Talent Release Form (the "Release")

 

I authorize Festool USA LLC, Festool Canada Inc., and Festool GmbH,  along with their related and affiliated companies (collectively, "Festool"), to use and publish any photographs or video footage of me, or in which I may be included (collectively, the “Materials”), for advertising, promotional, editorial, or other business purposes, in any medium or format, without restriction or compensation. Festool has full ownership of the Materials and may alter or adapt them as needed.

 

I understand that I am to receive no compensation for this work.  I grant Festool a worldwide, perpetual, royalty-free, non-exclusive license to use my name, likeness, and biographical information for publicity and promotional purposes. I waive any rights to inspect or approve the use of the Materials or the specific applications of my likeness, and I waive all moral rights, rights of publicity, and privacy claims in connection with this use.

 

I understand and agree that my personal information may be collected and stored by Festool and may be shared with affiliates, successors, assigns, and authorized third parties acting under Festool’s authority. I acknowledge that my information may be processed or stored in jurisdictions outside my home country and may be subject to local laws.

 

I understand that the use of my personal information is subject to the Terms of Use and Privacy Policy applicable to my country of residence.

By signing this Release, I confirm that I am at least the age of majority in my jurisdiction, have no existing agreements that would prevent me from entering into this Release, and agree to these terms.

 

In the U.S., this Release shall be governed by and construed in accordance with the laws of the State of Delaware without regard to its conflicts of laws principles.

J'autorise Festool USA LLC, Festool Canada Inc. et Festool GmbH, ainsi que leurs sociétés apparentées et affiliées (collectivement, « Festool »), à utiliser et à publier toute photographie ou séquence vidéo de moi, ou dans laquelle je pourrais figurer (collectivement, les « Matériels »), à des fins publicitaires, promotionnelles, éditoriales ou à d'autres fins commerciales, sur tout support ou dans tout format, sans restriction ni compensation. Festool a la pleine propriété du matériel et peut le modifier ou l'adapter si nécessaire.

 

Je comprends que je ne recevrai aucune rémunération pour ce travail. J'accorde à Festool une licence mondiale, perpétuelle, libre de redevances et non exclusive pour utiliser mon nom, mon image et mes informations biographiques à des fins publicitaires et promotionnelles. Je renonce à tout droit d'inspecter ou d'approuver l'utilisation du matériel ou les applications spécifiques de mon image, et je renonce à tout droit moral, droit de publicité et droit à la vie privée en rapport avec cette utilisation.

 

Je comprends et j'accepte que mes informations personnelles puissent être collectées et stockées par Festool et qu'elles puissent être partagées avec des sociétés affiliées, des successeurs, des ayants droit et des tiers autorisés agissant sous l'autorité de Festool. Je reconnais que mes informations peuvent être traitées ou stockées dans des juridictions situées en dehors de mon pays d'origine et qu'elles peuvent être soumises aux lois locales.

 

Je comprends que l'utilisation de mes informations personnelles est soumise aux conditions d'utilisation et à la politique de confidentialité applicables dans mon pays de résidence.

 En signant la présente décharge, je confirme que j'ai au moins l'âge de la majorité dans ma juridiction, que je n'ai pas d'accords existants qui m'empêcheraient de conclure la présente décharge et que j'accepte ces conditions.

 

Au Canada, la présente décharge est régie et interprétée conformément aux lois applicables de la province de l'Ontario et aux lois fédérales du Canada qui s'y appliquent.
