  • Inner Warrior Awakened – Terms and Conditions

    1. Introduction Inner Warrior Awakened is committed to providing inclusive and empowering fitness programs for NDIS participants of all ability levels. These Terms and Conditions outline the rights and responsibilities of participants engaging in our services under the National Disability Insurance Scheme (NDIS).

    2. Participant Eligibility To participate in Inner Warrior Awakened’s NDIS-aligned programs, individuals must have a valid NDIS plan with appropriate funding allocated to relevant services such as Improved Daily Living, Increased Social and Community Participation, or Capacity Building – Health and Wellbeing.

    3. Service Agreement By engaging with Inner Warrior Awakened, the participant (or their guardian/representative) agrees to the terms outlined in this document. Services will be delivered in accordance with the participant’s NDIS plan goals and funding capacity.

    4. Bookings and Scheduling

    Sessions must be booked in advance.
    Availability is subject to change and will be communicated as early as possible.
    Group classes and one-on-one personal training sessions will run as scheduled unless otherwise advised.


    5. Cancellation Policy

    A minimum of 7 days’ notice is required for the cancellation of any class or personal training session.
    Cancellations with less than 7 days’ notice may result in full session fees being charged unless exceptional circumstances apply.
    In the case of an emergency or unforeseen situation, participants should notify Inner Warrior Awakened as soon as possible.


    6. Fees and Payments

    Fees for services are aligned with NDIS pricing arrangements and are subject to changes in the NDIS Price Guide.
    Participants will be invoiced based on services delivered, and payments must be made in accordance with their NDIS plan funding structure.
    Additional costs (if applicable) will be discussed and agreed upon before service commencement.


    7. Health and Safety

    Participants must disclose all relevant medical conditions and any support requirements before commencing sessions.
    Inner Warrior Awakened follows strict safety protocols, and participants must adhere to provided safety guidelines.
    In the event of a medical emergency, emergency contacts listed in the onboarding questionnaire will be notified.


    8. Participant Responsibilities

    Participants are expected to arrive on time and be prepared for sessions.
    Any changes to a participant’s health status, medication, or support needs should be communicated promptly.
    Participants should respect trainers, staff, and fellow participants to maintain a supportive and inclusive environment.


    9. Privacy and Confidentiality

    All participant information is handled in accordance with privacy laws and NDIS requirements.
    Information provided in the onboarding questionnaire will be used solely for service delivery and support planning.


    10. Feedback and Complaints

    Participants are encouraged to provide feedback on services to help improve the program.
    Complaints can be directed to Inner Warrior Awakened management, and if necessary, escalated to the NDIS Commission.


    11. Amendments to Terms and Conditions Inner Warrior Awakened reserves the right to modify these Terms and Conditions to align with NDIS policy updates and operational requirements. Participants will be informed of any significant changes in advance.

    12. Agreement Acceptance By engaging in Inner Warrior Awakened’s NDIS-aligned services, participants and/or their guardians acknowledge and agree to these Terms and Conditions.

     

  • 8. Review/Notification

    8.1. The parties agree to use their best endeavors to conduct regular review of this Agreement, or as required due to the Organization’s operational reasons. 

    8.2. The Participants agrees to notify the Organization within 14 days of any of the following changes taking effect: 

    a) The Participant’s NDIS Plan is suspended or cancelled; 

    b) The Participant’s contact details change;

    c) If applicable, the Participant representative’s contact details change;

    d) If applicable, its “Authority to act on behalf of the Participant” is revoked, changed or expires; or

    e) There is a change to the manner or details of the person/organization who will pay invoices for Supports.

    9. Consent

    9.1. The Participant hereby gives consent for the Organization to create and/or approve service bookings for and on behalf of the Participant through the MyPlace Portal in accordance with this Agreement (including the Schedule of Supports).

  • Inner Warrior Awakened – NDIS Payment Terms

    1. Payment Structure Inner Warrior Awakened follows a structured billing process aligned with NDIS guidelines. Billing will occur on a monthly basis in arrears, and invoices will be issued to the nominated responsible party as specified in the participant’s NDIS plan.

    2. Invoicing Process

    Invoices will be generated at the end of each calendar month for services provided during that period.
    The invoice will be sent to the nominated party responsible for payment, which may include the participant, a plan nominee, the National Disability Insurance Agency (NDIA), or a registered plan management provider.
    Payment must be made in accordance with the payment terms outlined on the invoice.
    3. Payment Responsibility The parties agree that whichever of the following clauses 3.1, 3.2, 3.3, and 3.4 applies will depend on the method of payment specified in the participant’s service agreement.

    3.1. Payment by Self-Managed Participants The participant is responsible for ensuring that payment is made in full for all invoiced services within the specified time frame. Payment details and instructions will be provided on the invoice.

    3.2. Payment by Plan Nominee If a Plan Nominee is responsible for payments, the participant agrees to ensure that the nominee processes the payment in accordance with the agreed terms. Any issues regarding non-payment must be resolved between the participant and the nominee.

    3.3. Payment by National Disability Insurance Agency (NDIA) If the participant’s funding is managed by the NDIA, Inner Warrior Awakened will submit invoices directly to the agency for payment. The participant is responsible for ensuring their NDIS plan has sufficient funding available.

    3.4. Payment by Registered Plan Management Provider If the participant has engaged a Registered Plan Management Provider, they must ensure that the provider processes payments on their behalf within the specified time frame.

    4. Late Payments and Non-Payment

    If payment is not received within the specified invoice period, Inner Warrior Awakened reserves the right to suspend services until payment is made.
    Continued non-payment may result in termination of services and potential reporting to the relevant NDIS authorities.
    5. Changes to Payment Terms Inner Warrior Awakened reserves the right to update these payment terms in alignment with NDIS policy changes and operational requirements. Any amendments will be communicated to participants in advance.

    6. Agreement Acceptance By engaging in Inner Warrior Awakened’s NDIS-aligned services, participants and/or their guardians acknowledge and agree to these Payment Terms.
