In consideration of Michigan B.A.S.S. Chapter Federation, Inc (AKA MBCF, INC.) (DBA Michigan B.A.S.S.

NATION), allowing me to participate in tournaments, I acknowledge and agree as follows:

1. I have read and understand the description of the tournament and the Official Rules of the tournament. I will obey all rules and understand that any violation may result in immediate disqualification without refund of my entry fee. I also understand that tournament officials may reject my application for any reason and in that event will refund my entry fee.

2. I understand and acknowledge that competitive fishing is a dangerous sport, the risks of which include, though not exclusively, drowning, collisions in the water, and injuries from hooks and other fishing paraphernalia. I voluntarily assume responsibility for these risks, identified and not identified, and all risk of injury or death or damage to myself, or my property or to others, including spectators and their property, arising from my participation in the tournament.

3. I hereby release, discharge, and agree to hold harmless and indemnify AKA MBCF, INC., it's officers, directors, agents and employees, the host, sponsors and tournament officials, and its partners, agents or employees, and all other persons or entities associated with the tournament from any and all liability, claims, demands, actions or rights of action which are related to, arise out of, or are in any way connected with my participation in this tournament, including specifically but not limited to the negligent acts or omissions of AKA MBCF, INC., its officers, directors, agents and employees, the host, sponsors and tournament officials, and its partners, agents or employees and all other persons or entities associated with the tournament, for any and all injury, death, illness or disease, and other damage or loss to property suffered by myself or others. In signing this document, I acknowledge and agree that if anyone is hurt or property is damaged while I am engaged in this event, I will have no right to make a claim or file a lawsuit against AKA MBCF, INC.. its officers, directors, agents or employees, the host, sponsors, officials and all other persons or entities associated with the tournament, even if they or any of them negligently caused the bodily injury or property damage.

4. Any suit brought by me against AKA MBCF, INC as a result of my participation in tournaments will be brought in the state or county court in Livingston County Mi., where the principal office of AKA MBCF, INC., is located. Should it become necessary for AKA MBCF, INC. or someone on its behalf, to incur attorney's fees and costs to enforce this agreement, or any portion thereof, I agree to pay the reasonable costs and attorney's fees thereby expended, or for which liability is incurred.

5. I have sufficient health, accident and liability insurance to cover any bodily injury or property damage incurred by myself or others as a result of my participation in this event. If I have no such insurance, I represent that I am capable of paying for any and all such expenses or liability.

6. I have no past or present medical or psychological condition that might affect my participation in the tournament in such a way as to cause harm to myself or others.

7. I give AKA MBCF, INC. permission to use my name and photograph for promotional purposes. I agree to submit to and accept the results of the polygraph test given at this event. I am currently a member in good standing of AKA MBCF, INC.

8. I hereby waive my rights of privacy or publicity with regard to the programs of the tournament in which I appear and consent to AKA MBCF, INC., and those acting under their permission or upon their authority), copyrighting, distributing, televising, publishing and using in any way the audio and visual portions of any television videotape, film and photographs pictures of me or of interviews, scenes or other sequences in which I may be included, and any reproduction thereof, anywhere at any time through any medium or media for advertising, promotion, trade, television programming or other lawful purpose whatsoever; and I shall not be entitled to receive any royalties or other compensation in connection with such use.

9. I acknowledge and agree that AKA MBCF, INC., and those acting under their permission or upon their authority) shall have the right to use my personal information to contact me with communications and other advertisements, and may provide such information to any sponsor(s) associated with AKA MBCF, INC. and said sponsor(s) may contact me with communications and other advertisements.

Safe Sports Act Policy Acknowledgement:

The Protecting Young Victims from Sexual Abuse and Safe Sport Authorization Act of 2017, or Safe Sport Act, was created in reaction to child sexual abuse found in various youth sports organizations. The Act created a standard of care affecting youth-serving organizations across the country and expanded existing mandated reporting laws to all youth sports organizations that participate in international or interstate sporting events.

While the primary focus of the Safe Sport Act is National Governing Bodies (“NGBs”), the law impacts non-NGB sports organizations of every type, in every state, and at every level of competition. As a non-NGB sports organization tournament host, MBCF, INC. is committed to providing a safe and healthy environment for young people participating in our tournaments.

To do so, MBCF, INC. has instituted the following:

1) Training for MBCF, INC. Board Members and Directors Effective [date], all MBCF, INC. Board Officers, Board Members and Directors who are in regular contact with minors will receive training on child abuse prevention. New Board Officers, Board Members and Directors with job responsibilities that will bring them into regular contact with minors will receive training during their onboarding with MBCF, INC. MBCF, INC. will conduct follow up training every three years.

2) Mandatory reporting policy. On an annual basis, MBCF, INC. requires acknowledgement of this policy by all MBCF, INC. volunteers and Boat Captains who will be in contact with minors at MBCF, INC. administered youth tournaments, which requires our volunteer and Boat Captains to report any suspicions of abuse towards a minor (physical, sexual, and/or emotional) to the appropriate law enforcement agency within 24 hours. Volunteers and Boat Captains will be required to acknowledge receipt and compliance with the policy.

3) Reasonable prevention policies. MBCF, INC. will put in place reasonable procedures to limit one on one interaction between minors participating in its tournaments and MBCF, INC. employees and volunteers.

4) Compliance Assessment. MBCF, INC. will periodically examine its training, policies and procedures to determine the effectiveness of this policy in ensuring MBCF, INC.’ objective to provide a safe and healthy environment for young athletes.

These guidelines apply to MBCF, INC; however, MBCF, INC. encourages all Adult Clubs, High and JR Clubs participating in MBCF, INC. sanctioned events and tournaments to comply with all local, state, and federal laws regarding child safety and protection as well as any requirements of the Safe Sport Act applicable to their organization.

Boater's Safety Certificate Acknowledgement:

MBN Youth Division requires that ALL Boat Captains must have a boater’s safety certificate in their possession (paper or electronically). Boater'ss Safety Certificates from States other than Michigan are also accepted
