- PLEASE BE RESPECTFUL TO OTHERS BERTHED AT THE DOCKS.
- KEEP ALL DOCK LINES TIDY SO AS NOT TO OBSTRUCT PEDESTRIAN TRAFFIC
- IF YOUR BOAT DOES NOT HAVE A HOLDING TANK PLEASE USE PUBLIC FACILITIES. ABSOLUTELY NO DISCHARGE INTO HARBOUR. (Fines apply)

GENERAL TERMS & CONDITIONS OF BERTH USAGE
1. For purposes of this agreement, the contracting party, on behalf of the vessel using the berth, shall be referred to as the “Owner” and the St. George’s Marina Development Ltd shall be known as the “Company”. The party executing this
  agreement as Owner, shall either be the owner of the Vessel, or shall be authorized on behalf of the Owner to enter into this agreement.
2. The Owner acknowledges that this agreement is for use of the Berth only and that use of the Berth is at the risk of the Owner. The Owner shall at all times keep any vessel using the Berth property and securely berthed and the Company shall not be liable for the care and protection of the vessel (including gear, equipment, and contents) at any time. The Company whether by its servants, agents or otherwise shall not be liable for any loss, damage, or injury of whatever nature and from whatever cause arising to the vessel of any property of the Owner of the vessel or any property of the crew, agents, contractors, licensees, invitees, or guests of the vessel or in respect of personal injury, loss or damage, suffered by the owner of or the Owner’s servants, agents, sub-contractors, licensee, invitees, or guests unless such injury, loss, or damage is caused by willful negligence or willful act of the Company, its servants, or agents
3. The Owner agrees to indemnify and shall keep indemnified the Company, its servants or agents against any and all demands, claims, actions, proceedings, liabilities, costs and expenses in anyway arising from or in connection with any
  act or omission of the Owner of the Owner’s servants, agents, sub-contractors, licensees, invitees, or in any way arising from any defect in or caused by any vessel or other property of the Owner or the Owner’s servants, agents, sub-contractors, invitees, or guests save for any willful negligent act willful omission on the part of the Company, it’s servants, agents, sub-contractors, licensees, or invitees. The Owner further indemnifies and shall indemnified the Company, its servants, agents, against any and all demands, actions, proceedings, liabilities, costs and expenses in any way arising out of the use of the Berth or handling of the vessel in connection therewith save for any negligent act or willful omission on the part of the Company, its servants, agents, sub-contractors, licensees, or invitees.
4. The Owner confirms that the vessel and any other property on the vessel is adequately insured against loss or damage and the Owner undertakes to maintain adequate third party insurance in the respect of himself and the vessel and his crew, for guests, his agents, sub-contractors, licensees, or invites to the extent insurable and will continue to maintain such insurance for the term the vessel is occupying and using the Berth. Third party insurance must be at a minimum level of $1,000,000 USD or such level that is determined by the Company from time to time. Such insurance shall be effectively maintained in an insurance office of repute and the Owner shall if required, produce the policy or policies relating hereto and receipt of insurance fees paid thereon to the Company on demand. 5. The Owner and/or the Captain, for themselves, and on behalf of the crew of the vessel, agree at all times to comply with the Rules and Regulations of the Marina which may be varied from time to time, the most recent of which is attached hereto.
  I can confirm that I am the Owner of the vessel or in the alternative that I am duly authorized on behalf of the Owner to enter into this Berthing Agreement for and on behalf of the Owner.
