IN CONSIDERATION for being permitted to participate in the Macchi workshop (“Workshop”), I, for myself, personal representatives, heirs, assigns and next of kin:

HEREBY acknowledge and agree that the activities involved in the Workshop have inherent risks and dangers for anyone, which cannot be eliminated. I understand that these risks, hazards and dangers include without limitation: (1) potential allergic reactions or skin irritation due to the fragrance oils and/or materials exposed during or after the candle event, (2) melted soy wax at high temperatures; (3) equipment failure; and (4) acts of fellow participants in the Workshop.

HEREBY acknowledge and agree that I may be engaging in activities that involve the risk of serious personal injury, illness, permanent disability, dismemberment, and death, and that such participation may also involve the risk of severe economic and property loss and damage. I understand that these risks may result from the actions, negligence, misuse and failure to act of myself and others and from the condition of any property, facilities or equipment used. I also understand that there may be risks involved which are not known to me or to the Releasees (defined below) and may not be foreseen or reasonably foreseeable by any of us at this time or at the time of the Workshop. Despite knowing these risks, I hereby knowingly, willingly and voluntarily elect to participate in the Workshop and agree to assume all related risks, including without limitation those referenced above, and accept sole and absolute personal responsibility for any injury of any kind or nature that I or my property may suffer arising out of or in connection with my participation in the Workshop. 

HEREBY RELEASE, WAIVE, HOLD HARMLESS, COVENANT NOT TO SUE AND DISCHARGE Macchi LLC and their respective officers, employees, partners, representatives, and agents (collectively, the “Releasees”) and the building owner the Workshop is held in, from any and all damages, losses, claims, actions, suits, proceedings, liabilities, injuries (including but not limited to, personal injury, disability, paralysis, dismemberment and death), illness, economic or property loss or damage, costs, fees and/or expenses (including attorneys’ fees), arising out of or relating to the Workshop and/or my participation in the Workshop and/or any off-premises injuries, whether caused or contributed to by the negligent acts, omissions or willful misconduct of the Releasees and the building owner the Workshop is held in. 

HEREBY acknowledge and agree that I am in good physical condition and know of no medical condition or health reasons as to why I should not participate in the Workshop. I acknowledge and agree that I must obtain my own life, liability and health insurance to protect me against personal injuries. 

HEREBY acknowledge and agree that I am not under the influence of drugs and alcohol and will not use drugs or alcohol while participating in the Workshop. I acknowledge and agree that should I choose to drink alcohol prior to or during this Workshop, that I am doing so knowingly, freely and voluntarily with full awareness of the risks involved while under the influence of drugs or alcohol. 

HEREBY grant Macchi the absolute and irrevocable right and unrestricted permission to use and reuse photos, videos, and other media taken during the Workshop or made by or on behalf of Macchi for the purpose of advertising, marketing, publicizing, and promoting in any media, for an unlimited period of time following the execution of this Agreement. 

By signing below, I certify that I have read this document and that I fully understand its content. I am legally over the age of eighteen (18) and I am legally capable of executing this Agreement. I am aware that this is an assumption of risk and release of liability and I sign it of my own free will.
