2026 Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement
WARNING: READ CAREFULLY. THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS AND MAY DEPRIVE YOU OF THE RIGHT TO SUE GEAR WEST AND/OR OTHER PARTIES AFFILIATED WITH THE EVENT. DO NOT SIGN THIS AGREEMENT UNLESS YOU HAVE READ IT IN ITS ENTIRETY. SEEK THE ADVICE OF LEGAL COUNSEL IF YOU ARE UNSURE OF ITS EFFECT.
In consideration of Gear West Ski and Bike, Inc., its directors, owners, staff, volunteers, sponsors, and other event organizers allowing me to participate in the Grave to Gravel event (the “Event”), I, for myself and on behalf of my spouse, children, parents, guardians, heirs, next of kin, and any legal and personal representatives, executors, administrators, successors, and assigns, hereby agree to the following terms of this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement (the “Agreement”):
1. Participant Health and Fitness
I represent that:
(a) I am in good health and in proper physical condition to participate in the Event; and
(b) I am not under the influence of alcohol or any illicit, prescription, or other substance that would impair my ability to safely participate in the Event.
I understand and agree that it is my sole responsibility to determine whether I am sufficiently fit, healthy, and prepared to participate in the Event.
2. Assumption of Risk
I understand and acknowledge the physical and mental demands associated with cycling and participation in a gravel cycling event. I understand that cycling is inherently dangerous and that participation may involve significant risks.
These risks include, but are not limited to:
serious bodily injury, permanent disability, paralysis, or death;
loss of or damage to personal property;
falls, crashes, or collisions with other participants, spectators, vehicles, animals, or natural or manmade objects;
vehicle traffic and riding on roads that may remain open to normal traffic;
gravel, dirt, pavement, loose surfaces, potholes, washboards, debris, uneven terrain, water crossings, and other road or trail hazards;
changing or adverse weather conditions;
heat, cold, wind, rain, storms, or other environmental conditions;
equipment failure or malfunction;
inadequate or unavailable safety measures;
participants of varying skill and experience levels;
illness, dehydration, fatigue, or other medical conditions;
actions or inactions of other participants, volunteers, spectators, motorists, property owners, or members of the public;
situations beyond the immediate control of the Event Organizers; and
other known or unknown risks that may not be readily foreseeable.
I understand that these risks may be caused in whole or in part by my own actions or inactions, the actions or inactions of others participating in or associated with the Event, or the acts, omissions, or negligence of the Released Parties identified below.
I knowingly and voluntarily assume all such risks and accept responsibility for any damages, liabilities, losses, injuries, or expenses that I may incur as a result of my participation in the Event.
3. Photo, Video, and Media Release
I consent to participation in interviews and to the taking of photographs, video, audio recordings, and other media depicting me in connection with the Event (collectively, the “Products”) by Gear West Ski and Bike, Inc. and its authorized agents, employees, contractors, sponsors, and representatives.
I grant Gear West Ski and Bike, Inc. the right to edit, reproduce, publish, distribute, display, and otherwise use or reuse the Products for promotional, marketing, informational, and other lawful purposes, including use in print, online, on social media, and in other forms of media.
I waive any right to inspect or approve the finished Products or any materials in which they may appear, and I waive any right to royalties or other compensation arising from or related to their use.
4. Release of Liability and Covenant Not to Sue
I hereby release, waive, discharge, and covenant not to sue, and further agree to indemnify, defend, and hold harmless:
Gear West Ski and Bike, Inc.; the Event organizers and promoters; Event directors; sponsors; advertisers; host communities; local organizing committees; venues; property owners upon whose property the Event takes place; law enforcement agencies; municipalities and other public entities providing support for the Event; volunteers; contractors; and each of their respective parent, subsidiary, or affiliated companies, officers, directors, partners, shareholders, members, agents, employees, representatives, and volunteers
(individually and collectively, the “Released Parties”).
This release applies to any liability, claim, demand, cause of action, damage, loss, or expense, including court costs and reasonable attorneys’ fees, arising out of, resulting from, or relating to my participation in the Event, including claims for liability caused in whole or in part by the negligence of any of the Released Parties, to the fullest extent permitted by law.
I further agree that if I, or anyone acting on my behalf, makes a claim against any of the Released Parties despite this Agreement, I will indemnify, defend, and hold harmless the Released Parties from any liability, claim, damage, loss, or expense incurred as a result of that claim.
5. Acknowledgment and Acceptance
I acknowledge that I have carefully read this Agreement and fully understand its terms and conditions.
I understand that by signing this Agreement I am giving up substantial legal rights, including the right to bring certain claims against the Released Parties.
I acknowledge that I am signing this Agreement freely and voluntarily, without inducement, assurance, or guarantee, and I intend my signature to constitute my complete and unconditional acceptance of its terms.
This Agreement represents the complete understanding between the parties regarding the matters addressed herein, and no oral representations, statements, or inducements have been made apart from this Agreement.
If any provision of this Agreement is found to be unlawful, void, or otherwise unenforceable, that provision shall be considered severable from the Agreement and shall not affect the validity or enforceability of the remaining provisions.
