. 31, 2024. The potential prize winner will be contacted using the contact information provided at the time of entry. In the event a potential prize winner cannot be contacted within three (3) business days after the draw, or if the General Contest Rules are not adhered to by the potential prize winner, the potential prize winner will be disqualified and will forfeit all rights to the applicable prize. A new potential prize winner will be selected.
- Awarding of Prize(s): The potential winners must correctly answer a mathematical skill testing question to be administered via telephone or email and complete, sign and return a Statement of Compliance, Release and Indemnity Agreement. All prizes must be picked up in person at the BIZ’s office. Proof of identification must be provided upon request. All entrants and potential prize winners must sign a release and indemnity form.
- Privacy: The BIZ respects your right to privacy. Personal information collected to administer the Contest is not sold, rented, or loaned to any third parties. The BIZ will handle your personal information in accordance with its privacy policies and practices, which can be accessed on its website here: https://downtownwinnipegbiz.com/privacy-policy/, and in accordance with applicable laws. By making a Submission, you consent to the collection use and disclosure of your personal information for the purposes stated herein. By participating in the Contest, entrants consent to the use of their name (first and last) and image (as it appears in a Video Entry), all as may be edited or otherwise modified by the BIZ in the BIZ’s sole discretion, for the administration of this Contest or any publicity carried out by the BIZ, without further notice or compensation.
- Release and Indemnification: The winners must sign the BIZ’s Winner Release to: (i) confirm compliance with the General Contest Rules; (ii) agree to accept the prize as awarded; (iii) release, discharge and hold harmless the BIZ, its departments and agencies, parents, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, board members, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (the “Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, suit, debt, covenant, contract, use or misuse of a prize or any travel related thereto, the use of any Submission by the BIZ including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or any prize, liability for physical injury, death, or property damage which the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of any prize as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by an entrant with any of the General Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize and the use of the Submission by the BIZ.
- Disclaimer: The BIZ is not responsible for: (i) incorrect or inaccurate Submission information which may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries which fail to fully comply with these General Contest Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected Submissions; (iv) injury or damage to the entrant’s computer or to any other individual’s computer related to or resulting from participating in, or downloading any material relating to the Contest or accepting a prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize, including any travel related thereto and the use of the Submission by the BIZ; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer “hackers” or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner.
- Intellectual Property: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans, and representations are owned by the BIZ. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of the BIZ is strictly prohibited. The BIZ’s marketing or other partners, if any, shall also have access to and rights to reproduce, copy or otherwise use any materials generated by this Contest or any Submissions or materials generated by entrants.
- Governing Law: These General Contest Rules are governed by and construed in accordance with the laws of the Province of Manitoba and federal laws of Canada applicable therein, without regard to conflict of laws principles that would require the application of the laws of another jurisdiction. Any disputes relating to or arising from these General Contest Rules shall be brought and resolved solely and exclusively in the Province of Manitoba. All entrants agree that the courts of Winnipeg, Manitoba shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these General Contest Rules.
- General Terms: Subject to applicable law, the BIZ reserves the right, in its sole discretion and for any reason, to cancel, terminate, modify the General Contest Rules or administration of the Contest, or suspend this Contest in whole or in part without prior notice and with no obligation or liability. In the BIZ’s sole discretion, a Prize Winner may be selected by randomly drawing from among all valid entries received up to the time of cancellation, termination, or suspension.
