Adopter Responsibilities
1. The adopter agrees to provide a safe, loving, and permanent home for the pet.
2. The adopter agrees to provide the pet with regular veterinary care, proper food, water, shelter, and exercise, as appropriate for its species and breed.
3. The pet will not be sold, given away, or transferred to any other individual or entity without prior written approval from Whisker's Way.
Return Policy
4. If the adopter is unable to keep the pet, they agree to return the pet to Whisker's Way and will not surrender it to another rescue, shelter, or individual without prior consultation with Whisker's Way.
Health and Behavior Disclosure
5. Whisker's Way has disclosed all known health and behavioral issues of the pet at the time of adoption. The adopter acknowledges they are adopting the pet "as is" and accepts full responsibility for the pet’s health and behavior moving forward.
Adoption Donation:
6. The adopter agrees to make a donation to Whisker's Way, which is tax-deductible according to IRS 501(c)(3) guidelines. This donation helps cover the costs of veterinary care, feeding, and housing for animals at Whisker's Way.
Indemnification
7. The adopter agrees to indemnify and hold harmless Whisker's Way, its employees, and volunteers from any claims, damages, or liabilities caused by the pet after the adoption is completed, including injuries to persons or property.
Waiver and Assumption of Responsibility
I, the undersigned, acknowledge that I am voluntarily fostering the pet described above under a foster-to-adopt arrangement and assume full responsibility for the pet’s care, well-being, and any risks associated with the pet during the foster period.
8. I understand that Whisker's Way has provided all known information about the pet’s health and behavior at the time of adoption.
9. I agree to assume all risks related to the pet’s health, behavior, and future care.
10. I agree to indemnify and hold harmless Whisker's Way Animal Sanctuary from any claims, damages, injuries, or liabilities caused by the pet after adoption, including damages to persons or property.
Foster-to-Adopt Terms
11. The foster-to-adopt period begins on the date signed and will continue until the pet is deemed healthy and can be spayed/neutered, after which the adoption will be finalized.
12. The foster-adopter agrees to provide regular care and veterinary checkups to monitor the pet’s health during this foster-to-adopt period. Whisker's Way will cover veterinary costs at the designated vet during this time.
13. The pet must be spayed/neutered at Whisker's Way’s vet, with costs covered by Whisker's Way, or at the foster-adopter's vet with comparable or lower costs. Proof of spay/neuter must be provided to Whisker's Way.
14. If the foster-adopter chooses their own vet for the spay/neuter, they must provide an itemized estimate before the procedure for approval. Whisker's Way will only cover the cost if it is comparable to or less than the quote from Whisker's Way’s vet.
Arizona Liability & Animal Bite Disclosure
15. The adopter/foster acknowledges that under Arizona law, the owner and/or caretaker of an animal may be held legally responsible for injuries or damages caused by that animal. By entering into this agreement, the adopter/foster expressly agrees to assume full legal and financial responsibility for the animal upon placement, whether under foster-to-adopt or finalized adoption.
The adopter/foster understands and agrees that any bites, injuries, property damage, or incidents involving the animal after placement are the sole responsibility of the adopter/foster. The adopter/foster releases and waives Whisker’s Way from all liability related to any such incidents, including but not limited to:
-dog or cat bites, scratches, or attacks
-injury to children, adults, or other animals
-damage to homes, vehicles, or personal property
-medical treatment, veterinary care, or legal claims
The adopter/foster further agrees to indemnify, defend, and hold harmless Whisker’s Way, its directors, officers, volunteers, and fosters from any and all claims, lawsuits, damages, losses, or legal actions arising from the animal at any time after placement.
Homeowner’s / Renter’s Insurance Acknowledgment
16. The adopter/foster acknowledges that they are solely responsible for maintaining adequate homeowner’s or renter’s insurance to cover any animal-related incidents, damages, or injuries. The adopter/foster understands and agrees that Whisker’s Way does not provide any insurance coverage for the animal after placement and shall not be held financially responsible for any claims arising from the animal.
Governing Law & Venue
17. This agreement shall be governed by and interpreted in accordance with the laws of the State of Arizona. Any legal action or proceeding arising under this agreement shall be brought exclusively in a court of competent jurisdiction located within the State of Arizona.
