I. Purpose of the Mutual Goals
The purpose of this memorandum is to ensure that all participating parties understand the terms, eligibility requirements and parameters of the Circular Transportation Network.
II. Parties’ Roles and Responsibilities
Generator:
- Sign up for the program and agree to the Mutual Goals.
- Aggregate one or multiple materials listed on CEDC’s list of accepted materials.
- Source-separate all materials desired for pick up.
- Material minimums must be met to be eligible for pick up. Depending on the material, there will be some minimum requirements. Minimum amounts of material consist of full gaylords, super sacks or bales.
- Assure that materials are clean and free of contamination including, but not limited to, hazardous waste/materials, chemicals or pesticides. Loads with more than 5% contamination will be rejected.
- When ready to schedule a pickup, submit a pick-up request form found on the CEDC website. This will require photos of the material and estimated weights.
- The pick-up request form and accompanying photos will be shared with end-market entities for qualification and approval. Note that submitting a form does not guarantee that CTN will pick up a generator’s material; all material must be qualified by an end-market entity prior to approval.
- If the material is approved, work with the CTN team to schedule pick up.
- At the time of pick up, materials must be on pallets either in gaylords, super sacks, and or bales.
- Materials must be ready and in an accessible location on the designated collection day.
- Designate a staff member to meet the truck driver and to assist with the pick up.
- Generators will not pay for material hauling, nor will they be paid for their material.
- At the time of pick up, if the materials differ from what was approved, materials will be rejected and a fee may apply to cover the round trip cost of transportation from the designated route to the generator’s location.
Circular Transportation Network (CTN):
- CTN staff will vet the material pick-up request form and will share with end-market entities.
- CTN staff will acknowledge receipt of a material pick-up request form and initially respond within 5 business days.
- If a material is not approved, CTN staff will communicate with the contact provided on the form to explain why the material was rejected.
- If a material is approved, CTN staff will coordinate with the contact to schedule a pick up.
- All routes run at varying intervals; CTN staff will act in good faith within these logistical parameters to schedule material pick ups in the timeliest manner possible.
- CTN will haul the material at no expense and will not pay generators for material.
- CTN and the CEDC have the right to discontinue service if a generator provides unacceptable or contaminated material or if the guidelines are not followed.
- Circular Transportation Network is a pilot program. CTN will make the best effort possible to pick up materials from approved sites. However, CTN cannot guarantee material pick-up due to factors beyond its control or a discontinuation of the program.
III. Waiver and Release from Liability
This document, as signed below, authorizes Front Range Transload, LLC to enter the property address submitted in this form for the purpose of picking up previously specified materials. At no time will Front Range Transload, its agents, employees, or successors be held liable for any damages to property, personal injury or financial loss resulting from the collection and transporting of materials, equipment and waste.
IV. Term and Amendment
This agreement shall be in effect from the date of acceptance by both parties and indefinitely for the duration of the Circular Transportation Network project. Upon conclusion of the project, this agreement will be null and void. This agreement represents the entire understanding of both parties with respect to this partnership.
