This Foster Care Agreement and Liability Waiver (“Agreement”) is entered into as of the date set forth below by Big Dogs Don't Cry, Inc. (“BDDC”), a nonprofit organization, and the undersigned foster caregiver (“Foster”). The Foster has voluntarily contacted BDC and expressed an interest in fostering a dog in the care and custody of BDDC.In consideration of BDDC's agreement to allow the Foster to provide temporary care and shelter for one of BDDC’s dogs, the Foster agrees to the following terms: (check all boxes):*

The foster understands that completing this application does not guarantee that they will be allowed to foster a dog, and that the application is a tool to help Big Dogs Don't Cry Inc. make the best decision for the pet.The foster certifies that the information provided is true and complete.The foster certifies that they have never been convicted of animal cruelty or neglect.The foster understands the responsibilities involved in fostering a dog and agrees to adhere to them.The foster agrees to allow a representative from Big Dogs Don't Cry, Inc to contact their vet for a reference and also agrees to allowing a home visit prior to fostering this dog.Acknowledgment of Risks. The Foster acknowledges that fostering a dog involves inherent risks, including but not limited to bites, scratches, and other physical injuries, and in some cases, serious bodily injury or death. The Foster fully understands these risks and voluntarily assumes all such risks associated with caring for and interacting with the dog placed in their care.Foster Zoonotic Disease Awareness Disclosure. The foster acknowledges that fostering at Big Dogs Don’t Cry may involve exposure to zoonotic diseases, which can be transmitted from animals to humans and from humans to animals. These diseases include, but are not limited to, rabies, ringworm, and certain bacterial and viral infections. The foster understands the importance of following all provided hygiene practices, personal protective equipment guidelines, and any other safety protocols to minimize these risks.The Foster Parent, for themselves, their heirs, personal representatives, and assigns, hereby agrees to release, waive, discharge, and hold harmless Big Dogs Don’t Cry, Inc. (BDDC), its directors, officers, employees, volunteers, agents, representatives, and any other parties acting on behalf of BDDC, from any and all liability, claims, demands, and causes of action arising out of or in any way related to the Foster Parent’s fostering of the dog, including but not limited to any injuries, damages, or losses caused by the dog while in my care, whether caused by the negligence of BDDC or otherwise.This waiver includes, but is not limited to, claims of bodily injury, property damage, death, or other losses resulting from the Foster Parent’s exposure to or interaction with the dog, as well as any damages to third parties or third-party property caused by the dog during the fostering period.Third-Party Liability. The Foster Parent acknowledges that they are responsible for any injuries or damages caused to third parties (such as visitors, other pets, or property) resulting from their actions or the actions of the foster dog while in their care. The Foster Parent agrees to hold BDDC harmless from any claims, demands, causes of action, or damages resulting from injuries or property damage to third parties caused by the foster dog.Indemnification. The Foster agrees to indemnify and hold harmless BDDC, its directors, officers, employees, agents, and representatives from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of the Foster’s actions or omissions during the foster period, or any claims brought against BDC due to the Foster’s participation in activities related to fostering the dog.Medical Consent. In the event of an injury or emergency, the Foster grants BDDC permission to seek medical treatment on their behalf, understanding that BDC will make reasonable efforts to contact the Foster or their emergency contact as soon as possible. This consent includes treatment for injuries or health conditions sustained while fostering or interacting with the dog.Age and Legal Capacity. The Foster confirms that they are at least 18 years of age.Return of Foster Dog. The foster agrees to return the foster dog to BDDC if at any time they can no longer care for the dog, and they will not rehome, transfer, or sell the dog without prior written consent from the organization. If the dog is returned to BDDC, they understand that they are not entitled to a refund or reimbursement for any expenses related to the care of the dog.Home Visit and Follow-Up. The foster agree to allow a representative of BDDC to conduct a home visit and periodic follow-ups to ensure the welfare of the foster dog. This may include in-person visits, phone calls, or emails.
By signing below, the Foster affirms that they have read, understood, and voluntarily agree to the terms of this waiver and release. The Foster further affirms that they are physically and mentally capable of caring for the dog during the foster period and will comply with the terms and responsibilities outlined in the Foster Care Agreement & acknowledge the Zoonotic Disease Awareness Disclosure. *
