For On-Hill and Off-Hill Activities

This Release and Waiver of Liability (the "Release") is executed, by the undersigned participant (the "Participant") in favor of Kissing Bridge and all its owners, employees, agents, and affiliated companies (collectively "Releasees"

I, the undersigned, acknowledge and fully understand that participation in recreational activities at Kissing Bridge, including but not limited to skiing, snowboarding, hiking, mountain biking, and rock wall climbing, carries inherent risks. These activities may result in injury, illness, disability, death, or property damage, including risks arising from terrain, weather conditions, equipment failure, or the actions of others.

I freely choose to participate in these activities and accept all risks, whether known or unknown, in doing so. My participation is voluntary, and I am solely responsible for determining whether I am capable and prepared to safely participate.

By signing this Release, I agree to assume full responsibility for all risks associated with my participation in the on-hill and off-hill activities at Kissing Bridge. These risks include but are not limited to: - Slips, falls, and collisions. - Equipment-related injuries. - Inclement weather or unpredictable terrain conditions. - Other hazards that may arise during the course of recreational activities.

4. WAIVER AND RELEASE OF LIABILITY

In consideration of my participation at Kissing Bridge, I hereby waive and release any and all claims against Releasees for any injury, damage, or loss sustained as a result of my participation in these activities. This waiver includes claims based on the negligence of Releasees, other participants, or otherwise, to the fullest extent permitted by law.

Iagree to indemnify and hold harmless the Releasees from any claims, damages, liabilities, or expenses (including attorneys' fees) arising out of or related to my participation in activities at Kissing Bridge.

In the event of a medical emergency during my participation, I authorize Releasees to seek medical treatment on my behalf if necessary. I agree thatI am responsible for all costs associated with such treatment.

I consent to the use of photographs, videos, or other media taken during my participation in Kissing Bridge activities for promotional purposes, without any compensation.

This agreement shall be governed by and construed in accordance with the laws of the State of New York. Any dispute arising under this agreement will be subject to the exclusive jurisdiction of the courts located in Erie County, New York.

If any provision of this Release is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Bysigning this form, I acknowledge that I have read, understand, and voluntarily agree to this Release and Waiver of Liability. I also confirm that no one has made any false representations or promises regarding my signing of this agreement.
