"Confidential information" means information provided by one party to the other in written, graphic, recorded, machine readable or any other form concerning the business, clients, suppliers, finances and other areas of the other party's business or products, including, without limitation, course materials. It does not include information in the public domain other than through the default of the party disclosing the information, information required to be disclosed by any court or regulatory authority, or any information already in the possession or control of the disclosing party. CONTRACT means a legally binding agreement. COURSE MATERIALS means the information provided by Seller, Students Expressing Life through Fashion, LLC., to accompany a class/course provided as part of the product and services in hard copy, digital (recorded or live-stream) form. FEES means the fees paid by you to the Seller for the products and services. INTELLECTUAL PROPERTY RIGHTS means copyright, rights in or relating to databases, patent rights, performers' rights, designs and registered designs, trademarks, rights in or relating to confidential information and other intellectual property rights (registered or unregistered) throughout the world. ONLINE CLASS/COURSE means the delivery by us of an online class/course, inclusive of recorded or live stream media remotely, including but not limited to Skype or Zoom classes and YouTube.* This field is required.

Students Expressing Life through Fashion, LLC. offers a Fashion Design Training Program that grants you access to a comprehensive foundation in fashion design. This program includes various beginner-level fashion design topics, weekly 4-hour classes, an all-inclusive studio, and industry placement opportunities if you become eligible. You must attend classes regularly, maintain great standing, and receive Instructors' approvals to access industry placements.* This field is required.

You agree to pay your full tuition, regardless if you withdraw from the program. You understand that all payments are non-refundable and non-transferable.* This field is required.

You are expected to abide by all class, project, studio, and Students Expressing Life through Fashion, LLC. policies. You must adhere to the class schedule and are expected to be punctual. You are responsible for notifying your Instructor of any anticipated absence or tardiness. Disruptive or disrespectful behavior will not be tolerated. Make-up days for missed classes are only available upon request. To request a make-up class, you must make an appointment through your Membership Portal. Make-up classes are not guaranteed and are subject to Instructor and Academy availability and available class times.* This field is required.

You agree that Students Expressing Life through Fashion, LLC. does not owe you any compensation for the acts that you have consented to in this agreement. You further understand and agree that these materials may be kept on file and used by Students Expressing Life through Fashion, LLC. for potential future purposes and further agree to release Students Expressing Life through Fashion, LLC. from any and all liability arising from or in connection with the taking, use, publication, or dissemination of such materials.* This field is required.

You understand that sewing includes the use of machines, needles, scissors, and other tools. These activities include risks that can cause or lead to injury. There is no grace period for class. You must arrive to class on time. You will be marked late after 5 minutes. Doors will close after the 5 minute mark and you will not be allowed to enter the class. After 3 missed classes, you may be removed from the program. Tardiness and missed classes will affect your eligibility for placement opportunities.* This field is required.

There is a possibility that classes may be cancelled for whatever reasons including but not limited to, construction, inclement weather, etc. You will be notified on your online portal and via text if a class or event is delayed, canceled or postponed. Efforts will be made to make up weather-cancelled classes, but are not guaranteed. Refunds will not be offered. If the Fashion Instructor is ill for a class and a substitute is not available, a make-up class will be issued via your online portal.* This field is required.

Due to the nature of working with machinery, Students Expressing Life through Fashion, LLC. will not tolerate behavior deemed dangerous or harmful. You agree that Students Expressing Life through Fashion, LLC. may use such photographs of you for any lawful purpose, including but not limited to such purposes as publicity, illustration, advertising, and Web content.* This field is required.

An event outside our control means any act or event beyond our reasonable control, including without limitation; strikes, lock-outs, civil commotion, riots, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not), fire, explosion, epidemic, bad weather including but not limited to, storm, flood, earthquake, volcano, subsidence or other natural disaster (Acts of God). Failure of public or private telecommunications networks that are not under our control, or impossibility of the use of railways, shipping, aircraft, motor transport, or other means of public or private transport that are not under our control. Delay caused by transport disputes, failure to provide a class/course caused by death in the instructor's family, illness of the instructor, government edict or regulation. If an event outside our control takes place that affects the performance of our obligations, you will be notified via your online portal.* This field is required.

You are not authorized to copy, modify, reproduce, re-publish, sub-license, sell, upload, broadcast, post, transmit, or distribute any of the products and services. All intellectual property rights in all products and services (online and in-person classes/courses, course materials, online portal, patterns, products, the speeches made by instructors for in-person and online classes/courses, and any other products and services provided to you by Students Expressing Life through Fashion, LLC.) are, and remain, the intellectual property of Students Expressing Life through Fashion, LLC., whether adapted, written for or customized for you or not. You are not authorized to record on video or audio tape, relay by videophone or other means the in-person and online classes given. You are not authorized to use the Course Materials in the provision of any other course or training whether given by Students Expressing Life through Fashion, LLC. or any third-party instructor; remove any copyright or other notice of Students Expressing Life through Fashion, LLC. on the products and services; modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the products and services.* This field is required.

In consideration of the fees paid by you, Students Expressing Life through Fashion grants you a limited, non-transferable, non-exclusive license to use the course materials and complete in-person and online classes. The license Students Expressing Life through Fashion, LLC. provide allows you individual access to in-person and online classes, patterns, and online portals. You may not share the class materials, your passcode to the online portal, your class binder, and the pattern with another party, whether for profit or not. You accept that you will not use the products and services for commercial, business, or resale purposes. Class projects made by you using fabrics, materials, equipment, and tools provided by Students Expressing Life through Fashion, LLC. - including but not limited to drafts/samples in muslin fabric, and final projects - are not considered intellectual property to Students Expressing Life through Fashion, LLC.* This field is required.

Any other form of request including text or email will not be accepted, unless otherwise stated. You will receive a text message from a Sew with SELF Representative informing you if your request has been approved or not. Your request must be approved via text in order to attend the makeup class.* This field is required.

You are granted access to these course materials solely for the purpose of enhancing your learning experience within Sew with SELF Academy. Utilize these PowerPoints and all course materials responsibly.* This field is required.

Students Expressing Life through Fashion, LLC. shall be entitled to terminate the terms and conditions in this Form and cease to provide you with any products and services with immediate effect in the event that you fail to pay when due your fees; act in an aggressive, bullying, offensive, threatening or harassing manner towards any instructor, employee, guest and/or executive team member of Students Expressing Life through Fashion or any other student and/or client; steal or act in fraudulent or deceitful manner towards staff, instructors, employees, students and/or clients; intentionally or recklessly damage property or the property of Students Expressing Life through Fashion or other students and/or clients; commit any criminal offence committed on the premises or where the victim is an instructor, executive team member, employee, student and/or client; are in breach of the terms and conditions in this Form.* This field is required.

This Agreement is between Students Expressing Life through Fashion and you. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise. Each of the paragraphs of these terms and conditions operates separately, unless otherwise stated. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
