  • Terms and Conditions for Roadside Assistance through a Third-Party Mechanic

    1. Introduction These Terms and Conditions govern the roadside assistance services provided by BS and I Network Roadside Assistance (“Company”) through a third-party mechanic (“Third-Party Mechanic”). By utilizing these services, the customer (“Customer”) agrees to the following terms.

    2. Scope of Services Roadside assistance provided by Third-Party Mechanics includes but is not limited to:

    Minor mechanical repairs on-site (when feasible)

Third-Party Mechanic Engagement The Company utilizes independent third-party mechanics to perform roadside assistance services in the instances where a member's vehicle surpasses the basic roadside assistance. While the Company will make all reasonable efforts to engage qualified and reputable mechanics, it does not guarantee the workmanship, timeliness, or availability of the Third-Party Mechanic. The Company will not be held liable for any delays or errors in service resulting from the Third-Party Mechanic.

    4. Service Availability Roadside assistance is available 24/7 in designated service areas. Availability may vary due to factors such as geographic location, weather conditions, and road access. The Company reserves the right to refuse service in areas deemed unsafe for mechanics.

    5. Service Fees Any fees associated with roadside assistance services are determined based on the nature of the service, location, and the Third-Party Mechanic’s rates. The Customer will be informed of the estimated service cost prior to dispatch. Additional charges may apply if the Customer requests services beyond the standard roadside assistance package. Payment is due upon completion of the service unless otherwise agreed.

    6. Liability The Company acts as a facilitator between the Customer and the Third-Party Mechanic and assumes no liability for any damage, loss, or injury arising from the services provided by the Third-Party Mechanic. The Customer agrees to hold the Company harmless for any issues that may arise during or after the service. Any claims or disputes related to service quality must be addressed directly with the Third-Party Mechanic.

    7. Limited Warranty Roadside assistance services provided by Third-Party Mechanics are offered on an “as-is” basis. The Company does not provide any warranties, whether express or implied, regarding the quality of the services rendered. Any warranties on parts or labor must be discussed and obtained directly from the Third-Party Mechanic.

    8. Customer Responsibilities The Customer must ensure the safety of themselves and the mechanic during the roadside assistance. The Customer agrees to provide accurate information regarding the vehicle’s condition, location, and any other relevant details. The Company and Third-Party Mechanic reserve the right to refuse service if the Customer’s behavior or the situation is deemed unsafe.

    9. Cancellation and Delays If the Customer needs to cancel a service request, they must notify the Company immediately. The Company reserves the right to charge a cancellation fee if the mechanic has already been dispatched. The Company is not responsible for delays in service caused by external factors such as traffic, weather, or road conditions.

    10. Indemnification The Customer agrees to indemnify and hold harmless the Company, its officers, employees, and agents, from and against any claims, liabilities, damages, costs, and expenses (including legal fees) arising from the use of Third-Party Mechanic services or the breach of these Terms and Conditions.

    11. Governing Law These Terms and Conditions shall be governed by and construed in accordance with the laws of Portland/ Jamaica. Any disputes arising from these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of [Jurisdiction].

    12. Amendments The Company reserves the right to amend or modify these Terms and Conditions at any time without prior notice. The updated Terms and Conditions will be available on the Company’s website and will take effect immediately upon posting.

    13. Acceptance By requesting and using roadside assistance services facilitated through the Company, the Customer acknowledges and accepts these Terms and Conditions.
