DETERMINING MARRIAGE CASE TYPE

Different types of marriage case procedures exist since there are different sources of nullity. This questionnaire is designed to address the possible marital situations you will encounter and help you determine the proper case type.
SECTION 1 - DEFECT/LACK OF FORM

This marriage involved at least one baptized Catholic and:
1. This marriage was celebrated in front of a Catholic Priest or Deacon?

2. If the marriage was celebrated in another religious Church, a dispensation from canonical form was granted or the marriage was validated (blessed) by the Catholic Church?

SECTION 2 - LIGAMEN (PRIOR MARRIAGE)

Each moment of consent is considered valid by the Catholic Church. Once a presumably valid marriage is entered, one is considered incapable of entering a subsequent valid marriage while his/her previous spouse still lives without first obtaining an annulment. In this marriage:
1. Was either person in this marriage, married before?

SECTION 3 - PAULINE PRIVILEGE

This would apply when both parties in the marriage were unbaptized at the time they married and remained unbaptized throughout the marriage. In this marriage:
1. Were both parties to the marriage unbaptized and remained so for the entire marriage?

2. Is it true that there is no hope that the couple will reconcile?

3. Does the Petitioner wish to be validly baptized, or has the Petitioner been validly baptized since the divorce?
