WHEREAS, the Student wishes to participate in the lash training and certification program provided by the Lash Educator, which may include theory, demonstrations, hands-on practice, and the application of eyelash extensions on live models and/or mannequins;

WHEREAS, the Student acknowledges and understands that there are inherent risks associated with learning and applying eyelash extensions, including but not limited to allergic reactions, eye irritation, infection, injury, and potential damage to natural lashes, among others;

NOW, THEREFORE, in consideration of the Lash Educator providing the Training Program and allowing the Student to participate, the Student agrees to the following terms and conditions:

1. Assumption of Risk
The Student acknowledges that they voluntarily choose to participate in the Training Program and assume all risks of injury, illness, damage, or loss that may result from participation, whether caused by the negligence of the Lash Educator or otherwise.

2. Release and Waiver of Liability
The Student hereby releases, waives, discharges, and holds harmless the Lash Educator, including their employees, agents, representatives, and assigns, from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by the Student, whether caused by the negligence of the Lash Educator or otherwise, while participating in the Training Program.

3. Indemnification
The Student agrees to indemnify and hold harmless the Lash Educator from any loss, liability, damage, or costs, including court costs and attorney fees, that may arise due to participation in the Training Program, whether caused by the negligence of the Lash Educator or otherwise.

4. Medical Treatment
The Student acknowledges that the Lash Educator does not provide medical or health services and that any injury or adverse reaction arising from participation in the Training Program is solely the Student's responsibility. The Student agrees to seek medical attention and treatment at their own cost if necessary.

5. No Guarantees or Warranties
The Lash Educator makes no guarantees, representations, or warranties, express or implied, regarding the Student's ability to perform eyelash extension services or pass any certification exams upon completion of the Training Program.

6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of New York.

7. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.

IN WITNESS WHEREOF, the parties hereto have executed this Waiver of Liability and Hold Harmless Agreement as of the day and year first above written.

Acknowledgment of Understanding

The Student acknowledges that they have read this Agreement, fully understand its terms, and sign it freely and voluntarily. The Student understands that by signing this Agreement, they are waiving certain legal rights, including the right to sue the Lash Educator.
