This Tenancy Agreement (the “Agreement”) is made pursuant to Section 19A of the UK Housing Act 1988 as amended (the “Act”). 

WHEREAS the Tenant wishes to take the Property on lease from the Landlord, and the Landlord has agreed to let out the Property on lease to the Tenant on the terms and conditions contained herein.

LANDLORD’S REPRESENTATIONS AND COVENANTS
The Landlord hereby represents and covenants to the Tenant as follows: 

The Landlord shall not develop any part of the property in which the Property is located in such a way that such development interferes with the operation of the Tenant or the use of the Property by the Tenant. 

The Landlord agrees to insure the Property, and keep it insured during the Term of this Agreement and any time the Tenant remain in occupation of the Property. The risks that will be covered are those normally found in a comprehensive insurance policy. 

The Landlord shall keep in repair the structure and exterior of the Property (including drains, gutters, external pipes and windows) and keep in repair and proper working condition the service installations and heating and hot water system in the Property. 

The Landlord shall keep in repair and proper working order any furniture, fixtures, fittings and appliances which are provided with the Property, except where the damage or need for repair is a result of the Tenant’s negligence. 

The Landlord agrees to return the Deposit, provided, however, after making such deductions from the Deposit as are reasonable if the Landlord suffers any loss as a result of Tenant’s breach of the terms of this Agreement.

TENANT’S REPRESENTATIONS AND COVENANTS
The Tenant hereby represents and covenants as follows: 

The Tenant shall during the Term take reasonable care of the Property, maintain the Property in good order and condition. 

The Tenant shall not make any structural changes or additions or alterations to the Property or redecorate the Property without the Landlord’s prior written permission which must not be unreasonably withheld. 

The Tenant shall not under any circumstances assign, re-let, underlet or sublet the Premises, or any portion thereof, to any party except with the prior written permission of the Landlord. 

The Tenant must notify the Landlord as soon as reasonably possible about any such repairs that are needed to the Property. 

The Tenant shall permit the Landlord and/or the Landlord’s representatives and/or agents to inspect the Property at any reasonable time with reasonable notice.

Termination Of This Rental Agreement
The Landlord may terminate this Agreement by giving Tenant at least sixty (60) days advance notice in writing pursuant to Section 21 of the Housing Act 1988, specifying a date on which possession shall be required. 

If the Tenant breaches any of its obligations hereunder, the Landlord shall forthwith notify the Tenant of such default requiring the Tenant to cure such default within a period of fourteen (14) days from the date of such notice. If the Tenant fails to cure such default within such cure period of fourteen (14) days, the Landlord shall be entitled to terminate this Agreement by written notice. With effect from the date of such termination, the Tenant shall be liable to immediate eviction therefrom. 

The Tenant may terminate this Agreement by giving at least one (1) month notice in writing that the Tenant shall provide upon possession of the Property on a date specified in the notice.

Additional Notes
If any term of this Agreement cannot be enforced or is found to be unjustified, it shall not affect the other terms of the Agreement. 

This Agreement shall be governed by and construed in accordance with the Law of England and Wales.
