Participant acknowledges that as a visitor, volunteer or participant in the Healing Hooves program (collectively the "Activity") at the Pine Hill Ranch & Equestrian Center (''The Pine Hill Ranch"), that Participant may be exposed to certain risks. Participant assumes all of the risks associated with participation in the Activity and understands and assumes the risks of doing so. In participating in the Activity, Participant understands the potential dangers that he or she could incur in mounting, riding, walking, boarding, feeding, use of horse barn, paddock, trails, and being near horse(s) attended, unattended, or otherwise, including but not limited to any interaction with all horses including during helper and non-lesson time. Participant recognizes that equine professional(s) providing services at The Pine Hill Ranch site havemade reasonable and prudent efforts to determine Participant's ability to engage in the equine activity. As a condition for participating in the Activity at The Pine Hill Ranch, Participant and his or her heirs hereby release and forever discharge The Pine Hill Ranch & Equestrian Center, LLC and Healing Hooves, Inc., their agents, directors, officers, owners (including Robert Mullenax), employees and volunteers, as well as its affiliated companies (including Congo Real Estate, LLC) from all claims, demands, damages, actions, or liability of any nature whatsoever, known or unknown, for any personal injury, death, or property damage which may be incurred by Participant during participation in any Activity at The Pine Hill Ranch. Participant participates in the Activity with full knowledge of the risks involved and hereby agrees to assume all risk of loss or injury. Participant further agrees to indemnify and hold harmless The Pine Hill Ranch and Healing Hooves, Inc., from any and all claims, demands, damages, actions, causes of action, and liabilities which may result from, arise out of, or relate in any way to Participant's participation in an Activity at The Pine Hill Ranch.
WARNING: Under Arkansas Law, an equine activity sponsor is not liable for an injury to, or the death of, a participant in equine activities resulting for the inherent risk of equine activities.
