  • DETERMINING MARRIAGE CASE TYPE

    Different types of marriage case procedures exist since there are different sources of nullity. This questionnaire is designed to address the possible marital situations you will encounter and help you determine the proper case type.
  • SECTION 1 - DEFECT/LACK OF FORM

    This marriage involved at least one baptized Catholic and:
  • 1. This marriage was celebrated in front of a Catholic Priest or Deacon?
  • 2. If the marriage was celebrated in another religious Church, a dispensation from canonical form was granted or the marriage was validated (blessed) by the Catholic Church?
  • 3. Were the two witnesses present at the marriage?
  • 5. Did the Priest, Deacon, or Religious Minister ask for and receive consent (I do)from each of the spouses?
  • 6. Were the vows spoken the traditional vows (not written by the couple)?
  • IF ANY QUESTION WAS ANSWERED WITH NO -

  • SECTION 2 - LIGAMEN (PRIOR MARRIAGE)

    Each moment of consent is considered valid by the Catholic Church. Once a presumably valid marriage is entered, one is considered incapable of entering a subsequent valid marriage while his/her previous spouse still lives without first obtaining an annulment. In this marriage:
  • 1. Was either person in this marriage, married before?
  • 2. If either person was married before, is their previous spouse still alive?
  • 3. Did the previously married person, enter this marriage without first getting an annulment from the Catholic Church of their previous marriage?

  • SECTION 3 - PAULINE PRIVILEGE

    This would apply when both parties in the marriage were unbaptized at the time they married and remained unbaptized throughout the marriage. In this marriage:
  • 1. Were both parties to the marriage unbaptized and remained so for the entire marriage?
  • 2. Is it true that there is no hope that the couple will reconcile?
  • 3. Does the Petitioner wish to be validly baptized, or has the Petitioner been validly baptized since the divorce?
  • 4. Is it true that the Petitioner is enrolled in classes to become a Catholic, or wishes to marry in the Catholic Church?

    Once you have collected all of the documents and the application please make an appointment to speak with your pastor, deacon, or nullity minister.
