FOLLOWING CREATION FARM WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

1.   In consideration for being allowed to participate in the Rainbow Week hike, puzzles, and games at Following Creation Farm, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Following Creation Farm, its officers, agents, or employees from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or anyone in my group while participating in these activities, whether caused by the negligence of Following Creation Farm or otherwise, to the fullest extent allowed by law.

2.   I acknowledge the risks and hazards associated with the activities at Following Creation Farm’s Rainbow Week, including the risk of injury or death. I voluntarily choose to participate, fully aware of the potential dangers to myself and my group. I understand that participation is not required by Following Creation Farm. I assume full responsibility for any risks of loss, property damage, or injury, including death, that may occur as a result of participating in these activities, whether caused by the negligence of Following Creation Farm or otherwise, to the fullest extent allowed by law. This includes, but is not limited to, risks associated with wildlife encounters and the physical demands of hiking.

3.   I agree to indemnify and hold harmless Following Creation Farm from any loss, liability, damage, or costs, including court costs and attorneys’ fees, that may arise due to my participation in these activities, whether caused by the negligence of Following Creation Farm or otherwise, to the fullest extent allowed by law.

4.   This Waiver and Hold Harmless Agreement is binding upon my family members, spouse, heirs, assigns, and personal representatives. It shall be construed in accordance with the laws of the State of Alabama. Any legal action must be filed in Alabama, and any portion of this document deemed unlawful or unenforceable is severable and shall not affect the enforceability of the remaining provisions.

5.   By signing this waiver, I agree to follow all instructions and directions provided by Following Creation Farm and its staff, whether given verbally or digitally. If I fail to comply, I understand that I may forfeit my payment, be removed from the experience without a refund, and potentially be banned from future experiences at Following Creation Farm’s discretion.

6.   I agree to reimburse Following Creation Farm for any damages caused by myself, my group, or any minors in my care. This includes costs for materials, labor, time for repairs, and any lost sales due to damaged property. Reimbursement will be charged to the person who made the booking, and it is their responsibility to settle any charges with the individual(s) causing the damage.

7.   By signing this waiver and participating in the activities, I grant Following Creation Farm permission to use my likeness in any format for promotional and marketing purposes, including social media and other media formats.


IN SIGNING THIS AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by same.
