  • Welcome to Lizzy Care! Our service is designed to make managing dementia care easier, more connected, and tailored to the unique needs of families and caregivers. Through our platform, you’ll have access to tools, resources, and expert support that help you create and manage a care plan for your loved one, communicate with a dedicated team, and stay informed on best practices for dementia care all in one place.

    • You represent and warrant that you are authorized, empowered, and otherwise responsible (whether by relationship, power of attorney, agreement, consent, or other legal right) to direct and manage the medical care of the “Care Recipient(s)”. 

      Without limitation to any provisions of the Terms, You acknowledge and agree that we reserve the right to request reasonable documentation to substantiate the relationship between You and the Care Recipient and further reserve the right to suspend the provision of Services indefinitely and/or terminate this Agreement if we have reason to believe You are not so related to the Care Recipient or otherwise do not have the proper authority to make decisions relating to the Care Recipient’s medical care. Notwithstanding the foregoing, You acknowledge that we have no duty or obligation to verify Your relationship to the Care Recipient and are entitled to rely on Your above representation without further inquiry. You agree to indemnify and hold Us harmless from any against any and all claims, damages, losses, costs, expenses, and all other liabilities arising from or relating to any untruthfulness of the above representation.

    • SERVICES PROVIDED

    • The Lizzy Care “Services” provided under this Agreement include: 

      • Lizzy Care Application Subscription: You and your family members, along with any companions involved in the caregiving process, will receive a subscription to the Lizzy Care application, which offers valuable tools and resources for managing care.
      • Setup Assistance: Our team will assist with the setup of the Lizzy Care application to ensure you and your family members can access all features smoothly.
      • Initial Needs Assessment: Our team will conduct a thorough virtual needs assessment to understand your loved one’s unique situation, challenges, and care requirements.
      • Tailored Care Plan: Based on the assessment, we will develop a detailed, specific, and tailored care plan designed to meet the individual needs of your loved one and provide the best possible support for you and your family.
      • Monthly Care Reviews: The Lizzy Care team will conduct monthly reviews of your loved one’s care and all interactions to ensure that the care plan remains effective and aligned with their needs.
      • Continual Oversight: We provide continual oversight of care needs, actively monitoring and identifying any changes that may require adjustments to the care approach.
      • Care Plan Adjustments: Based on ongoing assessments and feedback, we will recommend and implement adjustments or improvements to the care plan as your loved one’s needs progress.
      • Educational Resources: We will provide resources that offer education and guidance on supporting a person living with dementia, helping you feel informed and empowered in your caregiving journey.
    • ADDITIONAL CONCIERGE SUPPORT SERVICES

    • In addition to the core services provided under this Agreement, Lizzy Care offers optional concierge support services at a rate of $150 per hour. These services are designed to augment the Services that are already provided and included in the Agreement:

      • One-on-One Coaching: Detailed coaching on dementia caregiving strategies and techniques tailored to your specific needs.
      • Cognitive Coaching: One-on-one support for the person living with dementia, focusing on techniques and strategies for maintaining memory and executive functions to enhance quality of life and independence. This is provided virtually but can be timed to coordinate with a Companion visit.
      • Healthcare Navigation: Guidance in navigating healthcare services and systems relevant to in-home dementia care.
      • Complex Decision-Making Assistance: Support with complex decision-making regarding treatment options and care transitions.
      • Home Monitoring Technologies: Provision and assistance with the usage of home monitoring technologies and devices to enhance care.
      • Communication with Care Providers: Coordination and communication with other members of the medical and caregiving community as needed.
      • Sourcing and coordination: Assistance in identifying, sourcing, and coordinating companions and home care aides to provide personalized support for your loved one.
      • Financial guidance: Help with understanding and using insurance benefits including Medicare, Medicaid and Long Term Care Insurance policy usage.

      These additional services can be requested and scheduled based on your specific needs and are billed separately at the hourly rate specified above.

    • COMPANION SERVICES

    • At Your request Lizzy Care can also provide Companion Services. Lizzy Care will pair You with one or more Lizzy Care companions (each a “Companion”) to provide companionship and related, non-clinical services (the “Companion Services”) for the Care Recipient. Depending on Your and the Care Recipient’s needs, Companion Services can include but are not limited to: regular visits and in-person interaction between the Companion and the Care Recipient, assistance with running errands, providing regular updates on the Care Recipient’s general health and wellness on the Lizzy Care App.

      You understand that the Companion is not a professional healthcare provider, and that, in addition to all of the services that are specifically excluded under the Service Agreement, You agree that the Companion Services will not include:

      • physical, occupational, or any other kind of motor or cognitive therapy;
      • clinical assessments of the Care Recipient’s health or clinical diagnoses of any condition;
      • prescriptions to obtain or receive any kind of treatment; or
      • any other service that is required, by law, to be provided by a licensed professional.

      Additionally, You understand that the Companion Services are dependent, in part upon Your cooperation. You agree that You will:

      • inform Lizzy Care and the Companion of all known special conditions of the home or dwelling where the Companion will meet the Care Recipient and be responsible for any injuries suffered by the Care Recipient;
      • provide all relevant information reasonably requested by the Companion to improve and enhance the effectiveness of the Companion Services;
      • not request or pressure the Companion to provide any service that he or she is not qualified to provide;
      • attempt to be available by phone or in person during all scheduled visits in the event of an emergency.

      Emergencies

      If a medical emergency occurs during a Companion visit, You understand that our Companions are not trained in rendering, and will not provide, any form of emergency care. We will discuss with you and establish a plan of action in the event of a medical emergency.

      You also agree and consent to giving each Companion the discretion to dial 911 or otherwise arrange for the immediate provision of emergency care services by trained professionals. You agree that any emergency services ultimately provided may incur additional fees and expenses, which, in signing this Rider, You agree to assume and pay.

      You further agree to hold Lizzy Care harmless from and against any costs, fees, expenses, lawsuits, and all other liabilities related to any such emergency situation.

      Scheduling 

      Lizzy Care will provide the Companion Services at a predetermined schedule to be arranged with You. Companion Services are generally provided in person but can also be provided virtually under extenuating circumstances including inclement weather and health or safety hazards such as having a communicable illness. If you would like to make changes to your service schedule, contact your Lizzy Care coach or account manager. Please do not communicate requests for service changes with your individual Companion(s). 

      Lizzy Care will always endeavor to provide Companion Services to meet your schedule but cannot guarantee availability.

      Change and Cancellation Policy; Late/No Show Policy

      24-hours notice is required for any change or cancellation of Companion Services. If You need to cancel, please contact Your Companion and the Lizzy Care team through the App. Cancellations that take place with less than 24-hours notice are subject to full payment.

      If You are more than ten (10) minutes late past the scheduled Companion Services start time and provide no advanced notice, this session shall be considered to be forfeited, and full payment for that session will be assessed.

      Suspension/Termination

      Lizzy Care reserves the right to suspend and/or terminate the Companion Services at any time for any reason, but we will try to give You as much prior notice of any suspension or termination as we can under the circumstances. You may also suspend or terminate the Companion Services at any time, provided that You give us at least thirty (30) days prior notice.

      If the Companion Services are suspended or terminated, the rest of the Service Agreement will remain in effect unless You and us agree otherwise.

       

    • TERMS OF SERVICE AND PRIVACY POLICY

    • By accepting this Agreement, you agree to comply with the Terms of Service (“Terms”) and our Privacy Policy, which are available on our website and incorporated herein by reference. These documents govern the use of the Lizzy Care app and services.

    • PAYMENT TERMS

    • The Services are charged at $99 per month, payable in advance. 

      The core Services provided are included as part of your subscription, with no additional charges unless otherwise specified. The optional Concierge Support Services are available at a rate of $150 per hour and will be billed separately based on usage.

      Companion services arranged with at least 72 hours notice are offered at a rate of $45 per hour.

      Companion services arranged with under 72 hours notice are offered at a rate of $65 per hour.

      Companion holiday pay: A holiday is considered the 36-hour period that starts at 8 p.m. the evening before the holiday and extends to 8 a.m. on the day after the holiday. When a Companion provides services on the following ten holidays, their time worked is charged at time-and-a-half (1.5x) rates: Lizzy Care recognizes the following holidays:

      • New Year’s Day
      • Martin Luther King Jr. Day
      • Easter Day
      • Presidents’ Day
      • Labor Day
      • Memorial Day
      • Juneteenth
      • Independence Day
      • Thanksgiving Day
      • Christmas Eve (entire day)
      • Christmas Day
      • New Year's Eve (entire day)

      Overtime rates: Hours that a companion works above 40 hours per week will be billed at time-and-a-half (1.5x) rates dependent on local regulation.

      Payment for the optional Concierge Support Services and Companion Services will be due upon receipt of the invoice, with payment expected within 10 days. 

      Expenses and disbursements

      Lizzy Care invoices include all expense disbursements, which are paid by Lizzy Care staff on your behalf. We will bill you for the cost of purchases made on your behalf.

       

    • TERMINATION

    • You or us may terminate this Service Agreement at any time, for any reason (or no reason), on thirty (30) days’ written notice and services will continue until then. If you wish to Terminate please email info@hilizzy.com.

      In addition, any breach of this Agreement, including the Terms and Privacy Policy, attempt to provide a Lizzy Care Coach or other representative with deliberately misleading information, information that You do not have a legal right to disclose, or any behavior that is considered by Lizzy Care, in its sole discretion to ridicule, mock, disparage, intimidate, or abuse a Lizzy Care representative will result in immediate termination of this Agreement.

      Lizzy Care may also terminate this Agreement for any of the reasons set forth elsewhere in this Agreement, the Terms, and the Privacy Policy.

    • PERSONAL RESPONSIBILITIES AND RISK

    • Customer acknowledges that they take full responsibility for the life and wellbeing of the Care Recipient, and all decisions made during and after this program.

      Customer expressly assumes the risks of this program. The Customer releases and agrees to hold Lizzy Care harmless from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which the Customer ever had, now has or will have in the future against Lizzy Care, arising from the Customer’s past or future participation in, or otherwise with respect to, the Services, unless arising from the gross negligence of Lizzy Care or its affiliates.

    • DISCLAIMER

    • Without limitation to anything above, in providing the Services Lizzy Care will not under any circumstances prescribe or assess micro- and macronutrient levels; provide health care, medical or nutrition therapy services; or diagnose, treat or cure any disease, condition or other physical or mental ailment of the human body. You understand that Lizzy Care is not a professional health care entity and agree that Lizzy Care is not providing professional services of any kind, medical or otherwise. Where applicable, You further acknowledge and agree that nothing recommended by Lizzy Care or furnished over the course of the Services is intended to replace the opinion or analysis of a duly licensed health care professional.

      Accordingly, You agree that we have made no, there are no, and we disclaim all express and implied representations, warranties, and guarantees related to the performance of the Services. You understand that we have not guaranteed that the Services will achieve any particular result or outcome, and we are not obligated to deliver any particular result or outcome.

    • MISCELLANEOUS

    • These Terms and any other policies or operating rules posted by us within or regarding the Service shall constitute the entire agreement and understanding between you and Lizzy Care.

      You acknowledge and agree that we have the right, in Our sole discretion, to modify this Agreement from time to time, and that the modified Agreement becomes effective upon written notice to You or becoming live on Lizzy Care’s website. You are responsible for reviewing and becoming familiar with any such modifications. Your continued use of the Service after the effective date of the modifications will be deemed acceptance of the modified Agreement.
