Agreement

NATURE OF MEMBERSHIP
The membership entitles the Member to assigned [Fall Sports Day camp/dance team/acrobatics/karate] classes according to the current schedule at NOLA CHAMPION LLC. The membership does not grant the Member any ownership or rights in NOLA CHAMPION LLC, its management, property, or operation.

 

 Costs:

- One Day Registration - $60 

A camper’s place at camp is not secured until tuition for the week attending is paid in full.

Cancellations must be completed no later than one week bewore first day camp . Your payment will be credited towards the next available Champions' day camp . No credits will be issued for cancellations made less than one week in advance.

A late fee of $1 per minute, per child will be charged of any children picked up after 3 pm.

MINOR CHILD MEMBERSHIP

Any Member who is under the age of 18 must have a parent or legal guardian sign and guarantee this Agreement. The signer, along with the Member, agrees to be bound by all the terms and conditions of the Agreement, including payment of all fees. The Parent(s) and/or legal guardian(s) do/does hereby approve and execute(s) this Agreement on behalf of the Member.

PERSONAL CONDUCT
The Member agrees to observe and obey all posted rules and warnings, and further agrees to follow any oral instructions or directions given by NOLA CHAMPION LLC AND ANY OF ITS ADMINISTRATORS, MANAGERS, OWNERS, DIRECTORS, AGENTS, OFFICERS, VOLUNTEERS, EMPLOYEES, REPRESENTATIVES, SUBSIDIARIES, AFFILIATES, ASSOCIATES, SUCCESSORS OR ASSIGNS (collectively, the “NOLA CHAMPION Parties”). The Member is required to conduct themselves in a manner that permanently protects the safety of others. Each Member accepts sole responsibility for their own conduct and actions while participating in the activities and the condition and adequacy of any equipment that they might own and supply in conjunction with those activities. The Member is aware that portions of the activities may not be guided or supervised at all times by NOLA CHAMPION LLC and/or NOLA CHAMPION Parties. The Member agrees to pay for all damages to the facilities of NOLA CHAMPION LLC caused by Member’s or Member’s family’s and/or Member’s guests’ negligent, reckless, or willful actions.

CLASSES
The Member understands that scheduling and content of classes and programs, furnishing of facilities, and provision of instructors to teach and supervise classes and practice sessions are at the sole and absolute discretion of NOLA CHAMPION LLC. The Member understands that NOLA CHAMPION LLC reserves the right to change the schedule and place of training. NOLA CHAMPION LLC reserves the right to cancel or reschedule classes due to inclement weather, emergencies, or other concerns.

NOTICE TO MEMBERS
Do not sign this Agreement before reading its entirety. The Member is entitled to a copy of this Agreement. The Member acknowledges that he/she has been notified: (A) That this document is an Agreement and will become legally binding upon its acceptance by NOLA CHAMPION LLC; (B) of the terms and conditions of this Agreement. There are no warranties either expressed or implied which extend beyond this Agreement. If any provision of this Agreement is held to be invalid or unenforceable in whole or in part, this Agreement shall continue to be valid as to its other provisions and the remainder of the affected provision.

CONFIDENTIALITY OF AGREEMENT
The Member agrees that this Agreement and its terms are strictly confidential and shall not be disclosed to any person, firm, corporation, or other entity, orally or in writing, except as may be necessary to comply with applicable laws and regulations, court orders, or other process of law, confer with a financial advisor, tax preparer, or lawyer regarding the subject matter of this Agreement, or to enforce this Agreement. This confidentiality obligation extends to NOLA CHAMPION LLC and its representatives

COVID-19 Consent Form and Liability Waiver

"NOLA CHAMPION LLC" will endeavor to at all times reasonably and to the best of its ability follow state and local standards of conduct and has put in place reasonable preventative measures to reduce the spread of COVID-19 at its activities (including but not limited to karate/ dance classes, acrobatics, photos, recitals, live performances, competitions and in-studio/gym performances).
COVID-19 is contagious and is believed to spread mainly from person-to-person contact. "NOLA CHAMPION LLC" will make every effort to prevent symptomatic employees and dancers from entering the building. However COVID-19 has been proven to be asymptomatic in some persons. Therefore,even though such standards will be reasonably followed and reasonable measures put into place, "NOLA CHAMPION LLC" can not guarantee that you or your child(ren), guests or relatives will not become infected with COVID-19 or any other unknown virus.

Further, you understand and acknowledge that attending "NOLA CHAMPION LLC" could increase your risk and your child(ren)'s risk of contracting COVID-19. By signing this Agreement, I acknowledge the contagious nature of COVID-19 and it's variants and that my child(ren) and I may be exposed to or infected by COVID-19 by participating in activities with "NOLA CHAMPION LLC" and that such exposure or infection may result in personal injury, illness, permanent disability, and death.

I understand that the risk of becoming exposed to or infected by COVID-19 at "NOLA CHAMPION LLC"may result from the actions, omissions, or negligence of myself and others, including, but not limited to, employees, volunteers, and program participants and their families. Considering the foregoing, however, I, grant permission for myself / my children to participate in activities with "NOLA CHAMPION LLC"notwithstanding the risks associated with the COVID-19 virus and group activities.

I further agree on behalf of myself, my child(ren), my spouse, our heirs, successors, and assigns, to release, indemnify, hold harmless, and defend "NOLA CHAMPION LLC" and their members, directors, officers, employees, agents and representatives (collectively "Indemnitees") associated with any event arising from, or in any way related to, any negligent act(s) or omission(s) of any Indemnitee in relation to prevention of the spread of the COVID-19 virus. I SPECIFICALLY ACKNOWLEDGE AND AGREE THAT I AM AGREEING TO DEFEND, INDEMNIFY AND HOLD HARMLESS THE INDEMNITEES' FROM THEIR OWN NEGLIGENCE AS IT RELATES TO PROTECTION AGAINST THE COVID-19 VIRUS AND ALL VARIANTS.

Model Release

I hereby consent to the use of my/ my child(ren)'s likeness, name and voice by "NOLA CHAMPION LLC" in connection with its informational, promotional and marketing activities, including, but not limited to, use in or on photographs, electronic video, social media and web based data and audio recordings or the "NOLA CHAMPION LLC" web site, without compensation.

I HAVE READ THIS WAIVER, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS WAIVER IS HELD TO BE INVALID THE BALANCE SHALL CONTINUE IN FULL FORCE AND EFFECT. TO BE SIGNED BY PARENT/LEGAL GUARDIAN IF NAMED STUDENT/PARTICIPANT IS NOT OF LEGAL AGE (18 YEARS OLD) I AM THE PARENT AND/OR LEGAL GUARDIAN OF THE MINOR(S) LISTED BELOW AND HAVE THE AUTHORITY TO EXECUTE THIS WAIVER ON HIS/HER BEHALF.

I hereby acknowledge that I understand the nature of the Activity and believe and confirm that said minor is capable and qualified to participate in the Activity, and, on behalf of myself, my personal representative, heirs, beneficiaries, assigns, and said minor, I hereby adopt and fully incorporate the entirety of the Waiver on said minor’s account and behalf.

Consent to Electronic Signature and Enrollment

By checking the box below, you are: (1) consenting to communicate electronically with "NOLA CHAMPION LLC" with regard to enrollment and participation at "NOLA CHAMPION LLC" (2) authorizing "NOLA CHAMPION LLC" to send you notices, disclosures, and forms electronically, and agreeing that information and responses that you provide to "NOLA CHAMPION LLC" may be stored in electronic format; and (3) agreeing that your electronic signature on an electronic authorization or agreement will serve the same purpose as a written signature.
